  • His will was dated "New York, August 13, 1771. I an in a bead stete of hillt, and have no time to spend my time for worls eafers, but intend a vill mey eastete acordin as follos. To my dere father and moder I will and bestow my place at Hopvill (Hopewell) and all my horses and my negor boy, and lickvis bestow the goods that I have at Fishkill in my store there. To my brother Abraham and my sister Antye all my bonds, notes and books to pay debts, and divide the rest between them. But I allow Abraham for his trouble in collecting the money. I further desire that after my death you vill remove to my father's old place and enjoy it, if it be your minds. I leave to my dear sister Sally a bond against Philip Ver Planck of £80. But mind, if Col. Lott shall make any demands upon my estate, don't allow one farthing. If Mr. Scott shall tell you it were best, don't mind it, but take course of the Law. Dear brother must have my wearing apparell. So no more but Love and Friendship. Stephen Duryee." Witnessed by Luke Kierstede, Peter de Riemer.
    Proved in Dutchess County, 6 Feb 1782, before Gilbert Livingston, Esq. upon oath of Dr. Lucas Kierstede, of Kingston, Ulster County. Abraham Duryee was made executor, but resigned and Letters of Administration were granted to Abraham Duryee, Abraham Duryee, Jr., and Peter I. Montfort, all of Rombout Precinct.4

Duryee, son of brother, John Duryee, deceased; Jacob Duryee, Jr., son of my brother, Jacob Duryee, deceased; Wilkelmus Duryee, son of my brother, Cornelius Duryee, deceased; and John Duryee, Jr., son of my brother John Duryee, deceased" (£200 each). To Jane, widow of my brother John, deceased (annuity of £25 per annum). To brother Henry (£25 per annum). All waering apparel to nephews. To wife (name not stated) "my Chariot and horses and my negro girl named Susan, aged about nine years, without any account to be given to my other executors." Wife also receives household furniture, plate, my other negroes, and occupation of one of my houses in New York City, for as long as she remains a widow. Also an annuity of £600 per annum. Executors are given power to sell real estate in New York or elsewhere as they see fit, but no New York City real estate to be sold during wife's widowhood. If she should remarry, she is to receive £2000. Bequests £6500 to be divided in equal parts among all the children of my brothers and sisters (except said Abraham I. Duryee, Jacob Duryee, Jr., Wilkelmus Duryee, and John Duryee, Jr.). "In the distribution of which said sum of £6500, it is my will that James C. Roosevelt, son of Christopher Roosevelt, deceased, by Mary, the daughter of my brother, Jacob Duryee, deceased, shall be entitled to one share; and the children of Daniel Duryee, deceased, the son of my brother Daniel, shall be entitled to one share; to my niece, Elizabeth May, wife of Benjamin May of Baltimore, for the use of her son Abraham, two hundred and sixty dollars; to Elanor Bassett, widow of the late Captain John Bassett, deceased, three hundred and sixty dollares; to the four daughters who are now living, of my brother-in-law, Jacobus Roosevelt, and Cornelius Roosevelt, Esq., both deceased, one hundred dollars each, all which Legacies, I direct to be paid by my executors, in one year after the death or remarriage of my wife." A fourth part of residue to nephew Abraham I. Duryee, and after his death to his eldest son, for want of a son to his daughter or daughters, if without issue at his death then to the two sons of his brother, Jacob K. Duryee. A fourth part of residue to nephew Jacob Duryee, Jr. (same conditions as above) if he should die without issue then to the eldest son of "my nephew Christian Duryee, and the eldest son of my nephew, Conelius Duryee, deceased, and the eldest son of my, nephew, Aaron Duryee, son of my brother Joost, deceased, and to the eldest son of the said James C. Roosevelt, in equal parts." One fourth of residue to nephew Wilkelmus Duryee, and after his death to his son Cornelius, and if Cornelius should die before his father, Wilkelmus Duryee, without issue, to his brother or brothers. The remaining fourth part of residue to nephew John Duryee, Jr., to his heirs forever. Appoints as executors, his wife (name not stated), Cornelius C. Roosevelt, James C. Roosevelt, and Harry Peters, New York, merchant. Witnesses: Abrm. M. Walton, attorney, Philip Ten Eyck, Anthony Bleecker.
    Codicil dated 7 Apr 1797. Leaves £30 to my brother-in-law, Peter Low, and an additional £5 to brother Henry Duryee. "My present family be supported for and during three months after my decease out of my estate; that my nephew, John Duryee, be permitted if he chooses to remain one year after my decease in my family as an assistant to his Aunt. Witnesses: Margaret Low, Henry M. Van Solingen, physician, Isaac S. Douglass.5
