Will of Joseph Powell of Kent County, Delaware
I Joseph Powell of the
county of Kent on Delaware being far advanced in years and Weak in body
but of sound and Disposing mind & memory Thanks to Almighty for the Same,
and calling to mind the uncertainty of this Life Do make this my last Will
and Testament in manner and form following, That is to say My Will and
desire is that all my just Debts which I to my person _____ ____ ___st and
in a reasonable Time paid by my Executors hereafter named, out of my
Personal Estate. Secondly I give and Bequeath unto my Elder son William
Powell all the land and Plantation which I bought of John Hill
called Mabry Plains containing 200 acres ___ ___ with the
appurtenances thereunto belonging and also one other tract or Percel or
land adjoining the same called Solomons Seal containing 245 acres
of Land excepting Ten acres of Land and swamp Laying on the southeastern
most Corner of the said tract of Land called Solomons Seal, unto my
said son William Powell, his Heirs and Assigns forever. And Thirdly
I give and Bequeath unto my younger son John Powell all the Land
and Plantation whereon I now Dwell with all the Land which I possess
thereunto adjoining, being part of several tracts of Land as may or at
Large appear by Deeds of Sale and _______ there Surveyors Office &c. and
also one other percel of Land Containing ten acres of Land Situate on the
forrest of Murderkill hundred and county aforesd, to be laid off of the
most southeaster most Corner of the above mentioned Tract of Land which is
called Solomons Seal unto my said son John Powell, his Heirs
and assigns forever. 4'ly I give and Bequeath unto my Daughter Mary
Maxwell wife to Thomas Maxwell the sum of five pounds Lawfull
Money of this government. 5'ly I give and Bequeath unto my Daughter Ann
Freeman wife to William Freeman the sum of fifty pounds Lawfull
Money of this Government to be paid by my Ex'r in the manner and form
following that is to say that at the Expiration of one year after my
Decease the sum of Eight Pounds and at the Expiration of of two years
after my Decease the like sum of Eight Pounds and so the like sum of Eight
Pounds yearly untill the above mentioned sum of Fifty Pounds be unto her
paid clear of Interest on any part of the above mentioned fifty Pounds.
6'ly I give and my Will and desire is that my Son William Powell
shall have one fifth part of my Personal Estate which shall appear clear
on settlement, Exclusive of the above mentioned legacys of five Pounds
unto my Daughter Mary and Fifty Pounds unto my Daughter Ann.
7'ly My Will and desire is that all the Children of my Daughter Mary
Maxwell shall have one fifth part of my Personal Estate which shall
appear Clear as aforesaid Exclusive of the aforesd Legacys, be equally
Divided to and amongst them or their Legal Representatives. 8'ly My Will
and desire is that one fifth part of my personal Estate which shall appear
Clear Exclusive of the above mentioned two Legacys unto my Daughters Viz.
Mary and Ann, be Equally Divided to and amongst all the
Children of my Daughter Hannah Deceased, late wife to Richard
Downham, Dec'd, to them or their Legal Representatives. & Ninthly my
will and desire is that my Daughter Sarah Downham wife to Joseph
Downham shall have one fifth part of my Personal Estate which shall
appear Clear as aforesaid, Exclusive of the legacys of five pounds and
fifty pounds to my Daughters Namely Mary and Ann. And
further my Will and desire is that my son John Powell shall have
one fifth part of my Personal Estate which shall appear Clear aforsd,
Exclusive of the afsd Legacys unto my Daughter Mary & Ann.
Also my Will is that all the rest of my Estate both Rail & personal which
is not mentioned in this Will be Equally Divided to and amongst my
Children namely William Powell, Mary Maxwell, Sarah
Downham, John Powell and Ann Freeman wife to
William Freeman, to them their Heirs and assigns forever and Lastly I
do hereby Nominate & Constitute and appoint my well beloved Sons
William Powell & John Powell my whole & Sole Executors of this
my Last Will and Testament, hereby Disannulling and making Void all other
Will or Wills heretofore by me made, Pronouncing & Declaring this to be my
Last Will and Testament in Witness whereof I have hereunto set my Hand
and affixed my seal the Twentieth Day of the Eleventh month Seventeen
Hundred & Seventy four ~ 1774
