the one part and Samuel Machesney of said County of the other
part witnesseth That the said William McFarron for and in consideration
of the sum of one hundred and ten pounds current money of Virginia to
him in hand paid Doth bargain and sell unto the said Samuel Machesney
and his heirs one certain tract or parcel of land in the said of
Washington containing two hundred and fifty acres Granted to the said
McFarron on both sides of spring Creek a branch of Holsteins river and
on the South side of the great Knobs and bounded as follows to wit
BEGINNING at a black Oak at the foot of the Knobs corner to Samuel
Machesneys land and with his lines South forty eight degrees east
thirty poles crossing the Creek to a p--?--k white oak South forty three
degrees East one hundred and fifty poles to two white oaks by a large
sink hole thence leaving said lines South thirty five degrees west two
hundred and thirty eight poles to a stake North eight degree west
seventy from poles to two white Oak saplins and a black Oak near the top
of a hill, South fifty seven degrees west forty poles to two white Oaks
by a sink hole north fifty four degrees west fifty three poles to a
large black Oak at the foot of the ----?-- thence along the same North
twenty degrees East three hundred and five poles to the
BEGINNING together with all
its appurtenances TO HAVE AND TO HOLD the said Tract or parcel of land
with its appurtenances to the said Samuel Machesney and his heirs to the

This Indenture Tripartite made this Thirty first day of August in the
year of our Lord one thousand seven hundred and ninty eight between
Thomas Berry Sr of the one part, Samuel McChesney of the other
part, and Esther Berry, wife of said Thomas of the third part.
Witnesseth that whoever the said Thomas Berry being late the proprietor
of a certain tract or parcel of land lying in the County of Washington
and State of Virginia and being arrived at an age when no Burgess
capable of superintruding that the management of a plantation has by and
with the amount of the said Esther his wife alienated and sold the same
unto a certain David McCord for the consideration one thousand three
hundred thirty three dollars and thirty three cents for which sum the
said David McCord with Thomas Berry his security has entered into two
seperate obligations, the one for eight hundred eighty eight dollars and
eighty eight cents and payable to David Lowery and Samuel McChesney
within six years after the death of said Thomas Berry Sr: to be applied
or shall be devised by his last Will and Testament, the other for four
hundred and forty four dollars thirtysix cents payable to Samuel
McChesney within six years after the death of the said Thomas Berry
Sr. for the use, interest and purpose hereinafter excepted. And
whosoever the said Thomas Berry in consideration of his love and
affection for the said Ester his wife and in consideration of her having
relinquished her right Domain in the land herein before mentioned &
being desireous of making provision for the said Esther his wife after
his death doeth Grant covenant and agree that aforesaid sum of four
hundred and fortyfour dollars and thirty six cents part of the
consideration of the land be sold to David McCord and for which an
obligation bearing date the twentyfourth day of August payable within
six years after the death of said Thomas Berry Sr: unto Samuel
McChesney shall vest in the said Samuel McChesney and that he
shall have right to collect and receive the same. And the said parties
agree that from and after six years after the death of the said Thomas
Berry the said sum of four hundred and forty four dollars and thirtysix
cents shall be the sole property and at the absolute disposal of her the
said Esther and that the right to the said sum of money herein vested in
Samuel McChesney is understood as a trust for the use behalf and
benefit of her the said Ester Berry from and after the period aforesaid
and the said Samuel McChesney consents and agrees for himself his
heirs executors & administrators that from and after the period
aforesaid he will relinquish all right or causes of right which he has
or may have Same or equity to that said sum of money. In witness of
which the parties have hereunder set their hands and affixed their seals

