Transcription note or What it it?

The source of these pages are the transcribed COURT estate records. I have tried my best to do an exact transcription. It was my intent to use the same upper/lower case letters and all original spelling. Sometimes the lack of punctuation creates a real problem in deciphering the intent of some of these records but I do not wish to alter the document in any way. The records were handwritten into a large ledger kept by the court.

Some Background information and pure conjecture:

During the time of the execution of this will two things were common that are unheard of now. They don't necessarily apply to this will but point out how little we understand the dynamics of life back then. 1) It was common, in some locations where it was law that the oldest son inherited everything, for that son to not even be listed in the will. Only the others that received special gifts and bequests were listed. In other cases, if gifts of property were settled on children at the time of marriage or the birth of the first grandchild they might be omitted in the will. 2) In some locations the the value of property was determined by selling it. Then the proceeds were split according to the wishes of the deceased. So you might see, as in this case, the widow buying the family bible and other personal items. Sometime the neighbors and family held off bidding, letting predetermined individuals go first. It appears that may have been the case in this auction.

Jacob said, in his will:

First I give all of my estate wherein I now live unto my dear wife Magdalene some of my children being along with her but if my children want to go and do for themselves then shall all the goods be sold and my good wife shall get her living out of it so long as she is a widow but if she marries another Husband she is to have the one third of all my estate and the remainder shall be equally divided amoung my Eleven children

So it seems that children were leaving home and Magdalene was cashing out to support herself on the proceeds.

* Definitions -----------------

[Hackle, 1. To comb flax or hemp; to separate the coarse part of these substances from the fine, by drawing them through the teeth of a hatchel.]

[Hopple, v.t. To tie the feet near together to prevent leaping; as, to hopple an unruly horse.]

[Clevis, n. An iron bent to the form of an ox bow, with the two ends perforated to receive a pin, used on the end of a cartneap to hold the chain of the forward horse or oxen; or a draft iron on a plow.]

[Riddle, n. [See Cradle.] An instrument for cleaning grain, being a large sieve with a perforated button, which permits the grain to pass through it, but retains the chaff.]

[I think a tare book was an account book but it's still listed in red so I remember to look it up for sure.]
