Hails Family of Durham, England
My
Hails family has been traced back to county Durham in England. The spelling of
the name has several variations including HALES, HAILES, HAILLS and HAILS. The
latter being the most consistent of all the spellings, and the one which has
been retained by my branch of this family for well over 150 years. My earliest
known Hails ancestors are Thomas and Isabel HALES of Birtley and later Harraton
who had five known children. I am a descendant of their youngest son, William
whose great-grandson, Robert migrated to Australia in 1876. I would take this
opportunity to acknowledge Mr. William Miller in the UK, also a descendant for
sharing the results of his Durham research.

He married Isabella WALKER, 7 Nov 1784 in

It is likely that Isabella is the one that
appears on the 1841 Census with John and his family aged 80+ years. She was
also born in the county. 16
Isabella died at Sheriff Hill in Gateshead. The
informant at her death was Hannah Hails. Research undertaken by William Miller
reveals that Isabella's eldest son, Robert was married to Hannah Ayre in 1816,
and that she is likely to be the informant. Robert and Hannah were both living
in Gateshead at the time of the 1851 Census. 58

Robert may have been a potter who worked at the
Patterson Pottery in Sheriff Hill. It was quite a substantial pottering
employing around 50 people with the majority of the produce exported to Norway.

12. John HAILS. Son of William HAILS & Isabella WALKER. Born Circa

A John Hales, aged 40, a Potter, who was born in
the county of Durham, was residing at Waterloo St, Southwick at the time of the
1841 Census that was taken on the evening of 8 June, 1841. Also residing with
John were his likely wife, Elizabeth, whose age was also given as 40 who was
not born in the county together with their children, Ann, aged 20, John, 15,
Robert, 10, Isabella, 8,Thomas, 5, and William, 2. An 80-year-old Isabella was
also residing in the family home and it is believed she is most likely to be
John's mother. It should be noted that at the time of the 1841 Census, the age
of anyone over 15 years of age were recorded to the nearest multiple of five
below, meaning both John and his wife were between 40-45 years. 16
John has been identified on the 1851 Census at
Waterloo St, Southwick, Durham ( LDS Reel 087076). John was aged 54, described
as a Potter (Fireman) and was born in Newbottle, Durham. Also residing with
John were his wife, Elizabeth, aged 52 a native of Wales, and four of their children:
namely, Ann, aged 31 who was born in Newcastle on Tyne, Thomas, aged 20, also a
Potter (White Thrower), Isabella, aged 18 and Thomas aged 11, who was described
as 'at pottery'. The three younger children were all born in Southwick. 17
John and his wife, Elizabeth and their youngest
child, William have also been identified on the 1861 Census at Southwick,
Durham (LDS Reel 0850882). John was married, aged 64 yrs, a Potter, born
Newbottle, Durham. His wife Elizabeth was married, aged 62 yrs, born Hollow Heave,
Wales and William their son, was unmarried, aged 21 yrs, a Coal Miner, born
Southwick. 18
A burial for John HAILS has been noted in the
Parish Registers in 1862. 5
There are no HAILS families living in Southwick
at the time of the 1871 Census. 19
He married Elizabeth. Born Circa 1799 in
Hollow Heave, WALES 18. Died 1861-1881. It would seem most likely
that Elizabeth died some time prior to the 1881 Census. She does not appear
anywhere on the index in Durham, in fact it is likely she died prior to the
1871 Census, however a burial record has yet to be found.38 They had
the following children:

13. Ann HAILS. Daughter of John HAILS & Elizabeth. Born Circa 1820
in Newcastle upon Tyne, Durham, ENGLAND 17. Buried 28 May 1851 in

Ann was residing with her parents at Waterloo St,
Southwick at the time of the 1841 Census. Her age at the time was rounded down
to 20 years. 16
Ann gave birth to a daughter Jane in 1847,
however other than her baptism, no further record of the child has been found
to date. 5
Ann was still residing with her parents at
Waterloo St, Southwick, Durham at the time of the 1851 Census. She was aged 31
years and her birthplace was given as Newcastle on Tyne. 17
She died just two months later and is buried at
Southwick. It is believed her nephew, William, son of John was baptised on the
same day. 5

