Call to Reverend Cummings
A call from the united congregations of Ebbing and Sinking Springs, on Holston's
River, Fincastle County, to be presented to the Rev. Charles Cummings, minister
of the Gospel, at the Rev'd Presbytery, of Hanover, when sitting at the Tinkling
Spring:
Worthey and Dear Sir: We being in very destitute circumstances for want of the
ordinances of Christ's house statedly administered amongst us under distressing
spiritual languishment, and multitudes perishing in our sins for want of the
bread of life broken among us; our Sabbaths too much profaned, or at least
wasted in melancholy silence at home; our hearts and hands discouraged; our
spirits broken with our mournful condition, so that human language cannot
sufficiently paint. Having had the happiness, by the good Providence of God, of
enjoying part of your labors, to our abundant satisfaction, and being
universally well satisfied by an experience of your ministerial abilities,
piety, literature, prudence, and peculiar agreeableness of your qualifications
to us in particular as a gospel minister. We do, worthey and dear sir, from our
very hearts, and with the most cordial affection and unanimity, agree to call,
invite and entreat you to undertake the office of a pastor among us, and the
care and charge of our precious souls. And upon your accepting of this, our
call, we do promise that we will receive the word of God from your mouth, attend
on your ministry, instructions and reproofs, in public and private, and submit
to the discipline which Christ has appointed in his church administered by you
while regulated by the word of God, agreeably to our confession of faith and
directory. And that you may give yourself up wholly to the important work of the
ministry, we do hereby promise to pay unto you annually the sum of ninety pounds
from the time of your accepting this, our call; and that we shall behave
ourselves toward you with all that dutiful respect and affection that becomes a
people towards their minister, using all means within our power to render your
life comfortable and happy. We entreat you, worthey and dear sir, to have
compassion upon us in this remote part of the world, and accept this our call
and invitation to the pastoral charge of our precious and immortal souls, and we
shall hold ourselves bound to pray. In witness whereof, we hereunto set our
hands, this 5th day of January, 1773.

In the name of God Amen, I , William Berry of the County of Washington & Colony
of Virginia being of sound & disposing mind do make and ordain this my Last Will
and Testament in Manner and form following way. In the first place that my
lawful Dues be Collected & Debts Discharged. I bequeath to my son Thomas my Land
and Plantation utensials a horse & saddle. I likewise I bequeath to my Wife Mary
her living on the Plantation During her Widowhood and her choice of any one of
the Mares with her Saddle to be at her disposal. Likewise two cows. In like
manner I Will to my two daughters each a Mare and Saddle, two Cows and Calfs and
an equal divide of the household furniture. The remainder of my stock I bequeath
to be Equally divided between my Wife & Youngest children and to the child my
wife is now pregnant with I bequeath Fifteen Hundred pounds of the present
Currency now due to me to be laid out to the best advantage for the Child if it
lives. & if not , to be divided equally between the Mother and Children Likewise
I leave five Hundred Pounds to be laid out for the Schooling & use of the
children. The remainder I bequeath to my Wife to be at her disposal. Lastly I do
make and constitute for Exectors James Trimbell, James Berry & Thomas
Berry Sr. witness when of I have vision to set my hand and Seal this fifth day
of February in the year of our Lord 1781.

The Last Will and Testament of William Berry Deceased Exhibited in Court and
proven by the Oath of James Berry a Witness thereto and by the oaths of Thomas
Berry and James Trimble that the Deceased name signed to Said Will was
the said William Berrys hand which Ordered to be Recorded Whereupon James
Trimble, James Berry and Thomas Berry Executors therein named made Oath
thereto in due form Whereupon they together with James Dysart & John Campbell
entered into and Acknowledged their Bond in the Sum of Four Hundred pounds in
Specie for the faithful Administration of the Said Decedants Estate. Ordered
that John Lowry, John McCutchan, Alexander McNutt and David Carson or any three
of them appraise the Estate of William Berry Deceased in Specie and make return

