LYNCH FAMILY PETITIONS

 
Dudley S. Lynch, b.1850, was the son of William Thomas Lynch & Nancy Hawkins of Halifax County, NC. He was married 3 times, the names of his wives were Mary Eliza Silver, Aleine Whitaker and Minnie Fox. In 1896, he headed a group of LYNCH Family members who sent in applications to the Dawes Commission for acceptance to the Cherokee Nation, and although all of them were Rejected, many of the family and their descendants went on to later form the Haliwa-Saponi Tribe in North Carolina.  These petitions provide a great deal of family information not previously known by many of the current-day descendants and it clarifies and consolidates the ancestry of all who are related in a way I had not thought would be possible. One of the things that is of note, is that by 1896, the name of their oldest known ancestor had become muddled with each person remembering only various parts of his name. The name was James Weaver, born about 1762, however, many called him James Lanier, or variant spellings of that and I do wonder if perhaps there was a LANIER in his own ancestry that may have contributed to the confusion of names? Whatever the case, there are quite a few surprises in these petitions for researchers, with some new information that could change what some may have thought previously, so I urge you to explore these records and use them in addition to your own research.

Before the Honorables, HENRY L. DAWES, FRANK C. ARMSTRONG, A. S. McKENNON, T. B. CABANISS, and A. B. MONTGOMERY, Commissioners.

In the matter of application of DUDLEY LYNCH, et. al.
Nation's No. 3199

for citizenship in the Cherokee Nation.
Your respondent, S. H. MAYES, Principal Chief of the Cherokee Nation, comes now and demurs the said application, and for the grounds thereof says:
1st. That this Commission has not jurisdiction over the parties or subject matter of this controversy, and no legal right, therefore, to hear and determine the same.
2nd. That the application does not state facts sufficient, if true, to show that the applicants are entitled to citizenship.
Respondent not waiving his aforesaid demurrer, but insisting upon the same for answer to said application, says that JAMES LONNEY through whom the petitioners claim to derive their right to citizenship in the Cherokee Nation, is not now, and has not been a citizen of the Cherokee Nation, since the removal of said Nation, west to the Indian Territory as at present located and defined; that his name does not appear on any of the authenticated rolls of said Nation; that neither he nor any of his ancestors now reside, or ever have resided in the Cherokee Nation and Indian Territory, as citizens thereof.

Having fully answered, your respondent asks to be hence dismissed.

MAYES Chief of the Cherokee Tribe of Indians Tahlequah, Ind. Ter. that registry receipt No.__ received from the P.M. and attached hereto is a receipt for said package which contained copies of the applications of DOCK ANSTED and FRANCIS HEDGEPETH with the affidavit of JAS. J. KING, WM. STOKES in support thereof. The application of JAS. LYNCH with the affidavit of JAS. J. KING in support thereof. The application of DUDLEY, ALBERT, JAS. and JOE LYNCH with the affidavit of WM. SYKES in support of same. And the application of WM. BOONE with the affidavit of A. B. ALLEN, W. K. A. WILLIAMS, GEO. WILLIAM SYKES being sworn according to law states that he is a resident of Nash County and that he is 82 years of age and he is acquainted with JAMES LYNCH, ALBERT LYNCH and JACKSON LYNCH and their father CHARLES LYNCH and Mother TEMPIE LYNCH and their Father JAMES LENIER and the said JAMES LYNCH, ALBERT and JACKSON LYNCH was Grand sons of JAMES LENIER and JAMES LENNIER was a full blooded Cherokee Indian and was always said to be as far back as I have ever heard and DUDLEY LYNCH is the son of THOMAS LYNCH who was also a son of said JAMES LANIER.

WM. BOONE's Application and Affidavits

To the Honorable the Dawes Commission on Citizenship in the Five Civilized Tribes in the Indian Territory:

Your petitioner WM. BOONE the undersigned respectfully states that he is a Cherokee Indian by blood and asks to be enrolled as a member of the Cherokee Nation of Indians in the Indian Territory.
That he derives his Indian blood from his grandfather LEWIS BOONE who was the father of CAROLINE BOONE, who was the mother of petitioner. CAROLINE BOONE and DARCUS RICHARDSON were sisters and both were Cherokee Indians by blood.
Your petitioner states the above facts as the lawful grounds of his application for citizenship in the Cherokee Nation and prays that his application may be fully investigated by your Honorable Commission and that he be adjudged to be a citizen in accordance with the laws and treaties with said Nation of Indians.

A. B. ALLEN being sworn according to law says that he is well acquainted with WM. BOONE, that he has lived in the same neighborhood with said BOONE and he is known among his neighbors and is recognized as of Cherokee Indian blood and this affiant has always so believed. His personal appearance shows very decidedly that he is of Indian extraction.
He is of kin to the RICHARDSONs who are known to be of Cherokee blood.

KING being sworn according law states that he is a resident of Halifax County and that he is well acquainted with JAMES LYNCH and his ancestor NANCY LYNCH is the mother of JAMES LYNCH, THOMAS LYNCH, HARDY LYNCH, EMILY EVINS, BETTY LYNCH, PATTY LYNCH & LUCY HEADGSPETH and WEAVER LYNCH is the grandfather of the above named JAMES LYNCH and HARDY LYNCH, EMILY EVINS, BETTY LYNCH, THOS.
