IN THE NAME OF GOD AMEN I Charles Berry Senr. of the County of Augusta in the State of Virginia, farmer, Being Very Sick and weak in Body but of Perfect Mind and Memory Thanks be Given to Almighty God for the same and Calling to mind the Mortality of my Body and Knowing that it is appointed for all men once to Die do make and Ordain this my last Will and Testament in manner and form following, First I Recommend my Soul into the hand of God that Gave it and my Body to the Earth to be buried in a Christian Like and decent Manner at the Discreation of my Executors and as Touching Such Worldy Estate as it hath Pleased God to bless me in this life I give and Dispose of the Same Manner and for following Impremis I Give and Bequeath to my beloved wife Mary Berry the one half of my moveable Estate after my Just Debts and funeral Chages is paid By my Executors and my Plantation that I now Live on for her Support During widowhood or Natural Life and my two oldest Negroes Viz Tom and Mack for her support and my son Robert Berry The Property Land and Negroes is to Equally for the Support of my Beloved Wife and my son Robert Berry dureang my Beloved Wifes Life and at her Death the whole of s.d property Property to Become the Property of my Son Robert Berry and his heirs and assigns for Ever- Only if the Two Negroes have any Increase they are to be at my Wifes Disposal. Item I give and Bequeath to my son John Berry my Plantation or Tract of Land above and Joining the tract I now Live on to be his and his heirs and assignes for Ever the s.d Two Tracts to be Equally Divided across to be in Each an Equal part and my Negro Boy Named Andy to be his for Ever. Item I give and Bequeath to my Son Charles Berry my Plantation or Tract of Land Lying in Washington County on houlstone [see 1796 deed below] and my Negro Boys Named Tom to be his and his heirs and assigns for Ever, Item I give and Bequeath to my Daughter Challe Berry my Negro Girl Named Lucy and my Mare Named Mige a Saddle at five Pounds price Two Cows and a heifer her bed and furniture to be hers and assigns for Ever, and She is to have her living off the Plantation I now live on with her Mother and Brother Robert till she is Married, my Negro Girl Named Fan (?) I leav at the Disposeal of my Executors to be Continued with my Daughter Elizabeth Henry as Long as they think fit and then to be Disposed of as they think proper. Item I give and Bequeath to my daughter Jean Brawford my Negro Girl Named Jude to be hers and her heirs if she has Lawfull Issue If she dies without Issue then to be Returned to my Executors for the use of my Family, I likewise Bequeath to my Son James Berry and to my Daughters Elizebeth, Mary and Jean to Each of them five shillings Sterling in Room of their Birthright the remainer of my of my Moveable Esate I Allow to be Equally Divided Between my Two Sons John and Charles Berry, and I do Constitute and appoit my Beloved Wife Mary Berry Exectrix and my Beloved sons James and John Berry Executors of this my Last will and Testament, and do Disannule all other Wills By me heretofore made Ratifying and Confirming this to be my Last Will and Testament in Witness whereof I have hereunto Set my hand and seal this Eighth Day of April one thousand Seven hundred and Eighty Nine

This last Will and Testament of Charles Berry deceased was presented in Court by James Berry and John Berry the Executors therein named and proved by the Oath of John MKenny and Henry Minger two of the Witnesses thereto and is ordered to be recorded and on the Motion of the said executors who made oath according to Law Certificate is granted them to for obtaining probat thereof in due form they hearing entered into and acknowledged Bond with Security as the Law Directs.

