In case of his death without issue, the estate to descend to the next heirs of his mother, Diana Risley. Legacies to mother Dina Gaell, brother David Gaell, nephew Abel Gaell (to be paid 3 years after he is of age). Executors: after my wife's decease - John Cowneover, Benjamin Ingersul (my neighbors). Wit.: John Covnover, Benjamin Ingersull, Stephen Morris. Sworn at Sharon, Burlington Co., 31 July 1749.5
- He made two wills ten years apart, both of which were recorded and are found in the New Jersey Archives abstracts. The first was dated 30 Oct 1720, proved 25 Dec 1730 (NJA 23:177). The second is dated 19 Sep 1730, sworn to at Sharon, New Jersey, apparently after a family dispute as late as 31 July 1749 (NJA 30:191-192).4
- On 25 October 1744 Stephen Morris and Benjamin Ingolson testified that Samuel Gale left a legacy to Abil Gail, son of David Gail, in the presence of the aforesaid witnesses. Stephen Morris (who wrote the will) saith not, and Benjamin Ingolson saith not. The will was delivered to John Cownover till called for. (Gloucester Wills 420 H).5
