Final Pension Payment


11 March 1839

The act under which Edward Walker obtained a pension provided that his widow or orphan could receive the amount due to the date of death. His widow, Jane, apparently was in no hurry for the money since the final payment was payable six months earlier. She appears before the County Court to prove that she is his widow and gives power of attorney to a local attorney, Newton A. Evans, to collect the final amount. She also had to return his pension certificate, which still exists in the files. These records are not in Edward's pension file but in the Final Payment records at the National Archives. Several pages are included and have not been microfilmed; the original records were examined and photocopied, and copies can presumably be obtained by mail from the Archives as well.

I certify that, in conformity with the law of the United States of the 7th June, 1832, Edward Walker of the State of [“East” crossed out] Tennessee who as a private in the Army of the United States is entitled to receive Forty dollars and --- [“cents” crossed out”] per annum, during his natural life commencing on the 4th of March, 1831, and payable semi-annually on the 4th of March and 4th of September every year.

Given at the War Office of the United States this 18th day of October one thousand eight hundred and thirty three

Be it known that before me, Benjamin Sewell a Justice of the peace in and for said county personally appeared Jane Walker and made oath in due form of law, that She is the widow of Edward Walker the identical person who was a pensioner and is now dead and to whom a certificate of pension was issued of which the following is a true copy.

At a county court began and held for the county of Claiborne at the court house in Tazewell on the first day of October 1838, the following proceedings were held. Jane Walker the widow and relic of Edward Walker deceased, proved in open court by the Oaths of Peter Niel, and Jonathan Walker, who were duly qualified that Edward Walker was dead and that he departed this life on the 26th day of August 1838. And that he is the same identical Walker, who drew a pension upon a pension certificate of no. 22265, Given at the War office of the United States 18th day of October 1833. And that the sd Edward Walker, left the said Jane Walker his widow.

I, William Niel Clerk of county court of said county do certify that the foregoing proceedings of the county court of Claiborne county is a true copy of the record in my office in testimony whereof I have here unto set my hand and affixed my Public Seal of office at office in Tazewell

Know all men by these presents that I, Jane Walker of Claiborne County and State of Tennessee widow and relic of Edward Walker deceased late a Pensioner of the United States do hereby constitute and appoint Newton A Evans my true and lawful attorney for me and in my name to receive from the agent of the United States paying pensions at Knoxville in East Tennessee the arrearages of pension which were due to the said Edward Walker from the 4th of March 1838 up to the 26th day of August 1838, the time of his death and which is now due to me under the laws of the United States. Witness my hand and seal, March 11th day 1839
