          "Cases Down For Assizes"

          Several Interesting Ones, Including Actions Against Local Druggist and B. of  R. T.

          For the non-jury sittings of the High Court to be opened at the court house here next Monday before 
         Justice Britton, the following cases have been entered:

          Edward Loosemore, vs. the corporationof the township of Aldborough, claiming $60 damages for water 
          discharged on his land, and asking for an injunction to restrain the defendants from further discharging water 
          on his property.   J. S. Robertson for plaintiff; C. St. Clair Leitch for defendants.

         John Milton Wright and Fanny Wright vs. J. M. Ross & Sons & Co. Limited, St. Catherines, asking that the 
         agreement for the purchase of a threshing machine be set aside and that promissory notes and chattel
         mortgages be given up and cancelled, and in the alternative judgment for the sum of $2,400 and interest 
         against the defendants.  A. McCrimmon for plaintiff,  and Marquis & Lane, St. Catherines, for defendants.

         E. J. Butler vs. Sarah C. Fulton, J. Fulton and W. J. Green to compel the performance of an agreement 
         for sale of store on Talbot Street East by the defendant Sarah C. Fulton; that a deed made Sept. 10, 1906, by
         Sarah C. Fulton to W. J. Green and the mortgage dated Sept. 11. 1906, made by W. J. Green to Dr. James 
         Fulton be set aside and declared void.  D. Coughlin for plaintiff;  Leitch & Green for defendants.

         B. F. Honsingar vs. Gustav Falk, K. S. Falk, Jessie M. Falk and brother, a partnership claiming $807-50 damage 
         for the difference in value now and when ordered and not delivered.
         Leitch & Green for plaintiff;  J. B. davidson for defendants.

         Chicago Life Insurance Cop. vs. Tyrell H. Duncombe and Reginald L. Duncombe, claiming the sum of 
         $1,035. 7. 2. with interest thereon, from May 7, 1906, to date of judgement , costs, etc.  Plaintiffs claim that defendant 
         Reginald Duncombe entered into an agreement with them to canvass for insurance for them in the state of Minnesota,
         and did not fulfil his agreement.  Leitch & Green for plaintiff; A. Grant for defendant.

         Edgar Silcox vs. Albert D. Ferguson and the Canadian British Land Co. to recover $320 commission for sale of lands, 
         costs of action, etc.  Leitch & Green for plaintiff;  A. McCrimmon for defendant.

         Mrs. Risea Pinfold, of Rodney, vs. Mrs. Elizabeth Martan, of St. Catherines, claiming  the delivery of and cancellation 
         of promissory notes to the amount of $1,275. which it is claimed, were obtained by fraud, just after the death of plaintiff's
         husband, Thomas Pinfold, of the Patterson House, Rodney, the........    Continued on page Four (which I don't have!)