In the name of god amen, the sixteenth of December one thousand seven
hundred and ninety eight. I, Thomas Berry, of the County of Washington
and State of Virginia, being weak in body but sound in mind and knowing
that all flesh must yield to death when it shall please god to call, I
do hereby make constitute and ordain and declare this to be my last Will
and Testament in manner and form following revolking and anuling by
these present all and every testement or testaments will or wills
heretofore by me made and declare either by word or writing and this to
be taken only for my last will and testament and none other and now for
the settling my temperate estate and such goods and chattals and debts
as it pleased god for above my deserts to bestow on me. I do order, give
and dispose the same in manner and form following, And first I do will
that all my just debts be paid within convenient time after my decease
by my executors hereafter named and seconded, I do give and bequeath to
my well beloved wife Esther the third part of all the moveable Estate
except the negros as I have left her the third part of the price of my
land already. I do leave to my son George a negro named Adam and all my
wearing apparel and George is to give to my daughter Rebeckah fifty
dollars. I do also leave to my daughter Esther a negro girl named Phili
to her and her heirs and if the girl has any children they are to go to
Esther and her heirs, also my negro woman named Tawney I do allow her to
be free and I leave her a milch cow. I also leave to my son John, four
dollars. I also leave the rest of my estate to my children hereafter
named, son James, son Thomas, my daughter in law Mary Berry, wife to son
William deceased, my daughter Mary, my daughter Barbara, daughter
Rebeckah, my daughter Elizabeth, my daughter Susannah, my son
Francis to be equally divided among them. I also leave to my grandson
Thomas Dryden my best saddle. I also will that David Dryden and Samuel
McChesney and David Lowry shall be my Executors given under my hand and
seal this sixteenth of December 1798.

deceased, which has or shall come to the hands possessions or knowledge
of them the said Dryden Lowrey, & McChesney or with the Lands or
possessions of any other person or persons for them, and the same is
made do exhibit unto the Clerk of Washington County at such times, as
they shall be therefore required by the said Court, and the same goods
chattels and credits, do well and truly administer according to Law, and
making just and true account of their askings and doings therein when
thereunto required by the said court; and futher do well and truly pay
and deliver all of the Legacies contained and specified in the said
Will, as far as the said goods chattels and credits wills extend,
according to the value thereof and as the Law shall charge them; then
this obligation to be void Otherwise to remain in full force.

Articles of agreement made and entered into this sixth day of March in
the year one thousand eight hundred and two between David Shaver of the
County of Washington & State of Virginia of the one part and William
King & Samuel McChesney of the County & State aforesaid of the
other part
WITNESSETH that David Shaver doth bargain and sell unto the said William
King and Samuel McChesney one certain parcel or quantity of land
lying and being on the waters of fifteen mile Creek now owned and
occupied by said Sheaver bounded in part as follows
BEGINNING at a white oak tree corner to David Drydens and Ale.x Doran
Land and with the lines of said Doran across the aforenamed Creek to a
corner of said line and along the lines of Adam Hope and Sheaver for
quantity sufficient to make up the sum of one hundred and three pounds
seven shillings and one penny now due from the said David Sheaver to the
aforesaid King and McChesney. But if said Shaver shall well and
truly pay the above sum of 103.71 unto the W. King and McChesney
on or before the first day of May next after the date hereof then and in
that case this sale to be be void. But if said Sheaver should fail to
pay the above mentioned sum against the first day of May next the said
Sheaver is to pay lawful interest on the above sum and until paid and if
the above sum of 103 pounds seven shillings and one penny is not paid
before the first day of May eighteen hundred and three then and in that
case the land afore described on a sufficience thereof to be exposed to
public Sale by the afore mentioned William King and Samuel McChesney
to discharge the above sum with interest and cost if any should arise
thereon and the said Sheaver doth hereby bond himself his heirs
executors and administrators to make unto the purchase a good sufficient
title in fee simple for whatever quantity may be found necessary to
discharge the above sum with interest and cost as above. But if said
Sheaver should not return before the first day of May one thousand eight
hundred and three from a journey now contemplated by the said Sheaver to
the Natches In that case the said Sheaver heirs executors or
administrators is to have to the first day of May one thousand eight
hundred and four to pay the above sum or convey the Land as before. But
said Shaever doth hereby secure all his houses and mills anything to the
contrary notwithstanding. In witness whereof we hereby bind ourselves
our heirs executors & administrators for the true performance of the

