In the name of God Amen.
I John Whitaker of Church Gresley in the County of Derby, Farmer, Being
of a sound and Disposing Mind, memory and Understanding, Thanks be to God
for the same, Do make Publish and declare this to be my last Will and Testament
in manner and form following (That is to say) First I Nominate and appoint
John Brantnall of Bagworth in the County of Leicester Farmer, And my loving
wife Mary Whitaker, to be Executor and Executrix to this my last Will and
Testament and I Give Devise and Bequeath into their Hands all and every
of my Estates at Church Gresley aforesaid, and elsewhere wherever the same
shall be found at the time of my Decease together with all and every of
my live and dead stock of all kinds whatever and wherever the same shall
be found at the time of my Decease and also all my Household Goods Implements
of Husbandry, Bonds, Notes and all other securities both for Lands, Buildings
and Money. And I also constitute and Appoint John Cooper of Church Gresley
aforesaid to be Executor with my afore mentioned Executor and Executrix.
And my will is that my Executors and Executrix as soon as possible after
my Decease and the proving of this my last will and testament shall sell
all and every of my liveStock, Implements of Husbandry and all and every
of my Household Goods except as many as shall be sufficient to furnish
one Room for my loving Wife Mary Whitaker and my Will is that, after my
live and dead Stock, Implements of Husbandry and Household Good shall be
sold the money arising therefrom shall be applied to the payment of my
Just Debts, and my Will is that my Executors shall let and set all my real
Estate both Lands and Buildings except the one Room Occupied by my loving
Wife Mary Whitaker and all the Rents and Profits therefrom arising shall
be applied to the Maintenance of my loving Wife and my son Samuel now a
Minor and my Will is that as soon as my son Samuel Whitaker shall attain
the age of Twenty one Years my will is that my Executors shall then have
power to sell all and every of my Real Estate at Church Gresley or elsewhere
and all the money therefore arising shall be put out on good security and
the Interest therefrom arising shall be applied for the Maintenance of
my loving Wife Mary Whitaker if she shall be then living but if she shall
not be living then my Will is that after my two Executors shall have paid
all expences attending the sale of all my Real Estate and their own reasonable
expences then the money arising from the sale of my Real Estate shall be
equally divided amongst my three loving children John Whitaker, William
Whitaker and Samuel Whitaker equally share and share alike or the lawful
Heirs of such surviving son or sons, but my Will is that my son Samuel
shall be put out by my Executors to some Trade if he shall choose to be
a Trader. Lastly I the aforenamed John Whitaker the Testator do hereby
Publish and declare this to be my last Will and Testament, And do hereby
make void all and every other Will or Wills heretofore by me made. In Witness
whereof I the said John Whitaker the Testator have hereunto set my Hand
and seal this third day of November in the Year of our Lord one Thousand
Eight Hundred and Sixteen.
