Hugh was a labourer (Road Worker). In the 1841 census when he was in his 20s he, his wife and young family were recorderded living with his parents in Campbells Close, Canongate, Edinburgh. Ten years later he is recorded as head of the household at 82 Grassmarket, Edinburgh with his wife Ann and children and with them were his sister Sarah, her husband and their young family.

Hugh died in 1860 as a result of an accident following horseplay. A newspaper report of the incident reads:
FATAL OCCURRENCE.- Yesterday afternoon, Hugh M'Ginty, a labourer, residing at 116 Cowgate, and another man named Adam Riddell, had been in a public-house near the foot of the Horse Wynd; and on coming out about half-past six o'clock they began in frolic, while standing on the street, to try which could twist the other's hand with the greatest force. As they were engaged in this trial of strength, a farm-servant, belonging to Selms, near Kirkiston, came up with two carts laden with brewey grains, and just as they were passing both men fell - Riddell towards the foot of the Wynd, and M'Ginty outwards towards the street. Unfortunately M'Ginty's head fell immediately before the wheel of the hindmost cart, which passed over his cheek and part of his skull. He was immediately removed to the Royal Infirmary, but was found to be dead on his arrival. He was about forty years of age, and has left a wife and family. No blame can be attached to the driver of the carts; he was at his first horse's head, the the men had not fallen when he passed them, and he stopped his horse almost the moment they fell.

The statutory death register states he died at the gate of the Royal Infirmary from injuries of the chest and fracture of ribs and the informant was John McGinty - Brother.
