We have not seen the actual document but we copied a transcribed version from a Northumberland book and spelling and symbols were retained. This is the first record we have found of Richard in the Colonies.

Richard Cundiff, Selling Land

Virginia Northern Neck Land Grants 1694-1742 Volume I, Book B, Page 98

Colonel William Ball of Lancaster Co. 6 Mar 1728/1729 set forth that John Brown formerly of Northumberland now Lancaster Co. died seized of 50 Acres in said County. Inquisition 14 March 1728/1729 by George Eskridge Eschr. And 12 freeholders to wit: John Whale & Verdict: John Brown died seized of 50 Acres purchased of Richard Cundiff, December 10, 1681. Brown was no alien, left no heir, nor made disposition. Escheat Grant to Ball adj. Richard Cundiff, William Theriats, Thomas Banks. May 30, 1729.

Richard Cundiff's, Indentured Servant

21 March 1687/8. Wheras Mary Stephens servt. to Richard Cundiffe hath had a bastard Child in the time of her service, it's ordered that she serve her said master for her said default according to Act, and that the Sherriffe take her into his Custody and give her fifteen Lashes on her bare back to be Well Layd on.


Richard Cundiff, Bounty for Wolf

Northumberland County Virginia Order Book 1678-1698, Page 531

At the November, 1690 session of the Northumberland Court, Richard Cundiff received a bounty for killing a wolf.

Wolves were such a nuisance to planters in early Northumberland County that the authorities offered a bounty for each wolf killed. The wolves were about the size of a coyote.

Margaret Lady Culpepper, Thomas Lord Fairfax 'e' To all 'e'

Whereas 'e' Know ye therefore, that we for and in consideration of the composition, do give and grant unto Richard Cundeffe of Northumberland County two hundred sixty seven and a half acres of land bounded as followeth /viz/ beginning at a small marked red oak standing in Edmond Basey's line near the head of a swamp, and running from thence by or nigh the said line North eighty seven degrees West two hundred and sixty four poles to a marked red oak corner tree, then South fourteen degrees West twenty one poles to a marked Corner White oak in Mr. William Theritt's line, thence South forty seven degrees East along the said line three hundred and twenty poles to a corner red oak in the said line near the head of a branch, thence down the said branch East do several Courses ninety four poles to a marked red oak standing upon a point in a fork of the said branch, thence along the first mentioned Swamp its several courses betwixt the North and West points two hundred and forty four poles to the beginning tree, containing and being now laid out for two hundred sixty seven and ahalf acres of Land 'e' Together 'e' Royall mines Excepted 'e' To have and to hold 'e' yeilding and paying six Shillings yearly 'e' provided 'e' dated the twenty sixth day of September one thousand six hundred and ninty five.

The following is a layout of the land description granted Richard Cundiff in Northumberland. We had a CAD program to create the layout and then used it to calculate the area. The description closed and the acreage was almost identical to the 267 & 1/2 acres. We have been unable to determine the exact location in Northumberland.

Gift of Land to Son, Richard Cundiff Jr.

"Northumberland County Order Book 1678-1698" Page #841 November 16, 1698

Richard Cundiff having this day acknowledged a deed of gift to his son Richard Cundiff for a parcel of land. This parcel is admitted for record.

The occasion for this gift may have been Richard Jr.'s marriage. The age of his children appear to be in close agreement with this date. We have been unable to find a description of this land transaction.


Will of Richard Cundiff the Immigrant (Abt 1638-1723)

In the Name of God Amen, I Richard Cundiff Senior of the County of Northumberland in Virginia, Planter, being very aged and feeble and not knowing how long it may please God to lend one life in this transitory world, do make ordain and appoint this to be my Last Will and Testament.

Imprimis I give and bequeath my Soul to God my maker who gave it me and do hope through the merits of my Blessed Redeemer and Saviour Jesus Christ thereby to be saved and to enjoy eternal happiness, afterwards my body to be decently buried and for what personal estate it hath pleased God to lend me, I give and bequeath in manner and form following sealed.

I give and bequeath unto my daughter Elase Conery a parcel of land beginning and bounded as followeth; beginning at a marked red oak standing near the Mill Road on the head of a branch called the Tobacco House Branch, from thence down the said branch to Thomas Taylor his line, from thence up another branch to Captain Richard Ball his line, and from thence along the said line to the Mill Road again, it be to my daughter Elace Conery and her heirs forever.

Ditto I give unto my grandson Richard Cundiff another parcel of land beginning and bounded as followeth; beginning at a marked red oak standing near the Mill Road and from thence down the next branch to Capt. Ball his line, thence along the said line to the Mill Road and along the Mill Road to the red oak where it first begun, it be to him and his heirs forever.

Ditto I give and bequeath unto my son Richard Cundiff all the residue and remainder of my land and it be to him and his heirs forever, and for what moveable estate I have, I give as followeth; I give unto my grandson Isaac Cundiff my musket, and all the rest of my movable estate I Will and Desire that it be equally divided between my son Richard and my daughter Elase, and lastly I ordain and appoint my son Richard and my daughter Elase to be my whole and Sole Executors of this my Last Will and Testament and to disannul all will or wills that shall be from the beginning of the world to this day, as witness my Hand and Seal this 28th of February 1712/13.

This will was proved in Northumberland County Court to be the Last Will and Testament of Richard Cundiff Senior, deceased, being proved by this oath of Benjamin Brown and Mary Chelton and is admitted to Record.

Upon the motion of Richard Cundiff Junr and Allice Condree Execrs of the last Will and Testament of Richd Cundiff Decd: Thomas Pittman, John Chilton, Isaac Basie and John Basie are appointed to meet sometime before the next Court (being first Sworn by the next Justices) and appraise the said Decds. Estate in money and Ordered that the Execrs:as aforesaid Exhibitt an Inventory thereof upon Oath to the next Court

The last Will and Testament of Richd Cundiff decd:was presented to the Court by Richd Cundiff Junr and Allice Condree Execs of the said decd: being proved by the Oaths of Benjamin Brown, Mary Cilton Witnesses thereto and on the said Richd Cundiff Jr and Alice Condrees motion and giving Security for their Just and faithfull Administration. Certificate is granted them for Obtaining a Probatt thereof in due form.

At a court held for Northumberland County March 18th 1723/1724 it was ordered that Thomas Pitman, John Chilton, Isaac Bayse & John Bayse or any three of them should appraise the estate of Richard Cundiff decd & return an inventory of the same to the next Court in obedience whereunto we whose names are underwritten have met & valued the same and inventory thereof followeth Viz

The are three are four dozen items listed in the inventory. Items include Large table, 3 wooden chairs, iron spit, spade, hand saw, old grubbing hoe, old ??? ax, hat brush, old smoothing iron, old hammer, old lantern, branding iron, old iron pot hooks, small stone mug, earthen mug, drinking glass, 5#? of very old feathers, old rug, small chest lock and key, old couch, old bread tray, large chest lock and key, set of iron wedges, 2 small earthen cups, small brass candlesticks, old frying pan, stone bottle, old pots & hooks, old washing tub, 2 old rugs, bedsted old wearing clothes, and 1 cow. There were other items but the entries were difficult to read.
