Transcriptions of Wake County Deeds for EVANS Family

In my research of my EVANS family, some of it has led me to Wake County, and although not all of them have been connected to mine, I have found it helpful to collect whatever materials I could to help identify each family. Morris, Gilbert & William Evans were brothers, however, only Morris is clearly identified as a "free person of color", while the other 2 are identified as white in the records. Descendants of these lines would be wise to do DNA research to find out the ethnicity of their ancestors which may help them find out why the discrepancies occurred in this family.  Following are some transcriptions of deeds I've used in my research which I hope may also be of assistance to others doing family research.


(Note that although the name of one of the grantors was John Scoggin, it was often misspelled in the below deed and I am transcribing the record as is)

MORRIS EVANS, JOHN SCOGGINS to JAMES KIRKUM- 1784

 

This indenture made the tenth day of February in the year of Our Lord One Thousand Seven Hundred and Eight Four between MORRIS EVANS & JOHN SCAGAN of Wake County and State of North Carolina of the one part and JAMES KIRCUM (?) of the said State aforesaid of the other part Witnesseth that the said MORRIS and JOHN SCAGIN for and in consideration of the Sum of Seven hundred pounds Courant money of the sd State to them in hand paid before the Sealing and delivery of these presents the Receipt whereof they doth hereby acknowledge and themselves therewith fully Satisfied Contented and paid and thereof doth acquit and discharge the said JAMES KIRCUM(?) and his heirs forever have bargained and sold and by these presence doth bargain sell convey and confirm unto the said JAMES KIRKHAM and his heirs forever one Sertain tract or parcell of Land situate lying and being in the County of Wake aforesaid on the waters of great lick Creek containing by estimation three hundred acres be the same more or less begining on a Sweet gum Thence running down the Said Channel of the said creek to JAMES JONES line to a Sweet gum thence North with sd JONES to a black Jack WM NICHOLS  thence cornering and Running said NICHOLS line West to a pine in HUGGINS lick<?> branch thence thence cornering runingeth the said Branch to a blaze line thence the said line to the said KIRKAM Spring branch to the first station together with all houses  orchards and every other improvement and appurtenance thereunto belonging or many <ilegible> appertaining  And the Revertion and revertion Remainder and <illegible> of the before mentioned land premises with the appurtion and also all the right title, property claim or demands whatsoever of them the said MORRIS EVANS  and JOHN SIOGAN their heirs &c of in or too the farms<?> or any part thereof to have and to hold the said three hundred acres of Land and premises unto the said KIRKAM his heirs and assigns to the only proper use and behalf of him the said KIRKAM  and his heirs forever Free and clear of and from all Former or other deeds gifts grants bargains  Sales dowers & Judgment Executions or any other in Cumbrances Whatsoever and lastly the said EVANS and Said SCOGIN doth for themselves their heirs do promise and agree to and with the said KIRKAM that they will the Right Title and property of the said Land and plantation with the appurtenances warrant and defend to the sd KIRKAM  his heirs forever from the Claim right or title of them the said EVANS and SCOGAN  and their heirs forever in Witness whereof we the said EVANS and SCOGAN hath hereunto set their hands and Seals the day and year <illegible> written Signs Sealed and delivered in the presence of us

