Will of John BAXTER, Cauldwell, Derbyshire

Probate granted 10 January 1740, Lichfield

In the Name of God Amen  I   John BAXTER of Caldwell in the County of Derby  Taylor & Grocer  being weak in body but of sound and disposing mind and memory praised be to God for the same  do make and ordain this my last Will and Testament in manner and form following

First I devise my soul into the hands of Almighty God who gave it hoping for his Acceptance theirof (sic) through the intercession of Jesus Christ my Redeemer and as to my wordly Estate I dispose theirof as followeth

First I give and devise all and singular my goods & chattels wares of stock and trade Readey moneys bills bonds and every Appurtenance lieing and being in Caldwell in ye County of Derby or else where to my son John BAXTER and his heires for ever subject never the less to the Payments and other sames following

viz My mind and will is that all my Debts and Funuaral (sic) Charges be first paid and as to the Rest of my Substance I give in manner and forme following

viz I give and devise to my son Joseph BAXTER Ten Pounds to be paid within two years after my Decease I also give unto my Daughter Marey BAXTER the sum of Five Pounds to be paid within two years after my Decease

And my Mind & Will allso farther is that my son John BAXTER shall find my son George BAXTER with Clothes dureing his Apprenticeship and likewise my Daughter Anne BAXTER with mentenance (sic) and clothes if so yet she will think well to stay with him for such mentenance until she is of Eighteen Years of age

And my Mind & Will also farther is that my son George BAXTER & Anne BAXTER shall have the sume of Five Pounds Eich (sic) when they arrive to the age of Twenty One years

And my Mind & Will also farther is that my son John BAXTER shall pay unto my Dear Wife the sume of Fivety Pounds as her marriage settlement Expresses, to be paid to her respectively or to her respective Extor Adm^ or Assign^

I also give unto my Daughter Elizabeth BAXTER Five Pounds to be paid when she comes to twenty one years of age

I also give to my son John BAXTER his heires Executors & Administrators all the rest residue of my Personal Effects of what kind or nature so ever and make him Sole Executor of this my Will and I do hereby revoke all former Wills by me made In Witness whereof I have hereunto sett my hand and seal 4th day of June the ThirteenthYear of Our Sovereign Lord George the Second by the Grace of God of Great Brittain & France & Ireland King Deffender of the Faith & so forth and in the Year of Our Lord One Thousand Seven Hundred & Forty

Signed Sealed Published & Declared by the above named John BAXTER the Testator to be his Last Will and Testament in the Presence of us whoes names are hereunto written who subscribed our names as Witnesses in his Presence he being of sound mind and memory

At Lichfield 10 Jan 1740: Let Probate of this Will be made to John BAXTER sonn and Sole Executor therein named Being first sworne and the debts payed the personal Estate will not amount to 40 P(ounds)
