THIS INDENTURE made on the fifteenth day of August One thousand seven hundred and eighty Between Daniel Smith of Washington County on behalf of Thomas Walker of Albermarle County, Esq. and who acts by virtue of a Power of Attorney from the said Walker recorded in the Court of Washington County (recourse thereto being had will fully appear) the said Daniel Smith being of the one part and James Berry of Washington County of the other part. WITNESSETH that the said Daniel Smith for and in consideration of the sum of thirty four pounds six shillings current money to him in hand paid for the use of the said Thomas Walker, the receipt whereof he doth hereby acknowledge hath granted bargained and sold, and by these presents doth grant bargain and sell unto the said James Berry and his Heirs and Assigns one certain tract or parcel of Land lying in the County of Washington containing by estimation three hundred and twelve acres be the same more or less surveyed by W. Robert Doak, dece.d, and being part of a larger tract of land at the Wolf Hills, belonging to the said Thomas Walker and bounded as followeth (viz)
BEGINNING at a large white Oak by the Creek, running thence north six degrees east crossing the Creek one hundred and sixteen poles to a white oak and a black oak on the east side of a ridge,
north twenty degrees EAST one hundred and forty poles to two white oaks on the west side of a ridge, north eighty four degrees, west two hundred and forty poles to a white oak and black oak on the patent line, thence with the said line south, two degrees and an half east one hundred and six poles to three white oaks, west seventy poles to three white oaks by a spring, South two degrees and an half east one hundred and twenty poles to a large white oak, Wt Oak sapling and small poplar, south eighty degrees east two hundred and twenty four poles to the BEGINNING Together with the appurtenances thereto belonging. TO HAVE AND TO HOLD the said tract of land with its appurtenances unto the said James Berry his heirs and assigns to the sole use of the said James Berry his heirs and assigns. And the said Daniel Smith and his heirs by virtue of the power of Attorney above mentioned, the said tract of land with its appurtenances unto the said James Berry and his heirs and assigns against the claims of all persons will forever warrant and defend. IN WITNESS whereof the said Daniel Smith hath hereto subscribed his Name and affixed his Seal, the day and Year first above written.

IN THE NAME OF GOD AMEN I Charles Berry Senr. of the County of Augusta in the State of Virginia, farmer, Being Very Sick and weak in Body but of Perfect Mind and Memory Thanks be Given to Almighty God for the same and Calling to mind the Mortality of my Body and Knowing that it is appointed for all men once to Die do make and Ordain this my last Will and Testament in manner and form following, First I Recommend my Soul into the hand of God that Gave it and my Body to the Earth to be buried in a Christian Like and decent Manner at the Discreation of my Executors and as Touching Such Worldly Estate as it hath Pleased God to bless me in this life I give and Dispose of the Same Manner and for following Impremis I Give and Bequeath to my beloved wife Mary Berry the one half of my moveable Estate after my Just Debts and funeral Chages is paid By my Executors and my Plantation that I now Live on for her Support During widowhood or Natural Life and my two oldest Negroes Viz Tom and Mack for her support and my son Robert Berry The Property Land and Negroes is to Equally for the Support of my Beloved Wife and my son Robert Berry dureang my Beloved Wifes Life and at her Death the whole of s.d property Property to Become the Property of my Son Robert Berry and his heirs and assigns for Ever- Only if the Two Negroes have any Increase they are to be at my Wifes Disposal. Item I give and Bequeath to my son John Berry my Plantation or Tract of Land above and Joining the tract I now Live on to be his and his heirs and assignes for Ever the s.d Two Tracts to be Equally Divided across to be in Each an Equal part and my Negro Boy Named Andy to be his for Ever. Item I give and Bequeath to my Son Charles Berry my Plantation or Tract of Land Lying in Washington County on houlstone [see 1796 deed below] and my Negro Boys Named Tom to be his and his heirs and assigns for Ever, Item I give and Bequeath to my Daughter Challe Berry my Negro Girl Named Lucy and my Mare Named Mige a Saddle at five Pounds price Two Cows and a heifer her bed and furniture to be hers and assigns for Ever, and She is to have her living off the Plantation I now live on with her Mother and Brother Robert till she is Married, my Negro Girl Named Fan (?) I leav at the Disposeal of my Executors to be Continued with my Daughter Elizabeth Henry as Long as they think fit and then to be Disposed of as they think proper. IN the name of God amen. I David Doak of Augusta County and State of Virginia being weak in body by reason