The Last Will and Testament of Mrs. Phebe Locke (Rice) Edgerton (Sussex
County Book of Wills, Volume L, Folio #450)
I Phebe L. Edgerton of the town of Newton Sussex County New Jersey being of sound and disposing mind and memory and understanding do make and publish this my last will and testament. It is my will and I do order and direct that all my just debts, funeral expenses and legitimate charges attending the administration of my estate, be duly paid and satisfied as soon as conveniently can be after my decease. I give devise and bequeath unto my children, Justin A. Edgerton, Sarah C. Pool (wife of Joseph Pool), John L. Edgerton, Byram C. Edgerton, Lydia Almira Andress (wife of Joseph C. Andress), Charles C. Edgerton, William A. Edgerton and Eli F. Edgerton and to the survivor or survivors of them, all of my estate, real personal and mixed of every kind and wheresoever situate, of which I may die seized or lie entitled to at my decease, to be divided between them share and share alike, it being my will that in case any of my children should die before my decease that the portion therein devised or bequeathed to such child or children shall be equally divided between the remainder of my said children share and share alike. I hereby appoint my son John L. Edgerton and my daughter Sarah C. Pool executors of this my last will. It is my will and I do order and direct my said executors or the survivor of them to see and dispose of all my estate of every kind and nature whatsoever as soon as it can conveniently be done for the best price they can obtain – and to divide & pay the proceeds of such sale or sales to my said children or the survivors of them as hereinbefore directed, share and share alike. And for that purpose I do hereby authorize and empower my said executors or the survivor of them to execute deeds of conveyance – quit claims – transfers – bills of sale, acquaintances agreements or any other necessary instruments for the purpose of carrying out the provisions and directions of this my last will – made this eleventh day of July Eighteen hundred and ninety nine. Phebe L. Edgerton Signed, published, and declared, by the said Phebe L. Edgerton to be her last will in the presence of use, who were present at the same time, and subscribed our names as witnesses in the presence of the testator and at her request. Howard Little Robert T. Johnson Probate: Sussex County, SS. Howard Little one of the witnesses to the annexed writing, purporting to be the last Will and Testament of Phebe L. Edgerton the Testatrix therein named, deceased, being duly sworn doth depose and say, that he saw the said Testatrix sign and seal the said annexed writing, and heard her publish and declare the same as and for her last Will and Testament; that at the time of the doing thereof, the said Testatrix was of sound disposing mind, memory and understanding, as far as this deponent knows, and as he verily believes, that Robert T. Johnson the other subscribing witness thereto, was present at the same time with this deponent, and together with him subscribed his name thereto as witnesses, in the presence of the Testatrix and of each other, and at the request of the Testatrix and that the said Testatrix departed this life on the Twenty-second day of November 1899, according to the best of this deponent’s information and belief. Howard Little Sworn and subscribed at Newton this 5th day of December A.D. 1899 before me Jacob M. Demarest Surrogate Sussex County, SS. Sarah C. Poole and John L. Edgerton the Executors in the annexed writing, being duly sworn do depose and say, that the said annexed writing contains the true last Will and Testament of Phebe L. Edgerton the Testatrix therein named, deceased, as far as they know, and as they verily believe, that they will, as the Executors thereof, well and truly perform the same, first by paying the debts of said deceased, and then the legacies therein specified, as far as the Goods, Chattels and Credits of said deceased will thereunto extend, and the law charges; that they will make and exhibit into the Surrogate’s Office of the County of Sussex, a true and perfect inventory of all and singular the said Goods, Chattels and Credits, as far as the same have or shall come to their possession or knowledge, or to the possession or any other person or persons to their use to their knowledge; and that they will well and truly account when thereunto lawfully required.
