Ambrose Cobb To & Deed of mortgage Clinton Jacobs

This agreement made and entered into this the 14th day of December in the year 1840. between Ambros Cobb and Clinton Jacobs both of the county of Rutherford and State of Tennessee, Witness that whereas the said Clinton Jacobs has got the said A Cobbs notes one due the 25th of December 1840. for Sixty five Dollars and one other for the amount of Eighty dollars due 1841 and one other note for Thirty dollars due 1841. The sum of one hundred and seventy five dollars, Now to secure the said sums of money to the said Clinton Jacobs the said A. Cobb hereby sells and conveys to him the following described property now in his possession, to wit one sorrel horse, two sorrel colts, one gray mare and colt, one black colt, one cow and calf, one side board two beds & steads & furniture, ten chairs, one clock, seventy five barrels of corn one loom, table fifty head of geese & all my farming utensils and it is agreed between said parties that the said parties that the Cobb is to keep possession of said property untill the 25th of December 1841. and in case he should on or before that pay the afro said sums of money to the said Clinton Jacobs then this deed of trust is to be void and of no effect but if he should fail to pay the said sums of money then the said Clinton Jacobs may take said property into his possession and sell the same or so much thereof as may be necessary to satisfy said debts and interest and cost of sale, on giving twenty days notice at three public places in the county. Witness my hand and seal this 14th December and the year as above written ----

TO: Deed & Trust Clinton Jacobs

This agreement made and entered into this the 21st day of Dec. Eighteen hundred and forty four, between A. Cobb and Clinton Jacobs both of the county of Rutherford and State of Tennessee, whereas the said Clinton Jacobs has this day loaned and advanced to the said A. Cobb the sum of Eighty Six dollars and forty two cents. Now to secure the said sum of money to the said Clinton Jacobs, the said A. Cobb hereby sells and conveys to him the following property, to wit, one bay horse, one bay mare, one cow and calf, one yoak of oxen, twenty head of stock hogs, now in his possession, And it is agreed between said parties that the said A. Cobb is to keep possession of the said property until the 21st of Dec. Eighteen hundred and forty five and in case he should on or before that time pay the afore said sum of money to the said Clinton Jacobs. Then his deed of trust is to be void and of no effect, but if he should fail to pay the said sum of money, then the said said Clinton Jacobs may take said property into his possession and sell the same or so much there of as may be sufficient to satisfy said debt and interest and cost of sale on giving twenty days notice at three public places in the county. Ambrosia Cobb TO: Deed & Trust John W. Yardley

I have this day bargained and sold and do hereby transfer and convey unto John W. Yardley for the sum of one hundred and five dollars & nineteen the following property (vig) one Sorrel Horse three years old, one Baymare, four years old, one JennaII two years old, Two Carr.... safe, six chairs, But this deed is made for the following purpose and uses and trust and for our other purpose that is to say I am indebted to one John W. Yardley in the sum of one hundred and five dollars & nineteen cents by note under seal of the date due on the 9th day of December 1852. and desires to secure and make certain the payment of the same, now if I should pay the said debt at the time a fore said then this deed to be void. But if I should not then the said John W. Yardley as Trustee after giving thirty days notice in writing at the court house door of the said County and at the election ground of the 24th district and three other public places in the neighborhood may expose to sale the above named property and sell it in so much thereof as will satisfy the above debt and cost for cash to the highest bidder and appropriate the proceeds first to the necessary expenses and cost, and second by to the satisfaction of said debt, given under my hand & seal this 20th day of December 1851 State of Tennessee
