Northumberland County, Virginia Record Book 1718-1726, Page 406 Will Written 1 Jan 1724 - Will Probated 20 Jul 1726; FHL Film 0032639

In the Name of God Amen, I Richard Cundiff the First day of January in the year of our Lord 1724, being very well in health and memory thanks be to God for it, and calling to mind the mortality of my body and knowing that its appointed to all men once to die, do make and ordain this my last Will and Testament

That is to say principally and first of all, I give and recommend my Soul into the hands of God that gave it and my body I recommend it to the earth to be buried in a Christian like manner at the discretion of my executors.

Nothing doubting, but at the General Resurrection I shall receive the same again by the mighty power of God, and touching such worldly estate wherewith it hath pleased God to bless me with in this life, I give, devise and dispose of the same in the following manner and form.

Imprimis I give and begave to my dearly beloved wife all my household goods and stock to her whole disposal till she marries, and when she marries or dies, what she leaves to be equally divided amongst my six children; only Cathern Cundiff to have what her Mother thinks fit towards housekeeping besides her part and to live with her Mother and work with her or by herself upon her brother Isaac Cundiff's part of land and to have the use of the ground and the Tobacco House during her single life.

Imprimis I give and bequeath to my eldest son Isaac Cundiff that neck of land beginning at a persimmon tree standing between the Tobacco House and so to the head of the Long Branch, to the corner tree standing in Edmond Bayse's line and to the head of the Long Branch between Elizabeth Taylor's and so down, and up the Swamp by Dennis Conries to the Spring Branch and so up the Spring Branch to the persimmon tree where we first begun, and all the portenances there unto belonging to him and his heirs forever, lawfully begot of his one body and for want of heirs to fall to John Cundiff or his heirs.

Imprimis I likewise give and begave to my youngest son Jonathan Cundiff that part of land beginning at the Pitman's line at the head of a branch and down the branch to his Grandfather Cundiff's Spring and down the north side of the Swamp below Brown's Bridge to Colonel Ball's line, leaving the Swamp and running by the ditch called Browns is an old corner white oak, and from thence to a red oak standing in Thomas Pitman's line and then easterly to the place where he first begun, to him and his heirs forever lawfully begot of his own body, and for want of heirs to Richard Cundiff Junior or his forever.

Imprimis I give and bequeath to my eldest daughter, Valey Bowing and her husband John Bowing, that point of land they now live upon beginning at a corner white oak of Edmond Baysies and running west along Thomas Pitman's line till he comes to the branch to Jonathan Cundiff's line and down this said branch to the point and up to the place where he first begun along the Swamp, during their two lives and after their decease to fall to John Cundiff or his heirs forever lawfully begot of his own body, and for want of heirs to fall to Richard Cundiff Junior or his heirs forever lawfully begot of his one body.

Imprimis I likewise give and bequeath to my son John Cundiff, all the remainder part of my lands, all the portenances there unto belonging to him and his heirs forever lawfully begot of his one body and for want of heirs to fall to Richard Cundiff Junior or his heirs forever lawfully begot of his one body.

Imprimis I likewise here appoint my four sons my sole Executors to see this my will fullfilled and to bear charges alike; Isaac Cundiff, Richard Cundiff, John Cundiff, Jonathan Cundiff, these are my sole Executors to see this my will fullfilled.

Imprimis I likewise will that my movable household goods, none of it to be appraised, but to share as equal as can be and take your lot and don't quarrel, but be fair and love one another and live in the fear of God.

Imprimis I likewise will that my sister Alce Conre enjoy, and her heirs, her part of land with peace quietness as witness my Hand and Seal the First day of January in the year of Our Lord Anno Dom. 1724.
