Mrs. RHINE left her husband in April 1909 and on 30 July instituted a suit against her husband for "dissolution of marriage", or for "judicial separation", in the Court of the District Judge of Saharanpur. Mr. RHINE filed a petition for divorce on 22 July 1909 on the ground of his wife's adultery with another Engine Driver on the North-Western Railway.

Mrs. RHINE alleged acts of cruelty by her husband, against her consent. The adultery of Mrs. RHINE with the co-respondent was established, also the misconduct of Mr. RHINE as alleged by his wife. Their petitions for dissolution of marriage were therefore dismissed.

A judicial separation was allowed due to the cruelty - criminal acts - of Mr. RHINE.

Both parties went to appeal. The judge sought to discover whether or not Mr. RHINE was guilty of the misconduct imputed to him.

Mrs. RHINE gave evidence, corroborated by Mrs. TILBURY, a diplomaed mid-wife, and also by her next-door neighbour Mrs. BURROWES. Mrs. TILBURY said she found Mrs. RHINE in a condition indicating that the offence complained of had been committed and that she had been treating her for the injuries sustained; she said she was called in once or twice more for the same reason.

Since both had committed adultery, dissolution of marriage was refused. The judicial separation allowed by the lower court, was annulled since inappropriate.

Notes: TILBURY = stockaded area on the crest of a tree-covered hill.

The origin of the name is considered at latest to be Saxon, and according to other historical indications (place-names, etc.) to be that of a 'tribe' of sailors / boat builders / traders, around the lower part of the North Sea and the eastern end of the Channel (Tilburg, etc.). My own received mythology, from my effective father, who said he had a read a history of the Ts (which I cannot find, but believe to be true), is that they came to England from across the North Sea, settling first in Essex - hence the three Tilbury towns - and then moving inland before successive invaders, not being warriors*; moving into the hills of Buckinghamshire (Tiliberia both in Essex and Buckinghamshire), and further, even as far as Ireland; returning later via Hampshire and the Midlands. The majority of the TILBURYs was, and still is, around the Thames.
(* i.e. paddling up the Thames as fast as they could go!!!)

TILBY and variants were sometime diminutives of TILBURY (Buckinghamshire and areas to which those Ts moved; variants south of the Thames, medieval period, were TILBOROW TILBOROUGH etc., until late 18thC; west country TIBERT, TILBARD, may also be variants).

However, there were two French Huguenot TILBY (TILBEY, TILBEE) brothers who landed in Kent, and whose descendants flourished there. Few TILBURYs were in Kent - around the port areas.
