Mary Dustin DURRELL 25 Aug 1847, daughter of Nicholas and Mary (BATCHELDER) DURRELL [NHVR], they both resided in Manchester at the time. She was b. 20 Apr 1823 [NEGHR133:282] and d. 16 Apr 1905 [GS] in Mitchell, MT [NEGHR133:282]. Levi's was a farmer and a well respected contributing member of the community. One wonders how his cause of death became suicide by hanging [NHVR]. Levi and Mary are buried in the New Cemetery on Main St in Warner. A Levi appears in the Warner Census for 1850 Page # 167.

The L. S. Colby $20,000 Damage case on Trial

After hearing a number of motions this morning, the slander case from Macon was called up for trial.

Wants $20,000

It is the case of Mrs. Clara McGee vs. Lewis S. Colby, a farmer living near Macon, the owner of 600 acres of land. The plaintiff places damages at $20,000, alleging that the defendant has slandered her character by declaring that she has been guilty of adultery. Her attorneys are Senator W.C. Johns and I.A. Buckingham and Cyrus Randolph. The counsel for the defense are the Mills Bros. The case is on trial by Jury.

Judge Vail resumed court this afternoon and after making a number of entries called up the slander case of Mrs. Clara E. McGee of Macon, vs. L.S. Colby, an action in trespass, claiming damages for slander on the part of Mr. Colby. There have been two long drawn out trials on the case. The first time the jury disagreed. At the second trial, the jury gave the plaintiff $1,250, but the defendant's motion for a new trial was allowed, and now the case comes up for a new trial. All parties were ready to proceed and the work of selecting a jury began at 10:15 a.m. The attorneys for Mrs. McGee are Buckingham and Shroll and Johns and Randolph. The defendant is represented by Mills Bros. and Mills and Hon. Horace S. Clark of Mattoon. Every point in the case will be closely contested.

The McGee-Colby Slander Case

The McGee-Colby slander case, wherein Mrs. Carrie E. McGee, wife of Albert McGee, residing at Macon, sued C.S. Colby, formerly of Macon, now living in Decatur, for slander, claiming $5,000 damages, has at last reach a final conclusion. The result of the first trial was a disagreement of the jury. The second trial resulted in a verdict for the plaintiff, the jury assessing damages at $1250. On the ground of some defect in the evidence, a new trial was granted. In the last trial Buckingham and Shroll and Johns and Randolph appeared for the plaintiff, and Mills Bros. and Clark for the defendant.

The case was well tried as all the attorneys are prominent in their profession After the evidence was all in the Judge limited the attorneys in their arguments to one and a half hours for each side. The case went to the jury yesterday evening. Judge Vail instructed the jury to bring in a sealed verdict, and having done so, they would be at liberty to go home until the court again convened, which it would not do until Monday afternoon. The jury repaired to their room and wrestled with the case until 4 o'clock this morning, when they reached a verdict, which they sealed and handed in as directed by the court. It is, of course, not known positively, what the verdict is, but from some pointers a representative of the REPUBLICAN got, it is safe to say that the verdict is for the plaintiff, fixing the damages at about $500.


Thus, it is supposed by those who ought to know, will be the end of this case.

Lewis T. Colby attended the Canaan Academy, and then spent some two years at painting, after which he returned home and took charge of his father's farm, and has remained there ever since, easing and making happy his parents' last hours. He formerly kept a large dairy and raised a quantity of sheep, but now he only keeps a small dairy, and is interested very much in poultry. He has one of the largest yards of poultry in the town, keeping upwards of 600 choice hens and raises some 600 to 1,200 fowls a year. He has a standard and special trade in eggs at the Boston markets. He is a Democrat and loyal supporter of Democratic principles. He is a member of the M. E. Church, and of the Grange.

The first of all the brides of Brooklyn society who will take up housekeeping in one of the new American colonies was wedded last night -- Miss Lilla Colby, formerly of President street, now of 317 Sixth avenue, daughter of Mr. and Mrs. Arthur Colby. Miss Colby married Lewis Leonard Cantor, who is the son of Lewis Cantor of 254 Garfield place, and who has been living in Havana, Cuba, for a year or so. On April 27 Mr. and Mrs. Cantor will sail for Havana on the Morro Castle and will make their new home at Aguila 60 of that city.

This ceremony was solemnized in the South Congregational Church, South Brooklyn, the Rev. A. J. Lyman officiating. There was no reception, a supper for the bridal party and relatives following at the bride's home. The church was decorated with palms and azaleas. Miss Blanche Cantor, the bride groom's sister, was maid of honor. She wore white point d'esprit over pink. The brides maids, Miss May Pierce of Philadelphia and Miss Gertrude Colby, had frocks of pindcrepe de chine and carried bridal roses. The bride herself wore white crepe de chine with tulle vail and orange blossoms and carrie lilies of the valley with white roses.

Mrs. Lewis Cantor was in black brocade crepe de chine over white with duchess lace and Mrs. Arthur Colby in gray crepe de chine.

Mr. Cantor's attendants were George Millner, best man, and William Mercer Steele, Dr. Frederick Bornmann, Arthur Colby, Jr. all of Brooklyn and W. Rand Jones of Hackensack, ushers.