John was residing with his parents, brothers and
sisters at Waterloo St, Southwick at the time of the 1841 Census. His age had
been rounded down to 15 years, which would indicate he was born some time
between 1821 and 1826. 16
John, may be the one who married in the 3rd
Quarter of 1846 at Sunderland, however there is no marriage record occurring in
the parish of Southwick. At the time, his wife's maiden name was not known and
has not been cross-referenced. 22
His wife's maiden surname has since been noted on
Parish Register entries at the time of the baptism of their children. 5
Neither John nor his wife were noted on the 1851
Census at Southwick however it would appear they were residing at Monkwearmouth
Shore at this time, as this address was given when their son, William was
baptised two months later in May 1851. 17
While John doesn't appear on the 1861 Census, his
wife, Isabella and children, William and Isabella are both noted as visitors to
the home of George and Catherine Cooper of Stafford Street. Isabella was
described as being married not widowed, and no record of a death for her
husband has been noted in the Southwick Parish Registers. Isabella was aged 33
years and her birthplace given as Elton, Durham. Of their children, both were
described as scholars, William was aged 11 and born at Monkwearmouth and
Isabella, aged 13 was born at Southwick. No record of their oldest daughter,
Elizabeth has been found. 18
It is believed that John may be the one
identified on the 1881 Census Index at Southwick as a boarder in the home of
William Spoor. 38
He married Isabella THOMPSON. Born Circa 1828 in
Elton, Durham, ENGLAND 18. Buried 14 Apr 1867 in Southwick, Durham,

Robert was residing with his parents, brothers
and sister at Waterloo St, Southwick at the time of the 1841 Census. He would
have been about 14 years old, but it appears, his aged has been rounded down to

Robert married Mary
McKENZIE, daughter of John McKENZIE, Jan 1849 in Sunderland, Durham,
ENGLAND 3. Born Circa 1831 in Penshaw, Durham, ENGLAND 17.
The 1851 Census indicates that Mary was born in
Penshaw, Durham circa 1831, however her marriage indicates she was born circa
1829. A search of the 1841 Census for Penshaw has been undertaken, however Mary
and her family were not found.
As mentioned above, Robert and Mary were married
at the Parish Church in Sunderland in January 1849, although their marriage
certificate does not give the exact date. Robert signed the register with his
signature, however Mary signed with her (x) mark. The witnesses to their marriage
were George LORD and Page SMITH. 3
Robert and Mary had the following children:

Robert, his wife, Mary and their young family
were residing at Waterloo St, Southwick at the time of the 1851 Census. Robert
aged 24 was a shipwright born in Southwick. His wife, Mary, was 20 and born in
Penshaw. Their two young sons, John and William were aged 1 and 4 months
respectively, both had been born in Sunderland. Robert's parents were living
just three houses away also in Waterloo Street. 17 ( LDS Reel
087076).
Robert and his family have also been identified
on the 1861 Census at East Murton residing at 24 Cottage Row. Robert is aged 34
years, a joiner and was born at Southwick. His wife's name however, is Annie,
she was aged 33 years and born in Durham. Initially it was believed that this
was the same person as Mary, whom Robert married in 1849, and that her name was
"Mary Ann". However it is possible that she is infact a second wife,
as both her age and birthplace also conflict with those given by
"Mary" at the time of the 1851 Census. The children residing with
Robert and his wife include John, aged 11, a coalminer born Sunderland, Robert,
aged 5, a scholar, born Southwick, and Annie, aged 2, born Sunderland. 18
(LDS Reel 0543181).
A search of the St. Catherine's Deaths Indexes
between 1855-1861, marriage indexes after 1855, and Births Indexes after 1859
will hopefully further clarify the above.
The 1871 Census for Southwick has also been
consulted and there is no record of Robert Hails and his family. In fact, there
is only one Hails resident in Southwick at the time and that is a widow,
Dorothy, aged 64. 19
Neither Robert, Mary nor Ann/Annie Hails have
been identified on the 1881 Census in Durham. However, an entry for Ann HAILES
aged 22, born Sunderland who is possibly the daughter mentioned at the time of
the 1861 Census has been found at 7 Owen St, East Murton in the home of Thomas
HENRI and his wife Ann. It would seem very likely that this is Robert's wife,
Ann, however this has not yet been substantiated. Also in the home is 2 year
old John Robert HAILES, a likely son of Ann, who is described as a stepdaughter
to Thomas HENRI. 38