In the Name of God Amen, I John Berry of the County of Augusta and State of Virginia being of Present mind and memory and Knowing that it is appointed for all men once to dye make and ordain this my last Will and Testament in manner and form as follows. first I recommend My soul into the hands of God that gave it and my Body to the Earth to be buried in a Christian and Desent manner at the Discretion of my Executors and as touching such wordly Estate as it has pleased God to Bless me with in this life I give and Bequith the same in manner and form following
Imprisis. I give and Bequith to my wife Eleaner Berry one third of my estate after my just debts and funeral Charges is payd by my Executors likewise my Negro Woman viz Sucky and s.d property and Negros to be hers Durin Life or widowhood and to have her support off my farm and to have one half of my house for to live in. Item I give and bequith to my son John Berry one hundred and five acres of land to be laid of the upper end of my land of my farm viz Beginning at Rosemary line and running with the course of the fence and with the fence that runs across orchard field and to cross the meddow and then to make a corner and run of the meddow fence in the field side and then to make a corner and run up the meddow fence in the field side and then to make a corner and run a South West coarse so as to lay him of s.d quantity of acres as above and to be his and his heirs and assigns forever. Item I give and bequith to my son Charles Berry one hundred and four acres of land including the part that I live on likewise my farming utensils such as plows harrow horse gears ---?-- & the windmill and his mare named Kate and her coalts named Cole and Tom the s.d land & property to be his and his heirs and assigns forever. Item I give and bequith to James B. Berry the ballance of my Land that is one hundred acres and to begin at the South Corner of my meddow at the crop lain next Robert Berry’s and to run up the road and then to make a corner and run a North West ---?-- a cross the meddow so as to leve the Spring mowing by the Ash spring in James B. Berry’s part of the land and then to be laid of to the best advantate to ---?- s.d James and Charles Berry and s.d hundred acres of land is to be his and his heirs and assigns forever. Item I give and bequith to my Daughter Anne T. Berry my negro girl named Margaret my mare named Peg her saddle her bureau and a table Beds and Bed furniture and such furniture She makes for herself likewise Six head of cows including cows and young Cattle six sheep her kitchen & Cupboard furniture Equal to what my Daughter Polly G. Bratton got of Kitchen and Cupboard furniture s.d property to be her and her heirs and assigns forever and to have her living with her Mother while single or unmarried. Item I give and bequith to my Daughter Polly G. Bratton (--?--) one hundred Dollars that I gave to my son in law John Bratton which he gave me a receipt to be accountable to me for the same on the s.d one hundred Dollars to be her and her heirs and assigns forever -- the remainder of my movable Estate I allow to be divided amongst my Children to wit: Polly G. Bratton, John, Charles and James B. Berry and Anne T. Berry and if my son Charles Berry will assist me to purchase my son James B. Berry a horse beast he shall have my Waggon and I do Constitute and appoint my sons Charles & James B. Berry Executors of this my last will and testament and to Disanul all other Wills by me Heretofor made and Ratifying this to be my last will and testament in Witness whereof I have set my hand and seal this twenty sixth of September in the year of our Lord one thousand eight hundred and thirty one. This last Will and Testament of John Berry dec.d was presented in Count and upon the oaths of George Frenger & Charles Berry Jun. the subscribing witnesss thereto and ordered to be recorded. And on the motion of Charles Berry one of the Executors is named who made oath thereto according to Law & together with Will McCutchen and James B. Berry his securities intend and ack. their bond in the penalty of $2000 conditioned as the Law requires which bond is ordered to be recorded. Certificate is granted the said Charles Berry for obtaining probat thereof in due form. James B. Berry the other Executor therein named having appeared in Court and refused to take upon himself the burden of the Execution said Will.

Know all men by these presents that Charles Berry, Wm. McCutchen & James B. Berry are held firmly bound to James Bell, Jacob Sons, Charles A. Stuart & Leonard B. Stuart Gentlemen Justices of the Court of Augusta County, now willing, in the sum of Two thousand Dollars to the payment whereof well & truly to be made to the said Justices & their successors, we bind ourselves & each of us our reach of our heirs Execs. & admns, jointly & severally, firmly by these presents. Sealed with our seals & dated this 25th of January Anno Domini one thousand eight hundred & thirty two in the 51th year of the Commonwealth.
The Condition of the above obligation is, that if the said Charles Berry Executor of the last will and testament of John Berry dec.d, do make a true & perfect Inventory of all & singular the goods chattels & credits of the said dec.d which have or shall come to have possession or knowledge of him the said Charles Berry or into the hands or possession any other person or persons for him and the same so made do exhibit to the County Court at such time as he shall be thereto required by the said Court; and the same goods, chattels, veredits, do well & truly admin. according to law; and make a just a true account of his actings & therein, when thereunto required by the said County and further do & thereby pay & deliver all the legacies contained & specified in the said as far as the said goods, chattels & credits will extend accoring to value thereof, and as the law shall charge him; then this obligation to be void, or else remain in full force.