In the name of God amen, I Samuel McChesney of the State of
Virginia and County of Washington being sick and weak in body but of
sound mind and disposing memory and calling to mind the uncertainty of
human life and being desirous to dispose of all such worldly estate as
it hath pleased God to bless me with;
first, I recommend my soul to Almighty God and my body to be decently
buried as my executors hereafter named shall think proper.
Secondly, after paying my just debts and funeral expenses, I give and
bequeath to my loving wife Susanna McChesney the plantation I now
live on known by the name of McFerrons (excepting fifty acres to be laid
of along Wm. Maxwells line from Hugh McChesney’s land to the glade) with
all appurtenances to be disposed of by her as she shall think proper.
Thirdly, I give to my son, Thomas McChesney my other tract of land
purchesed of George Berry with all appurtances to be at his disposal.
Fourthly I give to my brother Hugh McChesney the fifty acres of land
excepted to in the second article to be laid of as there directed to be
his in fee simple.
Fifthly, I give to my loving wife Susanna McChesney a negro woman
named Fan and three children, Adam, Lucy and Nancy, the three last to be
disposed of as she shall think proper (Fan to be free at her mistresses
death and to receive twenty pound paid out her Mistresses part) also I
give to her one horse named fox and one other horse trained to work as
to my cattle after selecting what came into my stock with my daughter in
law Sarah and all their increase. I give to my loving wife one half of
the same to be at her disposal and one half of my stock of sheep and one
third of my hogs.
Sixthly to my Son Thomas McChesney the remainder of my personal estate
consisting of one negro man named Harry, horses, cattle sheep hogs
farming utensils & on condition that he pay all my lawful debts out of
his part herein bequeathed him as also debts by note on otherwise to me
due are at his disposal.
Seventhly, I give to my brother Hugh McChesney one deep blue cloth coat
also black velvet jacket and breeches.
Eighthly to my nephew Samuel McChesney son of Hugh McChesney out of
estate a full suit of broad clothe.
Ninethly to said Hugh McChesney’s son, John McChesney, I give a bared
cotton coat. Tenthly, I constitute my brother, Hugh McChesney and my son
Thomas McChesney executors of this my last will and testament hereby
revoking all other or former Wills or Testaments. In witness whereof I
have hereunto set my hand and affixed my seal this 25th day of March in
the yar one thousand eight hundred and three.

At a court held for Washington County
The last Will and Testament of Samuel McChesney dec.d was
produced in court and prove in court by the oath of Matthew Willoughby
the only subscribing witness thereto and it being considered by the
court that the same is sufficient to pass personal estate altho not
sufficient to pass real estate, not have been written by the said
decedent it is ordered that the same be recorded. Hugh McChesney one of
the executors named in the said Will appeared in court and refused
taking on him the executorship. And on the motion of Thomas McChesney
another executor mentioned in t e said Will who took the oath of an
executor prescribed by land and entered into and acknowledged a bond
with John Shapr and David King his securities in the penalty of four
thousand dollars conditioned at the law directs a certificate is
therefore granted him for the probat of the said will in due form.

This INDENTURE made the nineteenth day of October in the year of our
Lord one thousand eight hundred and seven between Hugh McChesney and
Sarah his wife of the one part and Thomas McChesney of the other part,
both of the County of Washington and state of Virginia
WITNESSETH That the said Hugh
McChesney and Sarah his wife for and in consideration of the sum of two
hundred pounds current money of Virginia in hand paid the receipt of
which is hereby acknowledged, hath granted bargained and sold and by
these presents doth grant bargain and sell unto Thomas McChesney and to
his heirs a certain tract or parcel of land lying in Washington County
and state of Virginia, containing one hundred acres more or less and
bounded as followeth. Viz,
BEGINNING at a Iron thorn at the head of a Spring Thence 7 ° E 23 poles
to Two White oak saplings Thence crossing the Creek N 51° E 8 poles to a
White oak on the north side S 51° E 60 poles to a White oak S 77° E 84
poles to a white oak and Buckeye on the north bank of the creek Tense
crossing the creek S 2° E 40 poles to a post oak on the top of a ridge S
68° W 76 poles to a black oak among rocks N 38 W 37 poles to five White
oak grubs near a stake on the old line N 15 W 112 poles to the
BEGINNING,
Together with another certain Tract or parcel of land containing Eighty
Two acres more or less by a survey dated the 26th of September Eighteen
hundred lying in Washington County and bounded as followeth. Viz:

land owned by Samuel McChesney in his lifetime to a White oak by

Kings Corner and with his line S 55 W 112 poles to 2 Hickeries and a
post Oak on Sharp & Kings line and on the same N 53 West 98 poles to a
Hickery on the side of the Knobb N 35 E 100 poles to the BEGINNING
With their and each of their appurtenances to have and to hold the said
Tracts or parcels of land with their appurtenances to the said Thomas
McChesney and to his heirs forever, and the S.d Hugh McChesney and Sarah
his wife for themselves and their heirs will forever Warrant and defend
the above described tracts of land With their appurtenancies to Thomas
McChesney and to his heirs forever both from persons claiming under or
by them and from all other claims or persons whatever IN WITNESS whereof
the said Hugh McChesney and Sarah his wife have subscribed their names
and affixed their Seals the day and date above written.
