“Verbal and Nuncupative Will

Be it known that Burr Fugate of the County of St. Louis and State of Missouri being in a low and feeble state of body but of sound mind and memory did on the 13 day of April AD 1850 call upon the undersigned Benjamin C. Wilson and Samuel Stout to bear testimony of my will which I did then and there pronounce and declare as follows to wit

all my debts to be first paid and then first I gave all my land in the State of Missouri and else where and Slaves to my Wife Melinia that she may have full use of them during her natural life and then to my children Stocks cattles.  All money debt due and demands and I also wish my children to have and as equal division of my estate at my wife Melinia's death name

which said will was reduced to writing by the said Benjamin C. Wilson in the presence of the said Samuel Stout and by us subscribed this 13 day of April one thousand eight hundred fifty.

[Our synopsis:
Court judgement denying the claims of Malena and Burr Fugate's daughter Mary Ellen Cormack and spouse John Cormack; and the children of her deceased daughter Lydia Jane Crow and deceased spouse Paschal Crow, namely George, Elizabeth, Annie and Albert Crow.  The claim was for the original value of the estate left by Burr Fugate to his widow and subsequently to their children.  Judgement allowed Malena Fugate control of the estate and any and all expenses during her lifetime.]
