Transcriptions of Wake County Deeds for EVANS Family In my research of my EVANS family, some of it has led me to Wake County, and although not all of them have been connected to mine, I have found it helpful to collect whatever materials I could to help identify each family. Morris, Gilbert & William Evans were brothers, however, only Morris is clearly identified as a "free person of color", while the other 2 are identified as white in the records. Descendants of these lines would be wise to do DNA research to find out the ethnicity of their ancestors which may help them find out why the discrepancies occurred in this family. Following are some transcriptions of deeds I've used in my research which I hope may also be of assistance to others doing family research.
This indenture made the tenth day of February in the year of Our Lord One Thousand Seven Hundred and Eight Four between MORRIS EVANS & JOHN SCAGAN of Wake County and State of North Carolina of the one part and JAMES KIRCUM (?) of the said State aforesaid of the other part Witnesseth that the said MORRIS and JOHN SCAGIN for and in consideration of the Sum of Seven hundred pounds Courant money of the sd State to them in hand paid before the Sealing and delivery of these presents the Receipt whereof they doth hereby acknowledge and themselves therewith fully Satisfied Contented and paid and thereof doth acquit and discharge the said JAMES KIRCUM(?) and his heirs forever have bargained and sold and by these presence doth bargain sell convey and confirm unto the said JAMES KIRKHAM and his heirs forever one Sertain tract or parcell of Land situate lying and being in the County of Wake aforesaid on the waters of great lick Creek containing by estimation three hundred acres be the same more or less begining on a Sweet gum Thence running down the Said Channel of the said creek to JAMES JONES line to a Sweet gum thence North with sd JONES to a black Jack WM NICHOLS thence cornering and Running said NICHOLS line West to a pine in HUGGINS lick<?> branch thence thence cornering runingeth the said Branch to a blaze line thence the said line to the said KIRKAM Spring branch to the first station together with all houses orchards and every other improvement and appurtenance thereunto belonging or many <ilegible> appertaining And the Revertion and revertion Remainder and <illegible> of the before mentioned land premises with the appurtion and also all the right title, property claim or demands whatsoever of them the said MORRIS EVANS and JOHN SIOGAN their heirs &c of in or too the farms<?> or any part thereof to have and to hold the said three hundred acres of Land and premises unto the said KIRKAM his heirs and assigns to the only proper use and behalf of him the said KIRKAM and his heirs forever Free and clear of and from all Former or other deeds gifts grants bargains Sales dowers & Judgment Executions or any other in Cumbrances Whatsoever and lastly the said EVANS and Said SCOGIN doth for themselves their heirs do promise and agree to and with the said KIRKAM that they will the Right Title and property of the said Land and plantation with the appurtenances warrant and defend to the sd KIRKAM his heirs forever from the Claim right or title of them the said EVANS and SCOGAN and their heirs forever in Witness whereof we the said EVANS and SCOGAN hath hereunto set their hands and Seals the day and year <illegible> written Signs Sealed and delivered in the presence of us MORRIS EVANS ("X" his mark) Seal

BURKE’s line thence So. 105 poles to the first station containing 105 acres as per Deed from CHARLES DUNSTAN to sd. EVANS. The third tract or parcel of Land on great Lick Creek. Beginning at a Black jack in ISAAC HUNTER’s Line THOS. EVANS’ corner thence West 16 poles to a pine sd. EVANS corner, thence with an agreed Line to a black jack WM. BURKE’s line thence with sd line West to a black jack JOSEPH G<smeared> line thence So. to a Black Jack thence East 166 poles to a pine in ISAAC HUNTER’s line thence No. 50 poles to the first station containing two hundred acres as per deed from JOHN MAY to sd. WM. EVANS with the revertion & revertions remainder & remainders rents issues & profits of the said three parcels or tracts of land unto the said DAVID DANIEL his heirs & assigns forever. To have & to hold the said three tracts or parcels of Land to the only proper use & behalf of him the said DAVID DANIEL his heirs & assigns forever, together with all the rights, titles claims Interest & demand which he the said WILLIAM EVANS or his heirs has had or might have of, in, or to the said tract or parcel of Land & the said WM. Witnesseth that the said