Deed of Gift

John Couch to Charity Mullins

This indenture made and entered into between John Couch, of the State of Alabama, Lawrence County of the one part, and Charity Mullins daughter of the said John Couch, as well for and in consideration of the natural love and affection which he the said John Couch, hath and beareth unto the said Charity, as also for upwards of sixteen years good service and also for the better maintenance support and livelihood of her the said Charity, hath given granted aliened enfeoffed and confirmed and by these presents doth give grant alien enfeoff and confirm unto the said Charity, her heirs and assigns, the following property to wit, one negroe girl named Caroline, about six years old, the 27th day of April last, to have and to hold the said negroe give Caroline unto her the said Charity, wife of Thomas Mullins her executors administrators and assigns, forever, and the said John Couch for himself and his executors and administrators the said negroe give Caroline unto the said Charity, her executors and assigns against the claim of him the said John Couch his executors and administrators and against the claim or claims of all and every person or persons whatsoever shall and will forever warrant and defend them by these presents, this the 9th day of June 1838.

Personally before me Wiley Galloway Clerk of the County Court of said County came John Couch, whose name is signed to the within deed, and acknowledged that he signed sealed and delivered the same to the within named Charity Mullins, on the day of the date thereof, and for the purposes therein expressed and requested me to certify the same for records.

 

In testimony whereof thereunto set my name at office the 11th day of June 1838

I Wiley Galloway Clerk of the County Court of said County, certify that the foregoing deed of gift was deposited in my office for registration, ever since and because there was no record neither could there be one procured, it was not recorded until this day when it was duly recorded in Deed Record Volume H, pages 52, 53. In testimony whereof thereunto set my name, and affix the seal of said County Court, at office in Moulton the 27th day of July AD 1838 and of American Independence the 63rd year.

I Bolling Baker Judge of the County Court of said County, hereby certify that Wiley Galloway whose name appears to the foregoing certificate is the regular clerk of said Court duly elected and qualified that full faith and credit are due to all his official acts as such that his signature is genuine, and his said certificate is in due favor of law.
