Bainbridge Colby 1869-1950, U.S. lawyer and public official, b. St. Louis. Upon graduation (1891) from Columbia law school, he began law practice in New York City and became active in Republican politics. He left the party with Theodore Roosevelt (1912) to found the National Progressive party. During World War I he served on the U.S. Shipping Board and he became (March, 1920) Secretary of State in President Wilson's cabinet. He became a close confidant of Wilson, with whom he practiced law (1921-22) after Wilson's term of office ended.

"Loyalty"

It is important that we should constantly keep before us the duty of inculcating in the minds of our citizens from overseas the true meaning and significance of America, and the high duty that rests upon every generation to sustain our blessed institutions, and to transmit them to posterity strengthened and unimpaired. The test of good citizenship is loyalty to country. And one cannot discharge the duty of loyalty without the patient and an open minded study of the institution that marked the country and defined its character. America stands for individual liberty, but that means an ordered liberty. A liberty subject to law and subordinate to the common welfare.

The social and industrial structure of America is founded upon an enlightened citizenship. This presupposes education. Americanism demands loyalty to the teacher and respect for his lesson. I am deeply concerned with the diminution of the teaching strength of the country as a result of the disproportionately low salaries that are paid to teachers throughout the country. We must look to this right promptly. It is a condition that must not be suffered to continue.

Loyalty to America means loyalty to her children's servants from president down. We must stifle the voice of hatred and faction. We must realize that there is not a man who holds office except as a result of the free choice of our citizens. It is a high patriotic duty that we support and sustain the men who have been placed in position of difficulty, burden, responsibility, and even danger as the result of our suffrages. That does not mean that we must forego just and fair criticism, or refrain from opposition to policies which are debatable or which do not command our approval. An intelligent and conscientious opposition is a part of loyalty to country. But we must not, if we are loyal, disperse our energies in a partisan warfare that is waged without regard to its consequences to the well being, security, or honor of the country.

We must be loyal to the forum of our government. Under it we have grown great in numbers, wealth, and national influence. We must be loyal to the words that have come down to us from the past, bequeathed by Americans who have lived great lives in the service of America. Loyalty to America requires that we should preserve a friendly and encouraging and sympathetic goodwill toward our day and generation. Like pictures, men should be judged by their merits and not by their defects. Loyalty will not permit envy, hate, and uncharitableness to creep into our public thinking. Thus, only in a hopeful and confident temper, in a proud and constructive spirit, will we rescue the present and safeguard the future of our beloved country. The times call loudly to each of us for loyalty -- loyalty of purpose, loyalty of thought, loyalty of effort, and the loyalty of patience.

Secretary of State, 1920-21 A founder of the Progressive Party, 1912. After an ailing and angry President Woodrow Wilson dismissed Secretary of State Robert Lansing in February, 1920, for failure to support his administration's foreign policies, Wilson appointed New York lawyer, politician and public servant Bainbridge Colby as a replacement. For the next 12 months, Colby loyally supported the desperately sick President. Colby tried to rally public support behind the League of Nations and firmly laid down a policy of nonrecognition of Soviet Russia that was to last until 1933. A St. Louiss-born (1869) New York resident, he had not always been an admirer of Wilson. As one of the founders of the Progressive Party in 1912, Colby supported Theodore Roosevelt's presidential campaign against Wilson that year. By 1916, however,Colby had become a Democrat and would soon serve as a World War I bureaucrat. After Wilson left the White House in 1921, he and Colby formed a law partnership that lasted until Wilson's retirement in 1923, the year before his death. For the rest of his life Colby remained in private practice. He died in Bemus Point, N.Y. in 1950.

The legality of admitting to probate the will of the late Bainbridge Colby has been upheld by the Appellate Division, Fourth Department, of the State Supreme Court.

Mr. Colby, Secretary of State under President Woodrow Wilson, died on April 11, 1950. His will, drawn in Sept. 1941, left the bulk of his estate with a gross estimate of $130,000 to his second wife, Mrs. Anne Ahlstrand Colby.

Two daughters by his first marriage, Mrs. Katherine Delafield and Mrs. Francis Rogers, both of New York City contested the will.

The ruling by the Appeals Court yesterday was on an appeal by the daughters, made last summer. The court unanimously affirmed a decree by Surrogate Hugh V. N. Bodine admitting the will to probate.

Mr. Colby resided in Bemus Point at the time of his death.

Months of litigation followed after which the case was ordered transferred to Supreme Court.

In June 1952, Supreme Court Justice William H. Munsen overruled contestants to the will in Mayville and directed that it go to Surrogate Court for probate. The daughters appealed this motion and also a jury verdict upholding the will.