THOMAS MAY for and in consideration of the sum of two Hundred pounds to him in hand paid the receipt whereof he doth acknowledge and himself satisfied hath given granted bargained sold and confirmed & by these presents doth give grant bargain sell and confirm unto the said WILLIAM EVANS SENR. his heirs and assigns forever, a tract or parcel of land containing two Hundred acres more or less, lying in Wake County on both sides of Little Lick Creek Beginning on a corner Spanish oak on a bank on a prong of little lick Creek, thence North two Hundred and Nineteen poles across said Creek to a black Jack thence East Eighty nine poles to a pine, thence South thirty nine poles to some small maples standing in a small dividing drean on a branch, thence down the meanders of the same to a bent near said creek, thence South a few poles to said Creek cornering on a Sugar tree and bucks beach, thence down the various courses of said Creek on East course Seventy poles to a small poplar, thence south to the bank line, cornering on a pine and thence to the beginning. Containing two Hundred acres be the same more or less, with all and singular the rights hereditaments and appurtenances thereunto belonging or in any wise appertaining. Witnesseth that I the said GILBERT EVANS for and in consideration for the Sum of One hundred dollars to him in hand paid by the said EWELL WATTS, the receipt whereof I have hereby acknowledged and as these presents have bargained Sold Enscoffed and confirmed to him the said EWELL WATTS his heirs & assigns forever. One certain tract or parcel of land lying and being in the County & State aforesaid on the waters of little lick Creek. Beginning at a red oak JESSE GEORGE’ corner thence 55 poles to a stake then West 73 poles to a stake crossing the Creek then North 55 poles to a small Hickory then East 73 poles crossing the Mill pond to the Beginning. This Indenture made this 18th March in the year of our Lord 1841 Between ENOCH EVANS, JNR. And JEFFERSON LYNN and JOHN HAYES and the firm of JOHN HAYES &Co. all of the County of Wake and State of North Carolina Witnesseth that whereas the said ENOCH EVANS JR. stands jointly indebted to the said JOHN HAYES in the sum of Forty dollars and 91 ½ cents with Interest from 18th Inst. And to the firm of JOHN HAYES &Co. in the Sum of Five dollars & 72 ½ cents with Interest from Octr. 1840. One other debt due the said firm of JOHN HAYES &Co. for the Sum of Fifty dollars, which he the said ENOCH EVANS JNR. Honestly desires to secure and pay, in consideration thereof and in further consideration of the Sum of fifty cents to them in hand paid by the said JEFFERSON LYNN before the signing sealing and delivery of these presents the Receipt whereof the said ENOCH EVANS JR. doth hereby acknowledge the said fifty cents and debts and doth for himself, his heirs and assigns, give grant bargain & sell and deliver and by these presents hath given granted bargained sold & delivered to the said JEFFERSON LYNN, his heirs and assigns forever for certain purposes herein after mentioned, viz, 2 cows and their increase 1 stear 15 head of Hogs and their increase 2 Beds & furniture 2 pots one oven 1 spider 2 stacks of fodder, 10 Barrels corn, a parcel of bacon 10 chairs 2 chests 1 table 1 case knives & forks 1 cuppoard 1 sett plates, 1 sett cups & saucers, 1 sett spoons, and all of my cropage corn fodder, oats wheat and cotton &c that I shall make the present year. To have & to hold the above named property and every part thereof with all the rights & priviledges thereunto belonging free & clear from the lawful claim or claims or incumberances of any person whatever unto him the said JEFFERSON LYNN his heirs and assigns forever. In trust & withheld that he the said JEFFERSON LYNN or his heirs shall and may at any time after the 1st of October next sell the aforesaid property to the highest bidder for ready money at such time and place as he the JEFFERSON LYNN or his heirs shall think proper first giving ten days notice by public advertisement of the time and place of sale and the money arising from such sale to be applied to the discharge of the aforesaid debts, of Ninety six dollars and 64 cents and int. due and owing to the said JOHN HAYES and the firm of JOHN HAYES &Co. or so much thereof as may then remain unpaid and also the interest therein together with the costs of advertising and recording of this instrument and all other costs accruing by reason of these presents and to make and execute a good and lawful rights of the said property to the purchasers thereof and the balance of the money if any, to be paid to the said ENOCH EVANS his heirs or assigns &c.
