1617, 20 May - Nup. Jonathan Fayrbanke and Grace Smith, War(ley) [Parish Record: Halifax, Yorkshire].

[Several History and Genealogy books indicate that Grace Fairbanks maiden name was Lee, however the above record is quite clear that it was Smith. The only mention of a Grace Lee was as a witness to the 1650 will of Cousin George of Sowerby and obviously Grace Fairbanks was living in Dedham at that time and wouldn't have been the one to witness that will].

Jonathan Fairebanke came to Boston, Mass., in the year 1633, and in 1636 settled in Dedham, Mass., where he built the noted �Old Faibanks House� which is still standing as an ancient landmark, the oldest dwelling house in new England that, for the same period of time, has been continuously owned and occupied by the builder and his lineal descendants. Only a few houses, or parts of houses of the same age remain, and most of these are in ruins. It is moreover, a remarkable fact, perhaps unparalleled in this country, that during all this time, two and a half centuries, the estate has never had a mortgage incumbrance upon it.

This house is now historically famous, and is an object of great interest to many visitors to the old town of Dedham. It has been claimed that this house was built in 1636. This claim has been the subject of considerable discussion among historians, and is disputed on historical grounds. One, at least, expresses the belief that it was not built till about the year 1654. The chief reason assigned for his belief is that the old house is a framed building of massive oak timber, and that there in no historical evidence that any framed dwelling houses were erected in the town as early as 1636. Against this alleged fact is the tradition that the frame of the main part of the house, together with the bricks and tiles and windows, was imported from England, and remained in Boston for several months before it was carried to Dedham.

The truth is that the house was not built as it stands at one time, or in one year; and it is certain that Jonathan owned a house situated probably on the same lot in 1648. In the valuation of houses, made in that year for the purpose of assessing the �country rate,� there were enumerated eighty-one houses, ranging in value from �45, the highest, to �2, the lowest, omitting fractions. The valuation of Jonathan Fairbanke�s house was �28, and only eight houses were estimated higher. The highest valuation, �45, was placed upon the house of Rev. John Allin, pastor of the church.

Subsequently, perhaps as late as 1654, a large addition was made to the original building, which was called the new house, which is said to have been built for the occupation of his son John after his marriage�From these facts and circumstances, particularly the fact that he owned a lot of land prior to May 1637, it is not unreasonable to conclude that he built a house in 1636, or soon after, which is a part of the present building, or in a short time was replaced by a framed structure to which the addition was made some years later.

From that time down to July, 1892, the old house was continuously occupied by a Jonathan Fairbanckes and his descendants, Joseph, Joseph 2nd, Ebenezer, Ebenezer 2nd, Prudence, Sarah (Sally), Nancy, and Rebecca, the last of the family tenants. In July, 1892 the house was struck by lightning and considerably damaged. Mis Rebecca�s pet dog, lying under the bed where she was sleeping, was killed, but she escaped with a severe shock. Shortly after this event, deeming the house no longer a desirable place of abode, she abandoned it, leaving a strange family in charge, and removed to Boston. Thus for the first time in over two hundred and fifty years the old house was occupied by persons not �to the manor born� But after spending several months in Boston she returned to dwell in the time-honored mansion, of which she was then the sole owner, and is still living there (Fall of 1896)

[Several History and Genealogy books indicate that Richard Fairbanks of Boston was probably a brother of Jonathan, however I find no indication that this was the case and to the contrary:
Firstly, Richard was alive in 1650 but not mentioned in the will of Cousin George of Sowerby, although Jonathan was mentioned.
Secondly, Richard's only child to live to maturity was Constance, wife of Samuel Mattocke, and there is no indication of any interaction between the two families].

Wheras meetings have ben agreed upon & tymes apoynted accordingly, it hath often happened yt by ye slacknes of many their comeing, others have by long attendance waested much tyme to their greate damage. It is nowe for prvention thereof agreed & ordered taht whoesoever shall have Received notice of such a meeteing & shall absent himselfe one halfe houer after ye beateing of the drume shall forfet twelve pence, And yf any shall wholly absent himselfe shall forfet the sum of Three shillings & Fower pence, except ther be some greate occasions to the contrary & ye same to be allowed of accordingly in eyther of ye sayd cases

Wheras upon good viewe taken of ye Swampes next ye Towne they are fownd to be soe greate yt ye formr prportion allotted to men will not be neere sufficient to cleere them wherfore we doe nowe by a genrall consent order that soe many as have 12: acre lotts may have 4 acres for their 2: acres formrly granted, & those 8 acre lotts may have 3. acres of Swampe yf they please, otherwise not. Provided allwayes that [] the fourth prte of yt wch [] man doth accept of shalbe cleered every yeare in manner and forme according to ye first order Ordereing also yt whosoever shalbe fownd defective shall for every defaulte soe made forfett ye price of an Ewe kid then to be [] valewed and payd unto ye collector for benefit of ye wholl towne. In 1638, the 30th of the 3d month, Jonathan Fairbankes was appointed, with several others, to measure out those polls of Medowe wch adjoyne to mens Lotts. And to measure out soe much medowe in sevrall pcells as is allotted unto evry man according to their graunts made unto them.