Know all men by these presents, That I, Francis Berry senior being in my right
sences do make my last Will and Testament and do therefore appoint James Crow
and James Trimble for my executors therefore if Samuel Dunlap does not pay for
the land which was formerly my property purchased from me by said Samuel Dunlap
before mentioned before my decease I do therefore authorize and impower said
James Crow and James Trimble before mentioned being my executors, to receive
ninty seven pounds lawful money of the currency of the State of Virginia from
the said Samuel Dunlap above mentioned due to me by the said Samuel Dunlap for
the ??? before mentioned sold by me to said Samuel Dunlap and when payment is
made, the said James Crow and James Trimble is to give a right of said land to
the above mentioned Samuel Dunlap and likewise to deliver up the bonds of said
money, Above mentioned at the time of payment, And when I live and die I do
therefore allow them to be reasonably and fully satisfied for the trouble and
care they took of me during the term of time I abode with them. As for my son
Francis I rest assured and am satisfied in my mind that he has received plenty
both for the trouble he was at with me and his legacy likewise and I do then
think proper to leave him in this my last Will and Testament one dollar and the
remainder of my children namely Elizabeth Gibson and Thomas Berry to each one
twenty shillings and my other three daughters namely Mary Johnston Rachel
Trimble and Easter White the monies then remaining to be fairly and equally
divided among them and do therefore acknowledge and certify this said Will and
testament to be my true and genuine last Will and Testament and all other former
Wills before made or caused to be made by me Francis Berry to be void, and this
only to be my legal right and lawful last Will and testament as given under my
hand and seal In the presence of John Ryburn John Trimble this sixth day of
August one thousand and seven hundred and ninety nine 1799

KNOW all men by these presents that we James Trimble, James Crow and Sam'l
McChesney are held and firmly bound to Wm. McCoun, Matthew W. Doughty, Jno.
Davis, Elijah ____ Samuel Meeks, James White & Alexander Doran, Gent justices
now composing the court of Washington in the sum of six hundred 66 dollar 67
cents To which payment well and truly to be made to the said justices and their
successors we bind ourselves our heirs Executors or Administrators jointly and
severally firmly by these presents. Witness our hands and seals 18th day of
March 18 The Condition of this is that if the said James Trimble & James
Crow Executors of the last Will and Testament Fran.s Berry Deceased do make true
and perfect Inventory of all and singular the goods chattels and credits of the
said deceased which have or shall come to the possession or knowledge of them
the said Trimble & Crow _____ or into the hands or possession of other person or
persons for them and the same so made to exhibit into the county court of
Washington at such time as shall be thereto required by the said Court and the
same good chattels and credits do well and truly administer according to Law,
and make a just and true account of their actings and doings therein when
thereunto required by the said County; and further do well and truly pay and
deliver all the Legacies specified and contained in the said will as far as the
said goods chattels & credits will extend and the law charge you (according to
the value thereof) then this obligation to void otherwise to remain in full
force.

Crow the executors therein named who took the oath prescribed by law and
together with Samuel McChesney their securities acknowledged their bond in the
sum of six hundred 66 dollars by ants (?) conditioned as the law directs. A
certificate for the probat of the said will is therefore granted them in due
form

THIS INDENTURE made this twentieth day of April in the year our Lord one
thousand eight hundred and two between James Crow and James Trimble
Executors of the last Will and Testament of Francis Berry deceased of the one
part and Samuel Delap of the other part all of Washington County and State of
Virginia WITNESSSETH that whereas the said Francis Berry deceased in his life
time did bargain and sell to the said Samuel Delap for the consideration of one
hundred and forty pounds one hundred and forty acres of Land to the same more or
less lying and being in the County of Washington on a branch of the middle fork
of Holstein Granted to the said Francis By the Commonwealth of Virginia by
Pattent dated the first day of May 1789; and whereas the said Francis by his
last Will and Testament dated the sixth day of August 1799 duly proved and
admitted to record in the County Court of Washington did authorise direct and
empower his Executors to Convey to the said Samuel Delap the aforesaid tract of
Land and premises. Now this Indenture
WITNESSETH that the said James Crow and James Trimble executors as
aforesaid for and in consideration of the said sum of $140 to them in hand paid
Do bargain and sell to the said Samuel Delap and his heirs forever the said one
hundred and forty acres of Land be the same more or less and bounded as
followeth to wit:
BEGINNING at three white oaks on the side of a knob and corner to Samuel Henrys
land North twenty degrees West one hundred and thirty six poles to two white
oaks, South forty two degrees West one hundred and twenty eight poles to a black
oak and white oak North eleven degrees West twenty two poles to three white oaks
a corner to Thomas Hill and with his line South twenty nine degrees West ninety
eight poles to three white oaks South twenty three degrees East twenty two poles
to a white oak and poplar South forty three[?] degrees eighty six poles to two
white oaks by the knobs North forty six degrees East one hundred and sixty seven
poles to the BEGINNING
with all its appurtenances TO HAVE AND TO HOLD the said tract or parcel of Land
with all its appurtenances to the said Samuel Delap and his heirs to the sole
use and behoof of him the said Samuel Delap and his heirs forever and the said
James Crow and James Trimble for the heirs of their said Testator do
covenant with the said Samuel Delap and his heris that they the said James Crow
and James Trimble for the heirs of their said Testator the said tract or
parcel of land with all its appurtenances to the said Samuel Delap and his
haeirs against the claims of all persons whosoever will warrant and shall