This indenture made this twenty first day of of June One thousand seven Hundred and Ninety Eight Between WILLIAM EVANS of the County of Wake and State of North Carolina of the one part & DAVID DANIEL of the County and State aforesaid of the other part. Witnesseth that the sd WM. EVANS for & in consideration of the sum of two hundred pounds to him in hand paid by the sd DAVID DANIEL at or before the sealing and delivery of these presents the recpt whereof the sd W. EVANS doth hereby acknowledge and doth fully acquit release & discharge the sd. D. DANIEL hath bargained sold aliend  Enscoffd <?> and made over through several tracts or parcels and by these presents doth bargain sell alein assess and make over these several tracts or parcels of Land lying being and situated in the County & state aforesaid the first lying on the branches of great lick Creek beginning at a port Oak on a branch of sd Creek thence west one Hundred & Sixty poles to a port Oak thence North one Hundred poles to a pine thence east one Hundred & sixty poles to a port oak thence to the first station. Containing one Hundred acres as for Deed from the State to said EVANS. The second on the waters of little lick Creek & adjoining the aforementioned tract & beginning at a port Oak the corner of the aforesaid tract thence west to a post SAML JENKINS corner thence N. with sd line 105 poles to a stake on sd Line thence east 160 poles to a Stake in WM. BURKE’s line thence So. 105 poles to the first station containing 105 acres as per Deed from CHARLES DUNSTAN to sd. EVANS. The third tract or parcel of Land on great Lick Creek. Beginning at a Black jack in ISAAC HUNTER’s Line THOS. EVANS’ corner thence West 16 poles to a pine sd. EVANS corner, thence with an agreed Line to a black jack WM. BURKE’s line thence with sd line West to a black jack JOSEPH G<smeared> line thence So. to a Black Jack thence East 166 poles to a pine in ISAAC HUNTER’s line thence No. 50 poles to the first station containing two hundred acres as per deed from JOHN MAY to sd. WM. EVANS with the revertion & revertions remainder & remainders rents issues & profits of the said three parcels or tracts of land unto the said DAVID DANIEL his heirs & assigns forever.  To have & to hold the said three tracts or parcels of Land to the only proper use & behalf of him the said DAVID DANIEL his heirs & assigns forever, together with all the rights, titles claims Interest & demand which he the said WILLIAM EVANS or his heirs has had or might have of, in, or to the said tract or parcel of Land & the said WM. EVANS doth for himself & his heirs further covenant to & with the said DAVID DANIEL his heirs & assigns that at the time of sealing & delivering these presents he is possessed of a free & indefarable right & title to the aforesaid tracts or parcels of land free from all encumbrances whatsoever within law or Equity & the said WILLIAM EVANS for himself & his Heirs doth warrant & forever defend the aforementioned premises from all persons who shall by any claim right or title to the same unto the said DAVID DANIEL his Heirs & assigns forever    In witness whereof the said WILLIAM EVANS has hereunto set his Hand and affixed his seal this day & date above written.

THOMAS MAY to WILLIAM EVANS-1799

 

This indenture made this 14th day of December in the year of Our Lord One thousand Seven Hundred and Ninety-nine, between THOMAS MAY of the County of Wake and State of North Carolina of the one part, and WILLIAM EVANS of the other part. Witnesseth that the said THOMAS MAY for and in consideration of the sum of two Hundred pounds to him in hand paid the receipt whereof he doth acknowledge and himself satisfied hath given granted bargained sold and confirmed & by these presents doth give grant bargain sell and confirm unto  the said WILLIAM EVANS SENR. his heirs and assigns forever, a tract or parcel of land containing two Hundred acres more or less, lying in Wake County on both sides of Little Lick Creek Beginning on a corner Spanish oak on a bank on a prong of little lick Creek, thence North two Hundred and Nineteen poles across said Creek to a black Jack thence East Eighty nine poles to a pine, thence South thirty nine poles to some small maples standing in a small dividing drean on a branch, thence down the meanders of the same to a bent near said creek, thence South a few poles to said Creek cornering on a Sugar tree and bucks beach, thence down the various courses of said Creek on East course Seventy poles to a small poplar, thence south to the bank line, cornering on a pine and thence to the beginning.  Containing two Hundred acres be the same more or less, with all and singular the rights hereditaments and appurtenances thereunto belonging or in any wise appertaining. To have and to hold the said Bargained premises to the only proper use and behoof of him the said WILLIAM EVANS his heirs and assigns forever, & the sd THOMAS MAY & his heirs Executors administrators & assigns doth covenant and agree that the said Tract of land is free and discharged from an encumbrances & that this deed is good and valid to all intents and purposes and that the said WILLIAM EVANS his heirs and assigns may forever hereafter have hold use occupy possess & enjoy the same without any lawfull let hindrance whatsoever, and the said THOMAS MAY will warrant and defend the same against the claim or claims of person or persons whatsoever.  In witness whereof he hath hereunto set his hand and affixed his seal the day and year first above written.

