In the name of god Amen I John Byrd of Catherton in the parishe of Cleobury Mortymer, in the dyocesse of Herefford yeoman, the unproffitable servant of Alighty God, perceaveing greate Sicknesse to trowble me, Although in good and perfette memory, the Lordes name be praysed. And being glad and willinge to Abyde the good pleasure of my Lord and Saviour Jesus Christ, by whose precious Bloud sheeding I hope and trust to be saved, Doe herein make my Testament contayneinge my last will wherein I bequeath and Comend my Soule to the mercyfull handes of my maker and redeemer Jesus Christ. And my body to be buried in the Church of Cleobury Mortymer at the election of my frendes
Item Imprimis I geve and bequeath to be Dooled and geven to the poore at my funerall at the Discrecion of my frendes forty shillinges Item I geve and bequeath unto my sonne John Byrd the whole some of Three score and tenne Powndes of Currant English money to be payd to his owne proper use and behoofe And further, my trew meaninge Will and mynd ys, That my Brother William Byrd within one yeare next After my Decease into his Custody and Discrecion as a frend for me in trust, the foresaid some of �lxx shall receve as my said sonne John Byrd whole porcion with him alsoes, And trust that my said brother William Byrd Doe meyneteyne and kepe him the said Byrd, with sufficient meate, Drinke and lodgins and Apparrell with the increasse, use and Comodiitye of his foresaid porcion or stocke, And to kepe him at Schole contynually or some other, or better ecxercisse to the Contentment of my said sonne, And his frendes whom by this my last will & testament I doe ordayne & apoynt my brothers Robert Byrd and Thomas Byrd to be my Overseears to see my Sonne John Byrd well dealt with And to be meynteyned according to my trew meaneing, And also to have the uttermost Comodity to be raysed and made of his foresaid porcion or stockes, And that my said brother William Byrd or his executours Administratours or Assignes shall and doe repaye unto my foresaid Sonne John Byrd the foresaid whole some of �lxx, yf none thereof be spent, or any parte of the whole some Deminished, by oversight in kepeing him the said John Byrd at schoole, And the same payment as Aforesaid to be made, when the said John Byrd doth accomplishe the Age of twenty and on yeres yf the said John Byrd happen to lyve soe longe, And yf it happen that my said sonne Doe not lyve and accomplish the foresaid age of xxjty yeares, Then my will, intent and trew meaneing is, that the whole porcion or stock before bequeathed unto my Sonne John Byrd according to trew meaneing, shall remayne and come to any other Children by even and equall porcions, with the use & Comoditye therof, or to the Survivor of them, the same to be payd when George Byrd my Sonne Doth or shall accomplishe the full age of twenty and one yeares, And my daughter Dina Byrd the Age of Sixteene, and yf it happen that either of my Cheldren George Byrd or Dina Byrd the Age of Sixteene, And yf it happen that either of my Cheldren George Byrd or Dina Byrd to depart this Transitory lyef, before they, or eyther Doe accomplishe the ages aforesaid, that then the survivor to have the whole foresaid some according to my trew meaneinge,
Item I also geve and bequeath unto my Second sonne George Byrd the whole some of Twenty powndes of Currant English money, to be payd to the said George Byrd my sonne when he shall and Doth accomplishe the age of one and twenty yeares yf he doe soe longe lyve
Item furthermore I doe geve and bequeath unto my Daughter Dina Byrd the whole and entyre Some of Thirty powndes of Corrant English money, to be payd unto her when she shall and doth accomplishe the full age of Sixteene yeares, And also she to have one featherbedd with all appurtenances therunto belongeinge, when she doth accomplishe the age aforesaid And further my meaneinge, will and mynd is that yf eyther of my Cheldren Georg Byrd or Dina Byrd doe happen to Departe this transytory lyef, before eyhter of them Doe accomplishe the ages lymetted for the receipt of their porcions, that then the Survivors have the whole some or porcions before bequeathed according to trew meaneing
Item now lastly I geve and bequeath all other the rest of my goodes Cattell and Chattelles whatsoever, or whersoever unbequeathed, togeather with all my Debtes eyther dew by speciallty or without, All corne or grayne with all other Comoditys whatsoever, that in Right eyther is dew, or ought to arise or grow out of the prmisses unto my wyef Mary Byrd, whom I doe appoynt ordayne and make my Sole and whole Executrix, to pay and Discharge all my Debtes funarall expences And all other Leagusyes or paymentes whatsoever according to my trew meaneinge, for this my last will In wittnesse wherof I have caused this same to be read the ixth day of June and hereunto doe put my hand and Seale the day an yeare first above written
