Will of Elijah Fuller

Progenitor of the Perry County, Alabama Fullers

Greene Co. Georgia
December 8, 1825

In the name of God amen, I, Elijah Fuller of the county of Greene, State of Georgia, being sick and weak in body but of sound mind and memory and calling unto mind the mortality of my body and knowing it is appointed for all men once to die, do make and ordain this my last will and testament that is to say principally and first of all I give and I recommend my soul into the hands of Almighty god that gave it an my body to the dust from whence it came. And as touching such worldly estate whereas it hath pleased God to bestow within this life, I give, devise and dispose of the sum in the following manner.

First, it is my will and desire that all my just debts be paid and also my funeral expenses.

2nd I give and bequeath to my loving wife Elizabeth [Boggis] Fuller the tract of lands where in now live during her widowhood, and at her intermarriage to be sold and the money thence arising to be equally divided among the said Elizabeth Fuller, Jesse Fuller, Alfred Fuller, Green Fuller, the heirs of David Fuller, the bodily heirs of Milly [Amelia] Glaze, the present heirs of Phoebe Fuller, Celeste Fuller, Elijah Fuller, John B. Fuller, Eliza Fuller, Martha Ann Fuller and Simeon Fuller. If the said Elizabeth Fuller should die before intermarriage then and in that case said land to be sold and the money thence arising to be equally divided among the rest of the above named heirs.

I give and bequeath to my daughter Polly Daniel the sum of one dollar to be paid out of my estate. I give and bequeath to my sons Alfred and Green Fuller the sum of one hundred and ten dollars each to be paid out of my estate. I give and bequeath to the heirs of David Fuller the sum of one hundred dollars to be paid out of my estate. I give and bequeath to the present heirs of Phoebe Fuller the sum of eighty dollars. I give and bequeath to the bodily heirs of Milly Glaze the sum of eighty dollars. I give and bequeath to Celeste Fuller the sum of one hundred fifteen dollars. I give and bequeath to Elijah Fuller, John B. Fuller, Eliza Fuller, Martha Ann Fuller and Simeon Fuller the sum of one hundred fifteen dollars. I give and bequeath to my wife Elizabeth Fuller the sum of one hundred fifteen dollars. I give and bequeath to my daughter Milly Glaze the sum of one dollar. I give and bequeath to my daughter Phoebe Fuller and my son David Fuller, the sum of one dollar each. It is my will and desire that all the rest of my be equally divided among the before mentioned heirs: viz., Jesse Fuller, Alfred Fuller, Green Fuller, the heirs of David Fuller, the present heirs of Phoebe Fuller, the bodily heirs of Milly Glaze, Celeste Fuller, Elijah Fuller, John B. Fuller, Eliza Fuller, Martha Ann Fuller, and Simeon Fuller and Elizabeth Fuller, it is my will and desire that my daughter Celeste's part of my estate be and remain in the hand of my executor until she hath a bodily heir but to receive and have every advantage arising there from. It is also my desire that a Negro woman by the name of Betty at the distribution of my property shall remain in the hands of some of my first wife's children.

Lastly, I constitute, ordain and appoint my sons Alfred and Green Fuller my sole executors of this my last will and testament ratifying and confirming this and no other to be my last will and testament in writing whereof I have hereto set my hand and seal this 8th day of December one thousand eight hundred twenty- five.