The 28th of ye 5th month, 1638, it was ordered yt those wch Inhabit on ye East side of the little River shall have for yr Medowe next beneth ye greate pond. Under this order Jonathan Farebancke received six acres, five rods. But by Reason of some Interrruption arising by challenge made of the same medowe to belonge unto some of the Farmes &c., there was given to him in 1642, in place thereof, Sixe acres in ye medowe neere unto the South side of Ballpate hill (Source: Genealogy of the Fairbanks Family in America: Lorenzo Sayles Fairbanks, 1897.).

February 3, 1640 Graunted that John Farebanke maye have one Ceder tree set out unto him to dispose of wher he will: In considracon of some speciall service yt he hath done for ye towne: and not yt this shold be a president for others to obteyne the like wth out some speciall cause guiding therunto.

July 14, 1641 ordered yt Tim Dwite�shall asist�in laying out the bounds of this Towne compleate. yt John Dwight, Johnathan Fairbanke or any 3 of them shall search out appoynt determine and lay out a Cart way to our Water Mill for a common leading way where euer they or any 3 of them shall by their discresion judg most convenient for the Towne as also such foote pathes as may most conueniently be found nighest & best pasable or yt may be made passable: and also the sd men or any 3 of them shall haue power to make such satisfaction to any that shall haue damage as by their discresion they shall judg equall and as the Towne in other the like cases doth give.

The 15th of ye 7th month 1641 Dedham Grantith to Jonathan Fairbanke and to his heyres or assignes for ever; One acre more or lesse as it lyeth on ye Low playne; abutting upon Michael Powell toward the North east & upon John ffrarey toward the South west; & upon the waest towards the Norwest and upon ye highway from Dedham to Dorchester mill the South east (Source: Genealogy of the Fairbanks Family in America: Lorenzo Sayles Fairbanks, 1897.).

July 10, 1642 John Dwite and the other Town Officers decided that �Wheras�Jonathan Farebanke�had each of them appoynted to have 6 acres of medowe for their second Devision to make up 12: acres to their Lotts But by Reason of some Interuption arising by Challenge made of the same medowe to belonge unto some of the Farmes &c Wherfore we thinkeing it not fitting to hold them in suspence any longer. Doe therfore nowe order & graunte unto ye sayd three men above named to have ech of them Sixe acres in ye medowe neere unto the South side of Ballpate hill to be measured out unto them sevrally by our Measurer & others appoynted therunto heerunder named for their full satisfaction to make up the 12: acres of medowe due unto them pvided that they Relinquist the abovesayd graunts formrly made unto them.

January 2, 1643 John Dwite, Timothy Dwight, Nathaniel Whiteinge and Jonathan Fairbanke were four of the 51 attendees at the Town Meeting at which John Dwight was again elected as one of the seven Town Officers.

The 4 of ye 12 month 1644 Jonathan Fairbanckes received a grant of two and one-half acres of woodlands (Source: Genealogy of the Fairbanks Family in America: Lorenzo Sayles Fairbanks, 1897.).

February 4, 1645 granted Lots in the Woodlands to divers men as followeth�Jonath Fairbanke 6 acres 1 (Source: Town Record: MA: Suffolk: Dedham.).

Jonathan Fairebanke notwthstanding he had long stood off fro� ye church upon some scruples about publike p�fession of faith & ye covenant yet after divers loving conferences wth him; he made such a declaration of his faith & conv�sion to god & p�fession of sujection to ye ordinances of Xt in this XX yt he was readily & gladly received by ye whole church: 14d 6m 1646 (Source: Genealogy of the Fairbanks Family in America: Lorenzo Sayles Fairbanks, 1897.).

December 7, 1646 John Dwight �deputed to treat�about a parcell of his house lot to dig clay in: & with Jonathan Fairbanke about a way thereunto: & to tender satisfaction to them for ye same: & to make a full agrement as they shall se meete.

December 29, 1647 Ordered that Jonath Fayerbanke�or any 2 of them being formerly Chosen Surveyers for the year 1647 ar heerby enabled and authorised to call in such of the Inhabitants of this town as ar yet behind in thier high way worke. to pforme the same. at such time and place. as the said men shall apoint or compound with them to thier satisfaction

Ite I give & bequeath to George (ffarbanke my secon)d sonne & to his heyers for ever, sixteene pounds the one halfe whereof shall be payed to him within the space of one yeare next ensueing after the decease of my said wife; And whereas I haue allready given and doe herby confirme to my said sonne George all that my prt in the generall devident already laid out thro Meadfield & some workinge tooles & such like small things, my will & my mind is, That the said percell of lande and those tooles and other small thing soe giuen shall be all indifferently & Equally aprized and if they shall together amount to the value of eight pounds then it shall be accounted for his first payment and

Item I give & bequeath to Jonathan ffarebanke my yongest sonne & to his heighers the like sume of sixteene pounds, to be paid allso in two Equal Sumes.

Item I give and bequeath to Sarah the Eldest daughter of my sonne John ffarebanks one young beast betwixt one and two yeares of age, & more three pounds to be payed by my Executor when she shall attaine lawfull age, the young beast before mentioned I Reserve out of the cattell bequeathed to Grace my wife;