This Indenture made this 11th day of December of the year of our Lord One thousand Eight hundred and five by and between GILBERT EVANS of the County of Wake and the State of North Carolina of the one part, and HENRY EVANS of the County & State aforesaid of  the other part  Witnesseth; that I the said GILBERT EVANS for and in consideration of the natural love, and affection which I bear to my son HENRY EVANS have by these presents given and granted unto my said son HENRY EVANS one certain tract and parcel of Land, containing by Estimation one Hundred acres and Bounded as follows (to witt) beginning at a hickory in WILLIAM EVANS' line runing thence South two hundred poles to a black Jack, near a drain, thence East Eighty poles to a turkey oak, near the So. fork of little lick Creek thence, North two hundred poles to a small Hickory in WILLIAM EVANS line thence West along said line to the Beginning, to have and to hold, the above granted land and premises with all and singular the rights profits and priveledges with the heriditaments and appurtenances thereto in any wise appertaining or belonging, unto him the said HENRY EVANS, his heirs or assigns forever, and he the said GILBERT EVANS does agree that he will forever warrant and defend, the above granted land and premises unto him the said HENRY EVANS his heirs or assigns forever, to his or their only proper use and behoof from the lawful claim challenge or demand of all persons whatsoever.  In witness whereof I the said GILBERT EVANS have hereto set my hand and affixed my Seal the day and date first above written

This Indenture made the twenty first day of February and in the year of our Lord One thousand Eight hundred & Seven between JOSEPH LUMBLEY of Wake County and State of North Carolina of the one part and GILBERT EVANS, of the County and State aforesaid of the other part Witnesseth; that the said JOSEPH LUMBLEY for & in consideration of the Sum of One hundred pounds Specie, to him in hand paid by the said GILBERT EVANS, before the sealing and delivering of these presents, the receipt hereof, is hereby acknowledged hath granted Bargained & by these presents doth bargain sell & convey and confirm, unto the said GILBERT EVANS, one certain tract or parcel of land, and plantation situate lying and being in the County of Wake, on the waters of the two Lick Creeks.  Beginning at a Black Jack in said EVANS’ line, then South one hundred and thirty five poles to a stake in sd EVANS’ line, thence East one hundred and twenty five poles to a Stake, thence North one hundred and thirty five poles to Hickory Shrub in sd G. EVANS’ line; thence West One hundred and twenty five poles, to the first station, containing by estimation  One hundred acres of land, and be the same more or less with all Houses, orchards, woods and underwoods and all other appurtenances whatsoever, thereunto belonging to the sd Land and premises, unto the said GILBERT EVANS his heirs & assigns to the only proper use and behoof of him the said GILBERT EVANS & his heirs forever free & clear of & from, all former or other Deeds Gifts Grants, Bargains  Sales Dowries  Judgments, Executions or any other incumbrances whatsoever, and lastly the said JOSEPH LUMBLEY doth for himself his heirs  and Promise and agree to and with the said GILBERT EVANS, that he will the rights titles and Property of the sd. This Indenture made this 20th day of March 1807. By and between JOHN F. CARLTON of the County of Wake and State of North Carolina of the one part, and HENRY EVANS of the County & State aforesaid of the other part Witnesseth that the said JOHN FLOOD CARLTON for and in consideration of the Sum of Sixty pounds, lawful money of said State, to him in hand paid before the ensealing of these presents the receipt whereof he hath hereby acknowledged, and by these presents so bargain sell enscoff and confirm unto him the said HENRY EVANS his heirs or assigns forever, one certain tract or parcel of Land containing by Estimation One hundred and Twenty acres, lying and being in said County of Wake, on the waters of little lick Creek -- and bounded as follows:  Beginning at an ash and poplar, on little lick Creek, in GEORGE RIDEN’s line, thence along said line East to a red Oak, then So. 160 poles, to a Black Jack, thence East 80 poles to a pine, then No. 176 poles, to a pine on Rosses Road thence along said road about No 40  West 78, poles to a white oakon the bank of said Creek to the beginning. This indenture made this 10th day of March in the year of Our Lord One thousand Eight hundred and ten by and between HENRY EVANS of the one part and JOHN MAY SR. of the other part both of the County of Wake State of North Carolina.  Witnesseth that the said HENRY EVANS for and in consideration of the sum of Sixty pounds lawful money of this State to him in hand paid by JOHN MAY SR. the receipt whereof he hath hereby acknowledged and by these presents have bargained & sold, assessed(?) and confirmed unto him the said JOHN MAY his heirs or assigns forever and certain tract or parcel of land, lying and being in the said County of Wake and bounded as follows, beginning at a poplar on the little lick Creek and bounded by the land of GEO. RIDENS & HENRY EVANS containing by estimation one hundred and twenty acres, be the same more or less with all and singular the rights and profits & priviledges with the hireditaments and appurtenances thereto in anywise appertaining or belonging unto him the said HENRY EVANS & he the said HENRY EVANS, does agree & oblige himself his heirs or assigns that the will forever warrant and the defend the above bargained land and promises unto him the said JNO. This Indenture made this 22d day of January in the year of Our Lord, One thousand Eight hundred and ten by and between GEORGE BRASFIELD of the County of Wake State of No. Carolina of the one part, and WILLIAM EVANS of the County and State afores’d of the other part Witnesseth that the said GEORGE BRASFIELD for and in consideration of the Sum of One hundred pounds to him in hand & paid by the said WILLIAM EVANS his heirs or assigns forever one certain tract or parcel of land lying and being in said County of Wake and bounded as follows, to wit, Beginning at a Sweet gum NIMROD RENCHE’s Corner, thence West Two hundred and Eight poles to a pine on the Great Branch, thence up the various courses of said Branch to a white oak in SOLOMON GEORGE’s line thence East along a straight line to the Beginning  Containing one hundred acres, with all and singular the rights profits privileges with the reseditaments and appurtenances thereunto in any wise appertaining or belonging and he the said GEORGE BRASFIELD does agree for himself his heirs &c, that they will forever Warrant and defend the said land and promises to him and WILLIAM EVANS , his heirs or assigns forever to his or their proper use and behoof from the lawful claim  challenge or demand of all persons whatsoever.  Witness whereof I have hereunto set my hand and affixed my seal the day and date above written.

