Pool, Administrator of the Estate of William Curlee Deceased, respectfully represent that about ten months hace elapsed since he was appointed by this Court to said Administration, and that from the and character of the claims already presented to him, and from his intimate knowledge of the indebtedness of the Estate he is satisfied that said Estate is entirely solvent. Your Petitioner further represents that the heirs of said decedent are as follows to wit; Catherine Pool, now the wife of your Petitioner, Jackson Curlee, Pinkney Curlee, William T. Curlee - all of whom are of full age and all living in Elmore County, Alabama, A Catharine Cardin, wife of William Cardin, and Sicily Howard, both of full age, and also Mary Jane Rast, also of full age; the three last named persons being daughters of Floyd Curlee, who was the son and lawful heir of decedent, all the aforesaid named persons being residents of the aforesaid State and County, except Mary Jane Rast, who resides in Falls County Texas, and her husband is Marcus Rast, residing at same place, and also Franklin Curlee, a resident of the County of Coosa, and state aforesaid, and of full age, and Randolph Curlee, of full age and living in Jackson Parish in the State of Louisiana, also William James Curlee, Julia Curlee, and Washington Curlee all of full age, children of Washington Curlee who was the son and lawful heir of the deceased, and all residents of Coosa County, Alabama. Your Petitioner further states that the lands of said Estate consists as follows; SE 1/4 of Sec 12, T20. R18, South 1/2 of SE 1/4 of Sec 1, T20, R18, SW 1/4 of Sec 6, T20 R19 except 40 acres across the East end - NW 1/4 of SE 1/4 of Sec 18, T20 R19, NE 1/2 of NW 1/4 of Sec 14, T20 R19, N 1/2 of Sec 7, T20 R19 - all lying in Elmore County, Alabama, which parcels of lands are of unequal values and are so situated, and are of such dimensions, respectively that they cannot be equitably divided among said heirs aforesaid; your Petitioner there= fore states that he believes that the interests of all persons concerned in said lands, will be best promoted by a sale thereof, and a distribution of the proceeds among said heirs, according to their several rights; Wherefore your Petitioner prays your Honor, to authorize him to sell said lands for Cash, for the purpose of making a division of said Estate among said heirs aforesaid, according to the statute in such cases made, and that such proceeding, orders and decrees may be had and made in the premises, as may be sufficient to effect such sale, for said purpose according to law. Pool respectfully shows unto your Honor, that more than Eighteen months have elapsed since he was appointed and qualified in this Court as Administrator of the Estate of William Curlee Deceased, during all of which time heas diligently, and to the best of his abilities administered in and upon the affairs of said Estate - Your Petitioner further states that within one month after said letters were granted to him, he gave notice of his said appoint- ment by publication there of for Six successive weeks in the Ala- bama State Journal, a Newspaper published in the City of Mont- gomery, Ala (It being the Official paper for Elmore County) and it being the paper published nearest to the Court House of this County, there being no paper published in this County, a copy of which said notice, as published, is herewith Exhibited and filed together with the affidavit of the publisher of said paper showing when said publication was first made, and the length of time it was contin= ued; Your Petitioner further shows unto your Honor, that in his opinion Said Estate no longer requires the continuance of an Administra tion, wherefore, he now herewith files his accounts for a final Settle- ment thereof, Showing all the amounts with which he is firstly charge- able, and the payments which he is entitled to have allowed to him together with his vouchers, each duly numbered and all other written evidences which he has, in support of said account, Your Petitioner also, further states that there is nothing left to divide between the heirs of said Estate as is Evidenced by his former Statement and present accounts presented for such final Settlement; Your Petitioner further states, that he has not at any time during his said Administration, (Except as accounted for at his last annual Settlement made with this Court - dates therein stated.) used any of the funds belonging to said Estate; Your Petitioner, therefore, prays your Honor that a day may be set for making such final Settlement; that notice of the same may be given and published as is required by law, and that said Schedules and said accounts, vouch= ers &c have been duly credited, Examined and Considered.