Joseph Rhea of the other part both of the County of Washington and State of

WITNESSETH the said James Trimble and Rachel his wife for and in
consideration of the sum of one hundred and fifty pounds current money of
Virginia the receipt whereof they do hereby acknowledge the said James
Trimble and Rachel his wife hath granted bargained and sold and by
these presents doth grant bargain and sell unto the said Joseph Rhea and heirs
one certain tract or parcel of Land containing two hundred and thirteen acres
and being in the county and State aforesaid being part and adjoining the Land
the said Trimble lives on and is bounded as followeth to wit
BEGINNING at two white oaks on the North side of the second nobs thence North
forty five degrees West two hundred and sixty six poles to a gum and dogwood on
the South side of the first knob South thirty nine degrees West eighty poles to
two pines of the South side of knobs South one hundred and forty poles to two
white oaks by the end of a hill in a draught South forty five degrees East sixty
poles on a day branch on north side of the second knob thence for a dividing
line between said Trimble and said Rhea North twenty six degrees East two
hundred and sixteen poles to the Beginning
with its appurtenances TO HAVE AND TO HOLD the said tract or parcel of Land with
its appurtenances unto the said Joseph Rhea his and heirs forever and the said
James Trimble and Rachel his wife for themselves and their heirs
do covenant with the said Joseph Rhea and his heirs that they the said James
Trimble and Rachel his wife and their heirs the said tract or parcel
of land with its appurtenances to the said Joseph Rhea and his heirs against all
persons whosoever will warrant and defend. In witness whereof the said James
Trimble and Rachel his wife hath subscribed their names and affixed
their seals the day and year above written. Enterlined before signed.

THIS INDENTURE made this twenty eighth day of May one thousand eight hundred &
six between James Trimble & Rachel his wife of the one part &
Moses Trimble of the other part both of Washington County and State of Virginia
WITNESSETH that the said James Trimble & Rachel his wife in
consideration of the sum of Eighty two dollars lawful money of this Commonwealth
to them in hand paid by the said Moses Trimble at or before the ensealing and
delivery of these presents the receipt whereof is hereby acknowledged have
bargained and Sold and by these presents do bargin and sell each of us unto
Moses Trimble his heirs and assigns a certain tract or parsel of land containing
Eight three acres be the same more or less in the County of Washington and State
aforesaid a part of the land the said Trimble now lives on lying and bounded as
followeth
Begining on two white oak saplins in a draft North twenty four degrees East
eighty poles to two White oaks on a ridge North nineteen degrees East eighty
poles to two White oaks on a ridge North nineteen degrees West eighty poles to a
large White oak near a big rock South fity seven degrees West sixty two poles to
a dogwood and white oak North sixty six degrees West twenty poles to a dogwood
and Gum on the side of a branch South twenty seven degrees West Ninety two poles
to a white oak and black oak on Rays line South forty five degrees East eighty
two poles to two White oaks near a knob south Eighty eight degrees East forty
three poles to the BEGINNING
to have and to hold the said track or parsel of land with the tenements
hereditaments and all and singular the premises herein before mentioned or
intended to be barganed and Sold and every part and parcel thereof with every of
their right members appurtainences unto the said Moses Trimble and his heirs and
assigns forever and the said James Trimble and Rachel his wife;
for themselves and their heirs the said land with all and singular the premises
and appurtenance before mentioned unto the said Moses Trimble and his heirs and
assigns free from the claims of themselves their heirs and assigns and all
persons whatsoever and Will Warrent and forever defend in WITNESS Whereof the
said James Trimble and Rachel his wife hath hereunto set their hands and Seales
this day and year above written.