of sickness but sound of mind memory and Judgment Blessed be God and calling to mind the mortality of the body that it is for all men to die do this 26th day of June in the year of out Lord one thousand seven hundred and ninety nine make ordain and publish this my last will and testament in manner following to wit I resign up my soul to God who gave it and my body to be buried at the discretion of my Executors nothing doubting but at the last day both shall be united in Glory and respecting that part of the good things of this world which it hath pleased God to bless me with after my just debts is paid I dispose of and Bequeath as follows Viz: Imprimis I Bequeath to my Beloved wife Jennet Doak her living off this plantation that I now live on during her natural life & while she remains my widow and I allow my two sons Samuel and David Doak who gets the land to support her and the rest of my children that is to get their living off this plantation and each of my sons to be at equal Expense in supporting s.d. family. But if my wife thinks proper to live by herself without depending on her two sons I allow her a certain part of my plantation (during her natural life or while she remains my widow) for her support that is to say I allow her to have the management of and the Benefits arising from all my lands that lies on the South side of the great -?- including the dwelling house and to --?-- from line to line and after her decease s.d. land is to go to my two sons agreeable to the division that is to be made to them. I also bequeath to her my negro named Abraham (during her natural life or widdowhood) for the support of her and my children and at her Decease he is to be sold & divided between my two sons to enable them to make up the Legacies that is left to the rest of my Children. I also bequeath to my wife one third of all my stock and farming tools after just debt and specific Legacies is made up and the disposal and management of all the household furniture which stock farming tools and household is to be given to her agreeable to the appraisement of such things as she thinks proper to take. Item I Bequeath to my daughter to my daughter Jenny Berry five shillings for her Birth right Item I Bequeath to my daughter Rosanah Doak my negro girl named Hannah to her during her natural life and to desc.ds to her issue but is she dies without issue then s.d negro girl is to come back and her Value to be divided between my sons Saml & David Doak. I also bequeath to Rosannah a young mare Equal to Samls mare N--?-- --?-- her saddle bridle bed and bedding or furniture fitting for the Sorrel and such a quantity of Stock and household furniture as her mother thinks fit to give her living and maintainance for herself and negro and cratures of that part of the land alloted to my wife during her unmarried State. Item I Bequeath to my daughter Betsy five shillings for her Birth right as I intend o give her her divide immedietly. Item I Bequeath to my two sons Samuel and David Doak to each of them one half of this land that I now live on part to ther theirs after my Decease and the other part after their mother's decease which said Land is to be Equally divided considering quantity quality and improvement to be theirs and their heirs and assigns forever. I also Bequeath to Each of them a negro boy that is to Saml his negro boy Andw. and to David Dinnise I allow bequeath to then an Equal Share in my Grist Mill and saw mill and still with the appartainance thereto belonging reserving to my wife if she thinks proper to live by herself one fourth of the profits arising from the Grist Mill I also Bequeath to Each of my sons a young mare that is to say to Saml N-?- and to David a young filly named his with the remainder of all personal Estate not Bequeathed I also allow my negro woman June to be sold and her price to be appropriated for to enable my two sons to make up the following Legacys and to pay and to pay my just debts and my waggon I allow to be continued on the plantation for the use of my widow and all my children that lives thereon. Item I Bequeath to my five daughters (Viz) Paggy, Fanny, Dorces, Polly and Elly Doak to Each of them a little negro girl to be given to Each of them by my two sons Saml & David out of the Land to them and their issue but is no issue to return --?-- back to my two sons. I Bequeath to each of my above named daughters a tolerable good horse creature saddle and Bridle and such Stock and household furniture as their mother thinks proper to give them but if their mother should be Called off before the[y] get married I allow my Executors to Give them nearly as much as Rosannah gets. I also allow all of my children to be Schooled what is common out of the profits of my Mills and Still or to be Learned as fare as is necessary for children. I also my five daughters and son Hugh to get their living with their mother or to be supported off this plantation until the[y] change their way of living. Item I Bequeath to my son Hugh Doak his schooling as far as a good English Schoolar to paid out of the profits arising out of the land and if he appars to have a turn for learning and an inclination thereto I allow my two sons Saml & David to put him to learning and support him at the same until he gets through and them to give him a horse and saddle but if he appears to have no capacity no inclination for the same after he is --?