I, Robert Smith of the County of Stanly and State of North Carolina being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last Will and Testament in manner and form following: that is to say, first that my Executor (hereinafter named) shall provide for my body a decent burial suitable to the wishes of my relations and pay off funeral expenses, together with my just debts, however, and to whomsoever owing out of the moneys that may first come into his hands as a part or parcel of my estate.
Item 1st. I give and devise to my son Archibald C. Smith all that tract of land whereon he now lives, valued to him at three hundred dollars, to have and to hold to him and his heirs in fee simple forever. (Item) I give and devise to my son Parham Smith all that tract of land whereon he now lives valued to him at three hundred dollars to have and to hold to him and heirs in fee simple forever.(Item) I give and devise to my son Alsey Smith all that tract of land whereon he now lives valued to him at three hundred dollars to have and to hold to him and heirs in fee simple forever.
(Item) I give and bequeath unto my daughter Tobitha wife of Edmund Nash three hundred dollars to be paid by my Executor within two years after my death out of any monies belonging to my estate not otherwise disposed of to be hers and at her disposal absolutely forever.
(Item) I give and bequeath to my daughter Wincey Snuggs wife of Richmond G. Snuggs three hundred dollars to be paid by my Executor within two years from my death out of any monies belonging to any estate not otherwise disposed of to be at her disposal absolutely forever.
(Item) I give and bequeath to my daughter Martha Bell wife of Jonathan Bell the sum of three hundred dollars to be paid by my Executor within two years from my death out of any monies belonging to my estate not otherwise disposed of to be hers and at her disposal absolutely forever.
(Item) I give and bequeath to the children of my son Henry Smith Decd who now resides in the West fifty dollars each which sum is to be retained by my Executor until they arrive at twenty one years of age to be paid out of the proceeds of my Estate by my Executor on condition however said heirs do not apply for the said fifty dollars within two years after they become of age in that case it is my will that said amount be divided between my three sons, A.C. Smith, Parham Smith, and Alsey Smith and my three daughters, Tobitha Nash, Wincey Snuggs and Martha Bell.
(Item) I give and bequeath to the children of my daughter Elizabeth Callaway Decd wife of John Callaway three hundred dollars to be paid by my Executor within two years from my death out of any monies belonging to my Estate not otherwise disposed of to be theirs and at their disposal as they arrive at age forever in what I will my daughter Elizabeth Callaway's children I except her son Robert who now resides in the West, it is my will and wish that he shall (have) nothing of my Estate.
(Item) I give and bequeath to the heirs of my son John Smith Decd two hundred and twenty five dollars to be theirs as they arrive at the age of twenty one years to be theirs forever.
(Item) I give and bequeath to my daughter Nancy Kendall wife of Elums Kendall the sum of three hundred dollars if she is living if not to her children on condition she does apply for said amount within two years after my death of her children with two years after they become of age in that case it is my will that the said three hundred dollars be equally divided between the same six sons and daughters named in the condition of Henry Smith's heirs.
And lastly it is my wish and will that all the residue of my estate if any left be equally divided between my three sons and daughters (viz) A.C. Smith, Parham Smith, Alsey Smith and my three daughters Tobitha Nash, Wincy Snuggs and Martha Bell; And finally I do hereby constitute and appoint my son Archibald C. Smith my lawful Executor to all intents and purposes to Execute this my last will and Testament according to the intent and meaning of the same and every part and clause thereof, hereby revoking and declaring void all other wills by me heretofore made. In witness whereof I have hereunto set my hand and seal this 27th day of March AD 1848. Robert Smith (seal)

November Sessions 1848 when the foregoing last Will and Testament was offered for Probate and the Execution thereof was duly proven on data of the subscribing witness A F Atkins and Wm Biles.