Thomas appears on the 1841 Census in the home of
his parents at Waterloo St, Southwick. He would have been nearly 10, however,
his age is given as five, but it is possible that the enumerator has rounded
down as he appears to have done this with other child members of this family.
Thomas was residing with his parents at Waterloo
St, Southwick, Durham at the time of the 1851 Census. He was aged 20, described
as a Potter (White Thrower) and was born in Southwick. 17
Thomas was not residing in Southwick at the time
of the 1861 Census. 18
Thomas cannot be positively identified on the
1881 Census Index. 38

At the time of the 1841 Census, 8 year old
Isabella was residing with her parents at Waterloo St, Southwick. 16
Isabella was still residing with her parents at
Waterloo St, Southwick, Durham at the time of the 1851 Census. She was aged 18
and was born in Southwick. 17
It would seem most likely that Isabella may have
married some time between 1851 and 1861, as she does not appear on the 1861
Census, however there is no marriage for Isabella in Southwick. 5 At
this time, the St. Catherine's House Indexes have only been searched up to 1858
- and the only likely entry during that time period is at Tynemouth in 1854. 22

At the time of the 1841 Census, William was
residing with his parents at Waterloo St, Southwick. His age at the time was
given as 2 years. 16
William was residing with his parents at Waterloo
St, Southwick, Durham at the time of the 1851 Census. He was aged 11, and
described as being 'at pottery' and was born in Southwick. 17
William was still residing with his parents at
the time of the 1861 Census. At the time he was aged 21, a coal miner and his birthplace
was again given as Southwick. 18
It is believed that William is the 41 year old
William HAILLS who was residing at Monkwearmouth Shore at the time of the 1881
Census. He was born at Southwick. Also residing with him were his wife,
Margaret and children, Elizabeth, Margaret, Isabella and Thomas. 20
He married Margaret HENDERSON. Born Circa 1845 in
Whitburn, Durham, ENGLAND 38. They had the following children:

spinster of Southwick. 5
To date, no further record of the child Jane has
been found. She is not listed on the 1851 Census with her mother or
grandparents, and no burial for a Jane Hails prior to this date has been
identified.

regarding Elizabeth has been found.

William appears on the 1861 Census with his
mother and sister in the home of George and Catherine Cooper at Stafford St,
Southwick. He was described as a scholar, aged 11 years and born in
Monkwearmouth. 18
23. John HAILS. Son of Robert HAILS & Mary McKENZIE. Born Circa 1850
in Sunderland, Durham, ENGLAND 17. Died After 1891.
It is believed that John was born c1850, in
Sunderland as there is no record of his baptism in the Parish Register for
Southwick.
John is listed on the 1851 Census in the home of
his parents aged 1 year, his birthplace given as Sunderland. 17
John and his wife, Sarah migrated to Australia
with his brother Robert on board the "Windsor Castle"
which arrived in Brisbane, Queensland on 10 March 1876. At the time, John was
described as married and aged 25 yrs. His wife, Sarah was 23 yrs. 9
It is not known what happened to John or his
wife, Sarah, although it is believed they too relocated to the Newcastle
district in NSW.
A search of BDM records for both NSW and
Queensland has not revealed any birth records for children of this couple.
It is noted, that a Mrs. Hails was the witness at
the birth of Hannah Keziah HAILS, daughter of Robert and Isabella, at Adamstown
in 1881 - it is possible that this is John's wife, Sarah.
John HAILES is listed on the 1882/3 Electoral
Roll at Newcastle, situated at Commonage. He is again listed in 1883/4 in the
same electorate. He is not listed on either the 1884/5 or 1885/6 Rolls, but
appears on the Electoral Roll for 1886/7 at Stockton in the electorate of
Newcastle. He appears in this electorate until 1891/2. A John HALES, miner of
William St, Carrington appears on the 1903 Electoral Roll in Newcastle. He
appears again in 1906, as does a Sarah HALES.31
A John C. HALE of unknown parentage appears on
the NSW Death Index in 1890, however this entry has not been examined.
Sarah HALES of Carrington who died 30 June 1920
appears on the Probate Index however a Certificate of Search for Will did not
reveal any further information. 33