This Indenture made this 29th day of July in the year of Our Lord One thousand Eight hundred and fourteen, by and between WILLIAM EVANS of the County of Wake and State of North Carolina of the One part, and MARK BEASLEY of the County and State aforesaid Witnesseth that the said WILLIAM EVANS for and in consideration of the sum of two hundred and fifty dollars to him in hand paid by the said MARK BEASLEY the right whereof he doth hereby acknowledge, and by these presents have bargained, sold, enscoffed, and confirmed to him the said MARK BEASLEY his heirs or assigns forever, one certain tract or parcel of land, lying and being in said County of Wake and bounded as follows, to wit- Beginning at a sweet gum JOSEPH SCOTT’s corner, then a west two hundred and eight poles to a pine on the Great Branch, thence up the various courses of said Branch to a white oak in ZACHARIAH RENCHER’s line, thence South 36 °  East along a short line to the Beginning containg one hundred acres with all and singular the rights profits and privileges with the hereditaments and appurtenances thereto in any wise appertaining or belonging and the said WILLIAM EVANS doth agree for himself his heirs or assigns, that they will forever warrant and defend the above bargained land and premises to him the said MARK BEASLEY his heirs or assigns forever to his or their proper use and behoof from the lawful claim or demand whatsoever   In witness whereof he the said WILLIAM EVANS has hereto set his hand and seal the day and date above written.

This Indenture made this Twenty Sixth day of February and in the year of Our Lord One thousand eight hundred & Seventeen Between GILBERT EVANS of the the County of Wake and State of North Carolina in the one part, and ENOCH EVANS of the County and State aforesaid of the other part, Witnesseth that for and in consideration of the Sum of   Twenty five dollars, & a quarter to him in hand paid before the sealing and delivery of these presents, the receipt whereof he doth hereby acknowledge and himself therewith fully satisfied contented and paid & therefore doth acquit and discharge, him the said ENOCH EVANS  and his heirs forever, have bargained and sold by these presents doth Bargain sell convey and confirm unto the said ENOCH EVANS, & his heirs forever.  One certain tract or parcel of land, lying and being in the County of Wake, and on the waters of little lick Creek, containing twenty seven and a half acres be the same more or less and bound as follows. Beginning at a pine stump JOHN KING’s corner thence North along his line One hundred poles to a Black Jack, Widow EVANS corner, thence East along her line Eighty poles to a pine, on the Road thence up the Road, sd 27° West and South 40°  West to the corner of JOHN EVANS fence, thence West 8 poles to the old Road, a corner Persimon tree, thence down the old Road, to said EVANS corner Black Jack then East 4 poles to the Beginning with all and singular the right profits and priviledge, with the hereditaments  and appurtenances thereto in any wise appertaining or belonging to him the said ENOCH EVANS and his heirs forever, free and clear of and from all former or other deed  gifts  grants  bargains  sales  doweries  judgments Executions or any other incumbrances whatsoever, and lastly the said GILBERT EVANS, doth for himself, his heirs & promise & agree to & with said ENOCH EVANS, that he will the right title and property of the land & premises unto him the said ENOCH EVANS and his heirs forever, from the claim or right or title of him the said GILBERT EVANS and his heirs forever.  In witness whereof the said GILBERT EVANS, hath hereunto set his hand an fixed his seal, the day & year above written

