Will of Mary W. Harris- Alston, 1848
Daughter of James Harris & Temperance Williams; Wife of Philip G. Alston (1762-1820) In the name of God Amen, I MARY ALSTON of the County of
Warren & State of North Carolina being of sound mind & memory do make ordain & establish this to be my last Will and Testament in manner & form
following revoking all others by me heretofore made.
Item- I give to my daughter TEMPERANCE W. DAWSON Negro girl CHANEY.
Item- I give to my daughter MARY A. LEWIS Negro girl JANE.
Item- I give to my daughter ELIZABETH ALSTON the following Negroes, to wit: FED, HARRY, NANCY, LILY, BRISTER, EMILY & JESSE also my carriage &
carriage horses, three mules, all of my household & kitchen furniture, my ox cart and all of my plantation utensils of every description.
Item- It is my wish that the balance of my Negroes, that is all that I have not given away above in this my will, should be divided in four equal parts
one of which, I give to the children of my daughter EVELINE, one other part I give to my daughter CHARITY WORTHAM but in case she should die without
issue, the part I giver her I desire after her death to be equally divided between my children TEMPERANCE W. DAWSON, MARY A. LEWIS, ELIZABETH ALSTON,
GEORGE W. ALSTON, PHILIP G. ALSTON, the children of my daughter EVELINE ALSTON and Dr. PETER FOSTER, the portion that Dr. PETER FOSTER may get however
give to him in trust for the use and benefit of my daughter MARTHA J. WILLIAMS during her life and after her death the part that Dr. PETER FOSTER may
get as trustee by the death of CHARITY WORTHAM, I wish my three grand children to have, that is ROBERT WILLIAMS, to have one share, MATILDA FOSTER to
have one, and MARGARET WHITFIELD to have the remaining share, but the part that my grand daughter MARGARET may get, I desire & intend that she should
only have the use of during her life and at her death that it should go to her children One fourth part of the Negroes alluded to in the commencement of
this clause of my will I give to my daughter ANN MARIA, but in case she should die without issue it is my wish that the part given her should be
distributed precisely in the same manner, that I have directed the fourth part that I have given to my daughter CHARITY to be divided in the event of
her dying without issue, the remaining fourth part of the Negroes I give in Trust to Dr. PETER FOSTER for the use and benefit of my daughter MARTHA J.
WILLIAMS during her life and at her death it is my wish that the part given Dr. PETER FOSTER in Trust for her use & benefit should be equally divided
between her three children ROBERT WILLIAMS, MATILDA FOSTER & MARGARET WHITFIELD but the part that MARGARET may get in the division I design & intend she
should only have the use of during her life & at her death to go to her children.
Item- I am informed that there is a probability of my falling heir to the Estate of my Granddaughter MARY A. TRIPPE who lived in County of Perry and
State of Alabama should it turn out that I should get any portion or all of her Estate it is my wish it should be equally divided between my children
TEMPERANCE W. DAWSON, MARY A. LEWIS, ELIZABETH ALSTON, CHARITY D. WORTHAM, GEORGE W. ALSTON, PHILIP G. ALSTON, ANN MARIA ALSTON, the children of my
daughter EVELINE ALSTON & Dr. PETER FOSTER in trust for the use & benefit of my daughter MARTHA J. WILLIAMS, during her life and at her death it is my
wish that the part that Dr. PETER FOSTER may get in the division be equally divided between her children ROBERT WILLIAMS, MATILDA FOSTER, & MARGARET
WHITFIELD, but the part MARGARET may get in the division it is my wish that she should only have the use of during her life and at her death it should
go to her children.
Item- My crop & stock of all kinds, except the three mules I have given to my daughter ELIZABETH, I wish sold and the money arising from the sale
thereof to be applied to the payment of my debts; given under my hand & seal this 15th day of April in the year of our Lord One thousand eight hundred
and forty seven.

distributive shair to be $3297.50/100 three thousand two hundred ninety seven and 50/100 They were divided into four lots and drawn as follows – to wit Lot
