WARRANTY DEED

ALBERT HARRINGTON & WIFE to J.J. MAY

Know al men by these presents: That we, A Harrington and Mahala L. Harrington, wife of the said A Harrington, of the County of Trinity and State aforesaid, for and in consideration of the sum of $300.00 three hundred dollars, to us paid by J.J. May - $150 one hundred and fifty dollars cash, the receipt of which is hereby acknowledged - also one note bearing even date herewith for $150.00 one hundred and fifty dollars due and payable at Trinity, Texas, Dec. 1st, 1898, have granted, sold and conveyed, and by these presents as grant, sell and convey unto the said J.J. May of the County of Trinity and State of Texas all that certain tract or parcel of land lying and being situated in the County of Trinity and State of Texas herinafter described except (40) acres out of the SW corner of said described land being described as follows:

Beginning 92vars N, from the SW corner of J.R. Johns pre. Srv. And on the W.B. line of the same a stake a pine 12 in vrs S 43 W l vrs; a pine 6 in brs S 8 vrs. Thence W 1075 vrs. set a stake on the E.B. line of Sebastion Hayeans 320 acre syr, a O,I, 7 in brs. N. 34 W I vrs. a B.J. 5 in brs. S 71 W. 5 vrs. Thence S on Hayran's E.B. line 426 vrs E prong of Rawhide Bayou C. S. W. 840 vrs the S.E. cor. Of Hayeans a P.O. 7 ins for cor. A G.J. I in brs. N. 70 E. 5 vrs a P.O. 12 in brs. N. 55 W 12 vrs. Thence E 500 vrs. Black Jack ridge 780 vrs. Pennington Road to Frisby's Landing 1075 vrs. stake for cor. A P.O. 15 in. brs. S 16 E 6 vrs a do 12 ins brs. S 59 W 5 vrs. Thence N. 460 vrs. Pennington Road 748 vrs. J.R. Johnsons S.W. cor 840 vrs the beginning. The (40) forty acres above mentioned as excepted in the SW corner of this survey was heretofore deeded to N.D. Williamson by deed dated 5th day of Feb. 1892. Said deed being recorded in Book "P" page 268 and 269 Deed records of Trinity Co. It is distinctly understood that his deed conveys all of the remaining portion of the 160 acre tract herein described by field notes being one hundred and twenty acres. It is expressly understood that the Public Road leading from Trinity to Nevil's Prairie is the E.B. line of the (40) forty acres heretofore deeded to N.D. Williamson.

To have and to hold the above described premises, together with all and singular, the rights and appurtenances thereto in anywise belonging unto the said J.J. May his heirs and assigns, forever. And we do hereby bind our selves, our heirs, executors and administrators to warrant and forever defend all and singular the said premises unto the said J.J. May his heirs and assigns against every person whomsoever lawfully claiming or to claim the same or any part thereof.

Before me, W. N. Evans, Justice of the Peace and exofficio Notary Public in and for Trinity County, Texas, on this day personally appeared Albert Harrington and Mahala L. Harrington wife of Albert Harrington, know to me to be ther persons whose names are subscribed to the foregoing instrument and acknowledged to me that they executed the same for the purposes and considerations herein expressed. And the said Mahala Harrington wife of said Albert Harrington having been examined by me privily and apart from her husband and having the same by me fully explained to her, she, the said Mahala Harrington, acknowledged such instrument to be her act and deed and she declared that she had willingly signed the same for the purposes and considerations therein expressed, and that she did not wish to retract it.