An earlier court action in April resulted in a mistrial ruling when Mrs. Deiafield was unable to appear as a witness because of illness.

The daughters contested the admission of the will, alleging in trials that Mrs. Colby had exerted undue influence on Mr. Colby and that he was not in fit mental condition to make a will at the time it was drawn.

When Bainbridge Colby, a former Secretary of State appointed by Woodrow Wilson, died April 11, 1950, he had been a resident of Bemus Point, Town of Ellery, for ten years.

Two large cartons and five wooden boxes of his papers had been delivered to the Library of Congress in 1955 by deed of gift from his widow, Anne Alstrand Colby. However, there were still six filing cabinets of his personal papers - including genealogical information, photographs, copies of citations and speeches - in his library.

When the Colby library was about to be dismantled, the six filing cabinets of his papers were brought to the Fenton Historical Society in Jamestown, N.Y. for protection and preservation. In the early months of 1977, the Fenton Historical Society, after making necessary inventories thereof, successfully transported the contents of these files to the Library of Congress.

Few people ever knew that at the termination of his presidency Woodrow Wilson was admitted to practice law in the State of new York, in partnership with Bainbridge Colby. Multiple copies of the order of the Appellate Division, First Department, dated June 29, 1921, were included in the files sent to the Library of Congress.

Barbara Colby Rooney, 83, died Wednesday morning, January 6, 2010, at the Hanover Hospital. She was the wife of Walter R. Rooney for 61 years. Born September 17, 1926, in Washington, DC, she was the daughter of the late Isaac Newton and Margaret (Hitchcock) Colby. Barbara was a graduate of Bethesda-Chevy Chase High School in Maryland and was a homemaker.

In addition to her husband, she is survived by three daughters, Mary M. Rich of Olney, MD, Beth A. Bohrer of Monson, ME and Katherine J. Rooney of McSherrystown, MD; three grandchildren; and three great-grandchildren.

She was predeceased by a brother, Lawrence Colby.

A funeral service was held at Little's Funeral Home, 34 Maple Ave., Littlestown, with the Rev. Timothy J. Kielley officiating.

Interment was at Gate of Heaven Cemetery, Silver Spring, MD, with Rev. Msgr. Robert G. Amey, of Saint Mary's Church, Rockville, MD, officiating.

WEYMOUTH, Mass. Barbara Louise (Colby) Roberts, 87, of Weymouth died on Thursday at the Quincy Medical Center. She was born in Tilton, N.H., and graduated from Tilton Academy on 1936. She subsequently graduated from the School of Domestic Science in Boston. Her food service work took her to Connecticut, Vermont, New Hampshire and New York. In Massachusetts she was employed by the Young Women's Christian Association in Cambridge. She later worked in the credit department of The Jordan Marsh Company at Boston. She was associated with Jordan Marsh for 35 years. She was an active member of the Union Congregational Church of Weymouth and Braintree where she was a member of the Women's Guild of the Church. She was also a member of the Red Hat Association, a ladies group. She enjoyed reading, knitting and playing cards.

She is survived by her husband, Harold E. Roberts, to whom she had been married for 60 years. She is survived by a sister, Lucille C. Spaulding, of Montpelier; a sister-in-law, Mary B. Colby, of Tilton, N.H.; a brother-in-law, Donald Roberts, of Montpelier. She is also survived by six nephews, three nieces, 10 grandnephews, seven grandnieces, 10 great-grandnephews and five great-grandnieces.

A memorial service will be held on Saturday, Oct. 22, at 2 p.m. at the Union Congregational Church, 74 Commercial St., East Braintree. Burial will be at the Massachusetts National Cemetery, Bourne. The Rev. Michael Robertson will officiate. Arrangements are by the Mortimer N. Peck ? Russell Peck Funeral Home, 516 Washington St., Braintree.

NEW LONDON, Conn., Dec. 21— Barnard Ledward Colby, retired publisher of The Day, a newspaper here, died on Monday at Lawrence and Memorial Hospital. He was 82.

He had colon cancer for three years, his family said.

His career with The Day spanned 58 years. Mr. Colby served as its editor and publisher from 1964 to 1976.

He wrote a Sunday column, "Say What You Mean," an assault on poor grammar, spelling errors and meager writing. He also wrote two books on language, "Say What You Mean," a collection of his columns, and "How to Write Like a Pro."

His first wife, Ruth, died in 1975.

He is survived by his second wife, Anne, and three children from his first marriage, Robert A. Colby of Guilford, Conn., David P. Colby of Norwich, Conn., and Dorothy C. Durham of Globe, Ariz.; a brother, Chester H. Colby of New London; a sister, Norma C. Darrow of Waterford, Conn., and two grandchildren.