-- English scholar I allow him to be put to a trade such as he with the advise of my Executors will Choose and when he has learned the trade and is of age I Bequeath to him one hundren pounds and a horse and saddle for to enable him to follow his trade which money is to be given him out of the land and appurtance thereto belonging & I hereby by Constitute and appoint my beloved wife Jennet Doak Executrix and my sons Samuel and David Doak Executors of my whole Estate and I appoint and choose James Berry Guardian for my infant Children and I do hereby revoak and disanul and wills and Testaments by me heretofore made and do ---?--- Establish and publish this my las will and Testament. Know all men by these presents that we James Berry John {unreadable} William {unreadable – probably Brown} Wm. Shields son William Shields & Chesley Kinney and Andrew Fullon are held and firmly bound unto Willaim {unreadable} Esquire Governor of this Commonwealth and his successors in the sum of Thirty thousand dollars for the use of the Commonwealth to the payments whereof well and truly to be under {unreadable} bond ourselves jointly and severally firmly by these presents Sealed with our seals on this 23rd day of February one thousand eight hundred and seven.
The Condition of the above obligation is such that {unreadable} James Berry is continued in the office of Sherriff of the County of Augusta until the expiration of two years from the date of his first qualification by a Commission signed by the Governor under the Seal of the Commonwealth dated the tenth day of October last [unreadable]. If therefore the said James Berry shall well and truly collect the Taxes imposed by law in the said County and that faithfully account for and pay the same to the Treasurer of this Commonwealth for the time being for the use of the Commonwealth then the above obligation to be void, otherwise to remain in full force and virtue.

This Indenture made this twenty fifth day of August in the year of our Lord one thousand eight hundred and thiry five between William N. Youell and Jane his wife, David D. Berry and Elizabeth his wife of County of Montgomery and state of Indiana, heirs and heriesses of James Berry deceased of the County of Augusta, State of Virginia of the one part, and James Berry heir of said decedent, of the county and state aforesaid of the other part. Witnesseth that the said William N. Youel and Jane his wife, David D. Berry and Elizabeth his wife for and in consideration of the sum of three hundred dollars to them in hand, by the said James Berry paid, the receipt whereof is hereby acknowledged, have granted, bargained and sold by these presents do grant, bargain and sell unto the said James Berry, his heirs and assigns all their undivided interest in a certain tract or parcel of land containing by estimation three hundred and seven acres situated in the county of Augusta on both sides of the Little Calf Pasture River. Said land was conveyed to James Berry, deceased, by Robert Walker and Sarah his wife by deed dated the 21st of August 1787 and duly recorded in the clerk’s office of Augusta County Court and is bounded as followeth to wit: BEGINNING at that white oaks corner to John Young Jr the patent line thence with the same H78E198 poles crossing several creeks to that white oak between two hills corner to Joseph McCutchan, thence leaving the patent line with said McCutchans line S 30 E 240 pole crossing the run and said river to white oak and 2 poplars on the east side of said river at the foot of the Boownhill corner to said McCurchans in the patent line with said line to John Young corner thence with said lines crossing river to the BEGINNING. To have and to hold all their undivided interests of said tract or parcel of land with ---?-- appurtenances unto the said James Berry his hers and assigns forever. The said William N. Youel and Jane his wife, David D. Berry and Elizabeth his wife heirs and heiresses as aforesaid do for themselves their heirs, executors, administrators and assigns, their undivided interest, of said James Berry his heirs executors administrators and assigns, against the claims or demands of any persons claiming in or through them the said William N. Youel and Jane his wife, David D. Berry and Elizabeth his wife their heirs, executors, administrators or assigns or any other person or persons whatever. In testimony whereof the said William N. Youel and Jane his wife, David D. Berry and Elizabeth his wife have hereunto set their hands and seals the day and year first above written in this Indenture.
