LAST WILL AND TESTAMENT
JACOB FOULKROD
April 13, 1844
I, Jacob Foulkrod of Oxford Township in the County of Philadelphia and State of Pennsylvania, Yeoman, being of sound disposing mind, memory, and understanding, do make this my last Will and Testament, revoking all former Wills made by me.
I desire all my just debts and funeral expenses be paid by my Executors, hereinafter named, out of my estate.
I give and bequeath unto my dear and beloved wife Mary, all the residue of my estate after my just debts and funeral expenses are paid, both real and personal, also all the rents, income, household and kitchen furniture, during her natural life, for her free use and benefit; and after her decease, the residue which she may leave, be the same more or less, to be equally divided among my four children hereinafter named, excepting a legacy to my youngest son Jacob B. Foulkrod; the sum of Five Hundred Dollars to be paid out of my Estate, after the decease of my said wife Mary; more than either of my other children, as a compensation for his services rendered to me during my natural life.
I give and bequeath unto my four children to wit: John, Sarah, Isaac, and Jacob B. Foulkrod; all the residue of my estate, both real and personal, after the decease of my said wife Mary; and the above legacy is paid to my youngest son Jacob B. Foulkrod, to be valued and appraised, equally divided amongst them part and share alike; giving to my youngest son Jacob B. Foulkrod his first choice.
That portion of land lying west of the Oxford Road and extending to Second Street Road, with all the buildings and improvements thereon erected, containing about twenty-seven acres, be the same more or less, I desire to be considered as one tract.
That portion of land remaining and lying east of the Oxford Road and extending to land recently belonging to Samuel Castor. I desire may be divided in three equal parts or tracts; of as near an equal quality and quantity as my Executors can make it; reserving a road or lane thirty feet wide to each tract as a passage to and from the Oxford Road.
I also desire and Will that all my heirs, which have book accounts with me that are unsettled be required to settle the same after my death, and the amounts due me from each and every one be deducted from their portion of my Estate.
If my son John Foulkrod should fail or neglect to pay the sum of Six Hundred Dollars and the interest arising from the same, on an obligation given to William Overington, before my decease; I desire and Will that the amount of said obligation may be deducted from his portion of my Estate for the said Six Hundred Dollars was for his sole use and benefit.
If my son Isaac Foulkrod should fail or neglect to pay two obligations which I hold against him, one for One Hundred Dollars, & the other for Three Hundred Dollars, with the interest arising on said obligations, before my decease; I desire and Will then that the said amount of Principal and Interest, on said obligations, may be deducted from his portion of my Estate.
I do nominate and appoint my son Jacob B. Foulkrod and son in law John Cuckle, Executors of this my last Will and Testament, hereby revoking all other wills and bequests by me heretofore made. Witness my hand and seal this thirteenth day of April Anno Domini One Thousand Eight hundred and fourty four.
