This is the last Will and Testament of me Edward Jones the elder of
Church Gresley in the County of Derby, Potter. I appoint Thomas Gray, Agent,
and Valentine Peace, Cordwainer, both of Church Gresley aforesaid, to be
executors of this my will. I give devise and bequeath all my real and personal
estate, effects, and property of every sort and kind unto the said Thomas
Gray and Valentine Peace their heirs Executors, administrators, and assigns
upon trust as soon as conveniently may be after my decease to convert the
same into money for which purposes I give to my said trustees all requisite
and necessary powers of sale and authority to execute all conveyances and
other apurances of my said real Estate. And I declare that the receipts
of my said trustees shall be valid and effectual discharge to the purchasers
of my said real Estate and that such purchasers shall not be obliged to
see to the application of the purchase money. And I declare that my said
trustees shall stand possessed of the monies to arise from such sales as
well as from the bequest herein before made. Upon trust to pay thereout
all my just debts, funeral, and testamentary expenses, and after payment
thereof upon trust to invest the same at interest upon good and valid securities
and apply the interest and proceeds thereof in trust for my wife Mary for
her life for her own account and benefit and immediately after her decease
upon trust for my six children: William, Moses, Edward, Aaron, Mary wife
of Henry Adams, and Miriam in equal shares and proportions. And I declare
that each of my said children shall take a vested interest in my said Estate
immediately upon my decease. And I declare expressly that notwithstanding
the power of sale hereinbefore given to my said trustees that they shall
at the request in writing of my said wife postpone the sale of all or any
part of my said real Estate from time to time during her life. And I also
declare that my two sons Edward, and Aaron, shall be allowed the rights
preemptions of all those my potworks and premises now in my occupation
situate upon the Common at Church Gresley at a valuation to be fixed upon
by two indifferent persons one to be named by my said trustees and the
other by my said sons Edward, and Aaron, and in case such two persons cannot
agree then at the valuation to be agreed upon by a third person to be previously
named by such two disagreeing. And I expressly declare that it is my desire
that my said son Edward shall notwithstanding he may have had any conveyance
made to him of any part of my said real estate receive only his due proportion
with the rest of my said children and in case of his agreeing to do so
then that any security I may be in possession of at the time of my decease
from my said son Edward shall be null and void. And I strictly enjoin my
said son Edward to fulfil and perform this my last injunction upon him.
In witness whereof I the said Edward Jones the Elder the testator have
to this my last will and testament set my hand this 2nd day of June 1840.
Signed, published, and declared by the said Edward Jones the Elder the
testator in the presence of us present at the same time who in his presence
at his request and in the presence of each other have set our names as
witnesses: W Dewes, Welborn Owston.