Containing by estimation twenty five acres, be the same more or less with all the hereditaments and appurtenances thereunto belonging or in any ways, appertaining unto the said EWELL WATTS his heirs & assigns forever together with all the Rights which I or my heirs may have had to land or lands and premises to the only use and behoof of him the said EWELL WATTS  his heirs and assigns forever and I the sd GILBERT EVANS, will hereby warrant and defend the sd tract or parcel of land from all persons and shall lay any claim Right or title to the said land & premises to the said EWELL WATTS his heirs & assigns forever. KENNON EVANS for & in consideration of the sum of Two hundred and ten dollars, to them in hand paid by the said GEORGE BRASFIELD the receipt whereof they have hereby acknowledged and by these presents have hereby acknowledged, and by them presents have Bargained Sold Enscoffed and confirmed unto him the said GEORGE BRASFIELD his heirs or assigns forever, one certain tract or parcel  of land lying and being in the County of Wake, and bounded as follows

This Indenture made this 18th March in the year of our Lord 1841 Between ENOCH EVANS, JNR. And JEFFERSON LYNN and JOHN HAYES and the firm of JOHN HAYES &Co. all of the County of Wake and State of North Carolina  Witnesseth that whereas the said ENOCH EVANS JR. stands jointly indebted to the said JOHN HAYES in the sum of Forty dollars and 91 ½ cents with Interest from 18th Inst. And to the firm of JOHN HAYES &Co. in the Sum of Five dollars & 72 ½ cents with Interest from Octr. 1840. One other debt due the said firm of JOHN HAYES &Co. for the Sum of Fifty dollars, which he the said ENOCH EVANS JNR. Honestly desires to secure and pay, in consideration thereof and in further consideration of the Sum of fifty cents to them in hand paid by the said JEFFERSON LYNN before the signing sealing and delivery of these presents the Receipt whereof the said ENOCH EVANS JR. doth hereby acknowledge the said fifty cents and debts and doth for himself, his heirs and assigns, give grant bargain & sell and deliver    and by these presents hath given granted bargained sold & delivered to the said JEFFERSON LYNN, his heirs and assigns forever for certain purposes herein after mentioned, viz, 2 cows and their increase  1 stear   15 head of Hogs and their increase  2 Beds & furniture  2 pots   one oven  1 spider  2 stacks of fodder, 10 Barrels corn, a parcel of bacon   10 chairs  2 chests  1 table   1 case knives & forks    1 cuppoard    1 sett plates, 1 sett cups & saucers,  1 sett spoons, and all of my cropage corn fodder, oats wheat and cotton &c that I shall make the present year.  To have & to hold the above named property and every part thereof with all the rights & priviledges thereunto belonging free & clear from the lawful claim or claims or incumberances of any person whatever unto him the said JEFFERSON LYNN his heirs and assigns forever.  In trust & withheld that he the said JEFFERSON LYNN or his heirs shall and may at any time after the 1st of October next sell the aforesaid property to the highest bidder for ready money at such time and place as he the  JEFFERSON LYNN or his heirs shall think proper first giving ten days notice by public advertisement of the time and place of sale and the money arising from such sale to be applied to the discharge  of  the aforesaid debts, of Ninety six dollars and 64 cents and int. due and owing to the said JOHN HAYES  and the firm of JOHN HAYES &Co. or so much thereof as may then remain unpaid and also the interest therein together with the costs of advertising and recording of this instrument and all other costs accruing by reason of these presents and to make and execute a good and lawful rights of the said property to the purchasers thereof and the balance of the money if any, to be paid to the said ENOCH EVANS his heirs or assigns &c.  In witness whereof we the above named have hereunto set our hands & seals this day & date first above written, Signed Sealed & delivered in the presence of us.
