IN THE NAME OF GOD AMEN I Charles Berry Senr. of the County of Augusta in the State of Virginia, farmer, Being Very Sick and weak in Body but of Perfect Mind and Memory Thanks be Given to Almighty God for the same and Calling to mind the Mortality of my Body and Knowing that it is appointed for all men once to Die do make and Ordain this my last Will and Testament in manner and form following, First I Recommend my Soul into the hand of God that Gave it and my Body to the Earth to be buried in a Christian Like and decent Manner at the Discreation of my Executors and as Touching Such Worldy Estate as it hath Pleased God to bless me in this life I give and Dispose of the Same Manner and for following Impremis I Give and Bequeath to my beloved wife Mary Berry the one half of my moveable Estate after my Just Debts and funeral Chages is paid By my Executors and my Plantation that I now Live on for her Support During widowhood or Natural Life and my two oldest Negroes Viz Tom and Mack for her support and my son Robert Berry The Property Land and Negroes is to Equally for the Support of my Beloved Wife and my son Robert Berry dureang my Beloved Wifes Life and at her Death the whole of s.d property Property to Become the Property of my Son Robert Berry and his heirs and assigns for Ever- Only if the Two Negroes have any Increase they are to be at my Wifes Disposal. Item I give and Bequeath to my son John Berry my Plantation or Tract of Land above and Joining the tract I now Live on to be his and his heirs and assignes for Ever the s.d Two Tracts to be Equally Divided across to be in Each an Equal part and my Negro Boy Named Andy to be his for Ever. Item I give and Bequeath to my Son Charles Berry my Plantation or Tract of Land Lying in Washington County on houlstone [see 1796 deed below] and my Negro Boys Named Tom to be his and his heirs and assigns for Ever, Item I give and Bequeath to my Daughter Challe Berry my Negro Girl Named Lucy and my Mare Named Mige a Saddle at five Pounds price Two Cows and a heifer her bed and furniture to be hers and assigns for Ever, and She is to have her living off the Plantation I now live on with her Mother and Brother Robert till she is Married, my Negro Girl Named Fan (?) I leav at the Disposeal of my Executors to be Continued with my Daughter Elizabeth Henry as Long as they think fit and then to be Disposed of as they think proper. Item I give and Bequeath to my daughter Jean Brawford my Negro Girl Named Jude to be hers and her heirs if she has Lawfull Issue If she dies without Issue then to be Returned to my Executors for the use of my Family, I likewise Bequeath to my Son James Berry and to my Daughters Elizebeth, Mary and Jean to Each of them five shillings Sterling in Room of their Birthright the remainer of my of my Moveable Esate I Allow to be Equally Divided Between my Two Sons John and Charles Berry, and I do Constitute and appoit my Beloved Wife Mary Berry Exectrix and my Beloved sons James and John Berry Executors of this my Last will and Testament, and do Disannule all other Wills By me heretofore made Ratifying and Confirming this to be my Last Will and Testament in Witness whereof I have hereunto Set my hand and seal this Eighth Day of April one thousand Seven hundred and Eighty Nine

And on the motion of said Executors who made Oath according to law certificate is granted them for Obtaining probate thereof in due form they having together with James McCampbell & Jn Telford their Securities entered into and Acknowledged their Bond in the penalty of L1000 Conditioned according to law.
Ordered that James Buckanary James Tedford, Robert Stuart and Robert McChesnay or any Three of them being first sworn do appraise in Current money the Slaves and personal Estate of William Berry deceased and return an Inventory & appraisement thereof to Court.

THIS INDENTURE made this twentieth day of July in the year of our Lord one thousand seven hundred and ninety six between Charles Berry of the County of Augusta in the State of Virginia of the one part and James Campbell of the County of Washington in the State aforesaid of the other part. WITNESSETH that the said Charles Berry for and in consideration of the sum of thirteen hundred & thirty three and one third dollars current money of the United States to him in hand paid doth bargain and sell to the said James Campbell and his heirs one certain tract or parcel of Land in the said County of Washington containing three hundred and twelve acres, be the same more or less conveyed to Charles Berry by James Berry by Indenture of Bargain and Sale bearing the date the eighteenth day of November one thousand seven hundred and eighty three recorded in the court of the said County of Washington which will more fully appear by a reference thereto, and bounded as followeth, to wit, BEGINNING at a large white Oak by the creek running thence North six degrees East crossing the creek one hundred and sixteen poles to a white oak and black oak on the East side of a ridge. North twenty degrees East one hundred and forty poles to two white oaks on the west side of a ridge North eighty four degrees west two hundred and forty poles to a white oak and black oak on the pattent line thence with the said line south two degrees and a half east one hundred & -?-- poles to three white oaks, West seventy poles to three white oaks by a spring, South two degrees and a half east one hundred and twenty poles to a large white oak white oak Sapling and small poplar. South eighty degrees east two hundred and twenty four poles to the BEGINNING with its appurtenances TO HAVE AND TO HOLD the said tract or parcel of Land with its appurtencances unto the said James Campbell and his heirs to the sole use and behoof of him the said James Campbell and his heirs forever. And the said Charles Berry for himself and his heirs doth covenant with the said James Campbell and his heirs that he the said Charles Berry and his heirs the said tract or parcels of Land with all it appurtenances unto the said James Campbell and his heirs against all persons whoseover shall and will warrant and forever defend. In witness whereof the said Charles Berry hath hereunto subscibed his name and affixed his seal the day and year first above written,

Charles Berry & Robert McChesney or either of them to sell my plantation and Negro man Seifico(?) left me by the will of my brother Adam McChesney and also the rest of my property and out of the money arising therefrom to pay my sister Sally Moffett the Legacy coming to her which was left by the will of my Grandfather Patrick Crawford to my brother George and sixty pounds to my sister Nancy or her Heirs forever and sixty pounds to my sister Betsy or her Heirs forever the Balance of the money arising from the sales of the above mentioned property to be equally divided between my Sisters Margaret McChesney and Rebecca McChesney or their Heirs forever. I Charles Berry of Augusta County and state of Virginia being sick and weak in body but of sound mind and disposing memory do hereby make my last will and testament in manner anf form as following that is to say. 1stly. I give and bequeath to my wife Ann one sixth part of all my personal estate and said estate to be at her own disposal. 2ndly. I give and bequeath to my two sons John and James one sixth part to each of all my personal esate and also my three daughters Mary G. Harris, Christine Buchanan and Charlotte Jane Irvine each one sixth part of all my personal estate each and all of them to share and share alike. 3thly. I give and bequeath to my two sons John & James Berry my plantation all the Land I own to be divided equally between the two. They are to pay following dividend or Legacies that is to say three hundred Dollars to e paid to my wife at any time she may require or may have need for it. Also they do fund or furnish her a Decent and comfortable living during her natural. 4thly I further direct that my two sons John & James pay my Daughters Mary three hundred Dollars and they are to pay my Daughter Christian three hundred Dollars and still further I direct that my Daughter Charlotte be paid three hundred Dollars. Should anything intervene or turn out to prevent the payment of the afore named Landed Legacies for the term of two years after this being admitted to record, then in such case my two sons may proceed to sell the Land and make a title for the same first securing to my wife a comfortable living. Lastly, I do hereby constitute and appoint my two sons John & James executors of this my last will and testament disanuling and revoking all former wills heretofore made by me acknowledge this my last will and affixed my seal this 7th day of October 1843.
