The Last Will and Testament of Stephen Sawyer of Newbury 1663-1753

In the name of God Amen I Stephen Sawyer of Newbury in the County of Essex in the Province of Massachusetts Bay in New England Yeoman, being in Health of body, and of good & Perfect memory, and being sensible that it is appointed for all men to once die. Do make and ordain this to be my last will and testament, that is to say that I bequeath my soul & spirit into the hands of the almighty God, and my body to the Earth to be buried in hope of a joyful Resurection, and touching the distribution of my estate I dispose thereof in the following manner viz;

First I will that all my just debts due to any persons shall be truly paid by my
executors.-----------------------------------------

Second I give to my son Stephen Sawyer and his heirs and assigns forever all my farm in Newbury aforesaid where he now dwells containing about twenty five acres my lott rate at Indian Hill (so called) I give him also three acres of pasture land in my lott in the Owl Swamp pasture that is, three acres according to the grant, but I give him none of the wood------- on the said three acres----------------------------------------------------------------

Also I give to my son Enoch Sawyer & Daniel Sawyer all my homestead containing about twenty five acres. That is to say to my son Enoch & to his heirs and assigns forever.
I give the Northeast part thereof which adjoins to the Country Road with all the buildings thereon to be seventeen rod in breadth at the southeasterly end near Josiah Pillsbury's land and bounding northeasterly by the lane from the Country Road until it comes, to an apple tree, which is on the westerly side of a large Oyl nutt tree which is the corner boundary------ and to my son Daniel Sawyer and to his heirs and assigns forever I give all the remainder of that said homestead with all the buildings thereon--------------------------------------------------------

Also I give to my son Daniel Sawyer and to his heirs and assigns forever my lott of marsh at Jericho (so called) bounding upon Plummer------------------------------------------------------------

Also I give to my son Enoch Sawyer and to his heirs and assigns forever my piece of marsh called the five acres in Newbury aforesaid, adjoining to the meadow of Stephen & Moses Noyes, formerly Justice Roger's and to the meadow formerly belonging to Joseph Woodbridge Esq.------ I give him also my great brass kettle--------------------------------------------

Also I give to my son Daniel Sawyer & Enoch Sawyer and to their heirs and assigns forever all of residue lands (not particularly before mentioned in this my will to be given away) whatever or wherever of same may be to be equally divided between them (excepting my upper wood lott by Ezekiel Goodridge's in estimation about fourteen acres all the land & soil of which lott with three quarters of the wood on said lott, I give to my son Daniel Sawyer and his heirs and assigns forever, and the other quarter part of upwood on sd lott I give to my son Enoch Sawyer & to his heirs and assigns forever, with liberty to let of same wood stand there or cutt & carry of ye same, as they or he may please, and liberty of passing on same lott to cutt & carry of this quarter part of the wood as there may be occasion. -------------------------------------------------------

Also I give to my said sons Daniel & Enoch all my utensils for husbandry to be equally divided between them, Also: I give them all the wood (o be equally divided between them) which is upon the three acres of pasture, which in this will I have given to my son Stephen., with liberty of passing on said three acres to cutt & carry of the wood as there may be occasion and liberty of letting of same stated while they please.

Also I will that my Negro women Jenny serve with my daughr Eliza Collins. Three years from and after my decease, and be during that time at my sd daughters command and that after the said three years are expired. I will that said Negro Jenny shall have her liberty to live with either of my children which shee pleases, or otherwise that shee be quite free, if she pleases, and at full liberty to dispose of herself, Provided yet nevertheless that in disposing of herself it shall be by ye advice & approbation of my three sons Daniel, Stephen & Enoch, or two of them at least-------

Also I give and bequeath to my daughter Anna Peaslee and Eliz Collins all my live stock of creatures and all my household goods and personal estate not before disposed of to be equally divided between them.

And finally I do hereby appoint my sons Daniel & Enoch Sawyer to be the executors of this my Last Will and Testament, Renouncing all other wills by me heretofore made, and ratifying this and no other to be my last will and testament, in witness whereof I have heretofore sett my hand and seal this twentieth day of February Anno Domini 1753 signed sealed published and declared by sd Stephen Sawyer to be his last will and testament: in presence of my witnesses-------
