Arkansas Pea Ridge Park Group Seeks Condemnation of Approximately 299 Acres.

ROGERS, Ark., Feb. 25 -- The Arkansas Pea Ridge Park Commission has filed four sits in Benton county circuit court seeking condemnation of approximately 299 acres to be included in the Pea Ridge National Park. Three of the suits involve tracts owned by members of the Scott family, upon which the historic Elkhorn tavern is located. The fourth suit is against F. C. Cox and Hattie J. Wood, whose 80 acres have been appraised at $11,140. Another suit is pending in circuit court in which the park commission is seeking condemnation of approximately 800 acres of land owned by R. C. Hoobs of St. Louis, Mo., a former resident of Benton county. Attorneys for the defendants in the first of the newest actions have filed a demurrer in which the jurisdiction of the court in the matter is questioned. The demurrer contents that the court has no jurisdiction over the parties or the subect of their action and asks that the suit be dismissed. The demurrer also states that the complaint shows on its face that the real part in interest, the United States, is not a party plaintiff, and finally that act 192 of the Arkansas legislature of 1957, and public law 744 of the Eighty-fourth congress, being the basis of the action, is in violation of amendments 5 and 14 of the United States constitution. Several hundered acres of the required land have been acquired, including the Winton farm, famous for the large springs, which was the site of a battle during the Civil War. The Winton farm also is the scene of the camp in Arkansas of the Cherokee Indians on the "Trail of Tears" journey, from their homes in George to Indian Territory.
