In Warner, Feb. 21, Mr. Levi Colby, aged 86.

The subject of this notice has been a man of sorrow ever since he arrived at the age of 67. Previous to that time he was in easy circumstances, with a pleasant family; but through the profligacy(??) of an ungrateful son, he became overwhelmed in debt, and was committed to the debtor's prison, in which place, during the winter of 1821, he was brought into a state of great suffering, and near the grave, and but for the kind interposition of a particular friend of his, a few tolling sans more would have closed his existence. But he was raised from this condition to suffer still greater trials, and more severe afflictions.

Being robbed of his property, and broken down with the infirmities of age, he was under the necessity of making application to the town for support during the remnant of of his days, which was exceedingly mortifying to an honest and upright man, who had been reduced to this by unforeseen events. It is hoped that above will prove a warning to parents not to put too much confidence in children, but to avail themselves of the means with which they are provided for support during their declining years.



Levi Colby was a brother to Hezekiah. He settled at the Fair Ground; and the railroad, when it came along, ploughed through his old cellar. Fred Myron Colby, the young writer of Warner, is a great-grandson of this Levi, being the son of Levi O., who is the son of Valentine, who is the son of Levi. Levi Colby, son of Valentine and Hannah (KIMBALL) COLBY was b. ca 1754 in Amesbury, Essex, MA [ColbyGen:147], and d. Aft. 1805 when his fathers will was probated [ColbyGen:669/StearnsNH Fam 4:1569]. Warner Census 1790 1-1-4. He was living in Warner, NH in 1805. In 1818 Levi and Valentine Colby of Warner bought Bradford land from the John Pierce Est. [HillsDeeds120:460]. Levi was of Bradford when he m. 21 Oct 1819 in Warner Hannah OSGOOD who was of Warner [M92:8:1WarnerHistSoc/TRVR92/dc/dau]. In 1819 Levi and Valentine Colby of Bradford sell land there to Daniel Sargent of Bradford [HillsDeeds129:635]. 1820 CenB son 26 - 45, he over 45, dau 16 - 26 and wife over 45. Levi Colby of Bradford, yeoman makes his mark on a deed of land to Benjamin Evans of Warner in 1821 with Levi Osgood witness [HillsDeeds131:43].

His war record, as copied from the New Hampshire Revolutionary Rolls in the Office of the Secretary of State, Concord, NH is as follows:

"Levi Colby, Private; Captain Joshua Bagley's Company; Colonel Thomas Stickney's Regiment; General Stark's Brigade; New Hampshire Militia, which company marched from Hopkinton, July, 1777 and joined the Northern Continental Army. Fought at Bennington, VT.

Enlisted September 26, 1777.

Roscoe Colby comments concerning Levi's activities after the War: "It was a custom of the times for a father to give his son a piece of land to clear and settle. This may have been how Levi came to own Lot No. 17 in the 5th Range in Henniker, NH. - later known as the Patten Place."

"A cart road from Levi's place went up to the top of Patten Hill, where it passed out of Levi's home lot. There was a pair of huge gateposts at this spot and they are still standing (1974). From that gate the cart road was fairly level to the Colby Hill Road, which it joined where the Colby Hill Road made a right angle. Down to the left of the road was a swampy meadow.

Levi "starved himself to death through fear of coming to want."

Levi built a house, positioned so that he would have a nice view down the valley and to the hills beyond the Contoocook River then built a barn where it shut off the view.

A second house was built on the property for Levi, Jr. This was later torn down and reassembled on the Nahum Colby farm and was called the "upper house".

Levi in later years signed his name as LT. Colby.

Dr. Levi Colby was born June 15, 1817, in Henniker, Merrimack County, N.H., where he grew up. He had the advantage of district school education and the entered the academy in his native town, taking his first course of lectures at Dartmouth College in 1838. He removed to 'Defiance in 1839, and prosecuted his studies with his brother, Dr. Jonas Colby, and in the winter of 1840 and 1841, attended the Ohio Medical College at Cincinnati. He commenced the practice of medicine in the spring of 1841 at Defiance, as partner with brother Jonas. He was married at Defiance, June 7, 1843, to Miss Harriet R. Phelps, who was born in Richville, St. Lawrence County, N. Y., and daughter of James and Dorotha (Snow) Phelps. Their children are Edwin B., born October 24, 1850, at Montpelier, Williams County, Ohio, dead; George C., born at Independence, Defiance County, July 29, 1853, dead; Frances J;, born Setpember 17, 1856, on farm, and married Loren S. Durfey and resides on a portion of the farm; Hattie M., born on farm, May 27, 1860, married Franklin Bernard and living with the old folks Colby at home; and Willis, born December, 1862, dead. Levi Colby Sr., and Betsey (Clark) Colby, parents of Dr. Colby, were the parents of nine children---Sally, Jonas, Barak, Mary, Catherine, Benjamin and Levi Jr., twins, Lucinda and Abigail. Four boys and four girls grew up and married. The oldest, Sally, died at the age of about fifteen. Joseph, Mary and Catherine have sinced died. The grandfather of Dr. Colby was in the Revoluntionary War, and the father of our subject, Levi, Sr., was sent a substitute in the war of 1812. Mrs. Colby's father, James Phelps, was in the war of 1812 also. Mr. Colby has been a prominent and active man since he came to this county, having lived in this county (except for breif intervals spent in adjoining counties of Williams and Paulding) ever sine he came in 1839. At an early day, and soon after his arrival, we find him associated with the School Board as Clerk also Corporation Clerk, etc., and he has generally been in township offices all through his life. He is now serving this county as County Commissioner, having been elected in 1879 and re-elected in 1882. He was the first clerk pro tem. of Williams County as it now stands, having received his appointment by President Judge Patrick G. Good and his associates. He was Deputy under Edwin Phelps, in Williams prior to organization of Defiance County in 1845, and Representative of Paulding and Defiance Counties in the Legislature, being elected in the fall of 1869 and re-elected in 1871, receiving the nomination by acclamation.
