General Notes:
Andrew appeared in the Edinburgh Court of Justiciary on 16th July 1821 along with his father, Lewis, and Alexander Smith all accused of house-breaking and theft from the houses of Mr Darling, plasterer, and Miss Cossar both in Norton Place, South Leith. Only Andrew pleaded guilty and the Lord Advocate stopped the indictment of Lewis and Alexander Smith proceeding further without the facts being determined. Andrew was sentenced 14 years transportation. He was transported on the ship Guildford which departed on the 4th April 1822 and arrived in New South Wales on the 15th July 1822.
A year earlier Andrew had been accused of housebreaking and theft along with John Lawson. They were accused of breking into the house of Mr Mowbray, Hope Street, Leith and stealing a number of silver spoons, also, breaking into the home of Mr Burn, West Bush, Inveresk and stealing a great number of silver aticles. On this occasion the Lord Advocate stopped the indictment proceeding further without the facts being determined on. The trial notes name Andrew as Andrew Hutton, son of Lewis Hutton, Smith, Water Gate. Age 14. Nailer. Address: Prisoner in Edinburgh, formerly Cowgate Edinburgh.
John Lawson did however end up being convicted for another crime and was transported to Australia on the same convict ship as Andrew Hutton which set sail on the 4th April 1822. John Lawson stole a silver watch from a jewellery shop.
In Australia Andrew was given a Ticket of Leave on the 31st January 1830, 8 years into his sentence of 14 years. Andrew married Catherine Dougald in 1850. He became a drover and cattleman working at Nungatta Run close to the Victoria Border. Due to drought he took 500 head of cattle down river to Genoa and then onto Gippsland. There is a map of Victoria with his name and route that he took - the Aboriginals drove him out. In 1840 Angus Mcmillan (explorer) took up Bushy Park Briagolong near Maffra Victoria and Andrew Hutton worked on the property. He is listed in the 1856 electoral roll for Gippsland at one hundred pound per annum for Mcmillan, the McMillan house is still at Briagolong but in very poor state.
