B.5.f. Samuel Nesbit {B.5.f.}

 

     Samuel Nesbit was born about 1781, most likely on his family’s farm in northern part of the Borden Grant in Augusta County, Virginia. In 1787, when he was about six years old, the family picked up stakes and moved to the part of Fayette County, Virginia that eventually became Harrison County, Kentucky. He grew up in his parent’s household on Gray’s Run near the town of Cynthiana, and in the spring of 1813, in Harrison County, Kentucky, he married Nancy N. Thomas, daughter of John Thomas. Samuel was 32 years old at the time, but, since Nancy’s father had to sign a consent form to allow the marriage, Nancy must have been a minor. In fact, with a birth date of 1793, as shown by her life span listed on her headstone, she was about 19 years old at the time. As indicated by the 1850 and 1860 federal census records, Nancy was born in Kentucky, most likely in Harrison County. As shown by the birth places of their children, these census records also demonstrate that this Nesbit family moved to Missouri in 1827 or 1828, about the same time as Samuel’s brother, Robert, and his family did. Nancy passed away on 13 August 1869, probably in Monroe County, Missouri, and was buried in the Nesbit Family Cemetery near Stoutsville, Madison County, Missouri.752

To all whom it may concern be it known that I Robert Nesbit of Harrison County Kentucky have this day constituted and appointed my brother William Nesbit of same county my agent and attorney in fact for me & in my name to transact all my business of every kind in Kentucky- But to be more particular be known that I have sold the tract of land on which I live to Mr. Wm Novis & have made him a deed therefore and whereas I have also sold to Danl Tibbs a small piece of land of six or eight acres & have executed to him a bond for a conveyance and whereas I am unable to make the Title to S'd Tibbs at this time I also could not make the title complete to Novis for a little upwards of eight acres of the land contained in his deed because Robert Trimble through whom I am to derive the legal Title to s'd two small slips of land has departed this life without having obtained the legal title to the same? from the heirs of Wm Allen dec'd- And whereas I have brought in con¬junction with my brothers Wm & Sam'l Nesbit a suit in chancery in the Bourbon Circuit Court against the heirs of s'd Trimble & Alien to obtain the legal title to said two slips of land & am. about removeing from Kentucky - Now be it known that so soon as said Court may decree a conveyance of said land from Trimble & Aliens heirs & a deed shall be made under s'd decree to me, I then authorize my said agent in my name & on my behalf to convey to s'd Novis said eight acres & upwards by deed with such warranty as is contained in s'd Deed already made him that is with general warranty and also to convey to said Tibbs by deed with such warranty as called for by said bond said six acres or whatever is called for in s'd bond and I do hereby authorise him in my name & on my behalf to do every thing necessary to complying with my contracts as aforesaid & I hereby give as full validity to his s'd acts in this behalf as if done by myself in person In testimony whereof I have hereunto set rny hand & seal the day & year first above written that Is to say this 11th Novem. 1828.

This indenture made this 15th day of August AD 1840 between Samuel Nesbit of the first part and Benjamin Nelson of the 2nd part and James Parker of the 3rd part all of the county of Shelby and state of Missouri
Witnesseth that whereas James Parker of the 3rd part is bound unto Leslie Price as security for Samuel Nesbit in an appeal bono taken up from the judgement of Isaac W Moore A justice of the peace for Salt River Township in Shelby County which appeal was dismissed from the docket of the Shelby Circuit Court at the July Term last past whereby the said party of the 3rd part has become liable as security as aforesaid for the whole amount of of the judgement that said price recovered against Samuel Nesbit which judgement damages and costs amounts to the sum of fifty eight dollars and seventy five cents. Analysis of the Timeline

 

     Samuel Nesbit and Nancy (Thomas) Nesbit can be tracked for about 88 years from their origins in Virginia and Kentucky, through their life together in Kentucky to their final move to Missouri, based mostly on census, tax data and some associated court records. Based on his stated age in the 1850 census, Samuel Nesbit’s birth calculates to 1781. His birth place was listed as Virginia in the 1850 and 1860 federal enumerations, and it is known that his family was still residing in Augusta County in 1781. When he was about six years old, the family moved to Fayette County, Virginia on the western side of the Appalachian Mountains, and eventually to Harrison County, Kentucky. Young Samuel began appearing as a male of taxable age in 1799, when he was still living in his parent’s household, and he continued being counted as part of their household until 1809. From then on, he appears to be living in his own place, and by 1813 he owned 80 acres of land on Gray’s Run and a stud horse. Samuel married Nancy Thomas, daughter of John Thomas, in early June of 1813 in Harrison County, and census records note that she had been born in Kentucky. Nancy’s birth date of March 1793 was derived from the information provided on her headstone, so she was about 19 years old when she got married.

 

     Samuel was listed as being in Captain Gray’s Company in 1813, so he must have been required to join the local militia during the War of 1812. In his father’s 1814 will, Samuel was awarded some land adjoining his father’s land, which is probably the 80 acres he was taxed on in 1813. His father also gave him a horse, which is, quite obviously, the stud horse that shows up in Samuel’s 1813 tax bill. Over the next 13 years the value of the land appreciated from $12 an acre in 1814 to $20 an acre by 1826, and the total value of his property increased from $1400 to $2450. In the late summer of 1825 Samuel’s brother, Robert, sold him 17 acres of land adjacent to their family homestead for the paltry sum of six shillings. After 1825 his land no longer shows up in the tax books, and the total value of his property suddenly dropped from $2450 to $400, then $70 the following year. Apparently, he sold his 80 acres, possibly to one of his siblings. The family shows up in the Harrison County tax books for the last time in 1827, but Nancy and Samuel’s son, Nicholas, was born in Missouri later that same year, so, quite clearly, the land sales must have been a prelude to their move westward. In 1828, Samuels’ brother, William, who also moved to Missouri at this time, mentioned in a legal document that his brother Samuel was participating in a Bourbon County lawsuit. By the time of the 1830 census the family is living in Monroe County, Missouri. Apparently, Samuel and Nancy remained there for the rest of their lives. In the summer of 1840 Samuel was involved in a Shelby County, Missouri land conveyance. Nancy passed away in the summer of 1869, most likely in Monroe County, and was buried in the Nesbit Family Cemetery near Stoutsville, Monroe County, Missouri. The date and place of Samuel’s death is not known, but it quite likely that he passed away in the same county.