William appeared on the 1851 Census with his
parents at Waterloo St, Southwick. His age of 4 months matches his birth
details given at the time of his baptism in the Parish Register of Southwick. 17
It is believed that William is the one who was
buried on 21 April, 1852. 5
Whilst it is acknowledged that he had a cousin,
William (son of John and Isabella), this William has been noted on the 1861
Census with his mother at Southwick. 18

Although Robert's birth at Southwick has been
confirmed with his birth certificate. There is no record of his baptism in the
Southwick Parish Registers. It would seem most likely that his family relocated
shortly after this time and that he may have been baptised elsewhere.
Robert was residing with his father at the time
of the 1861 Census at 24 Cottage Row, East Murton. He is described as 5 years,
a scholar born Southwick. 18 Robert's death certificate indicated
that he was born in Murton, rather than Southwick, so it is possible the family
moved here shortly after his birth.
Robert migrated to Australia with his brother
John (and his wife Sarah) on the "Windsor Castle" which
arrived in Brisbane, Queensland on 10 March 1876. At the time, Robert was
described as single and aged 20 yrs. His brother John was 25 yrs and married.
John's wife, Sarah was 23 yrs. 9
The family travelled as Free Passengers. The
following description of Free Passengers as it relates to Queensland
immigration has been found:

"Free passengers were granted by the Government to particular categories of immigrants and their families, which were, from time to time, particularly required in Queensland. Applicants were required to pay 1 pound and a similar amount for each member of the family counted as a statute child. To be eligible, they had to be unable to pay their own passage, they could not have resided in any Australian colony, and they must intend to reside permanently in Queensland." |
Despite this, Robert made his way to Newcastle in
NSW, where he was to meet his future wife.
Robert married Isabella COURT, daughter of John COURT & Isabella BRIMBLE, 19 Feb
1881 in Hamilton, NSW, AUSTRALIA 3. Born 24 Feb 1864 in Hartley
Vale, Newcastle, NSW, AUSTRALIA 1. Died 7 Oct 1920 in Helensburgh,
NSW, AUSTRALIA 14. Buried 8 Oct 1920 in Church of England Cemetery,
Helensburgh, NSW, AUSTRALIA 14. Religion Church of England. Isabella
and Robert were married in the home of her brother, William who also consented
to the marriage as her guardian, as she was under 21 years of age and her
father was deceased. 3

It appears that Isabella and Robert moved a
several times during their marriage between Newcastle and the Illawarra
district, most likely in search of employment.
Robert was first identified on the 1882/3
Electoral Roll at Newcastle, as was his brother, John with the spelling of
their surname as HAILES, situated at Commonage.
Robert did not appear on the Electoral Roll in
1883/4 in either the Newcastle or Illawarra electorates, although it is known
that he was living at Clifton at the time. Robert is listed on the 1884/5
Electoral Roll at Clifton again with the HAILES spelling.
In 1885/86 he is in the electorate of
Northumberland at Adamstown, which is consistent with the birth of his third
child, Mary. The family appears to have remained in Newcastle, as Robert was
included on the 1886/7 Electoral Roll at Stockton in the electorate of
Newcastle.
Although it is known the family returned to the
Illawarra district as their fourth child, Isabella was born at Clifton in 1887,
Robert is not recorded on the Electoral Roll again until 1891/2 at Clifton in
the electorate of Illawarra with the spelling HALES. He is recorded here again
in 1892/3 and 1893/94, the latter spelling being HAILES. No further listings of
Robert can be found on Electoral Rolls.31
The township of Clifton came into being in 1877,
when the Coal Cliff Colliery was developed. From a Press Report in 1877 it is
learnt that a number of well built weatherboard cottages with galvanised iron
roofs had been erected about half a mile from the mine, and the spot was known
as "the Village of Clifton." The mine manager, Mr. Hale, had a villa
residence almost on the edge of the cliffs. 67
Robert was declared bankrupt twice during the
1890's. The first occurrence was on 3 Mar 1890 when Robert estimated his assets
at 4 pound and his liabilities just over 41 pounds. Among the 16 people to whom
Robert owed money was his brother-in-law Alfred Ball of Stockton to whom he owed
7 pound in 1886. His only assets were his wearing apparel.
The second occurrence was on 11 Apr 1893 at which
time Robert made the following statement:

I have filed my statement of affairs. I don't wish to amend it. I have been bankrupt before that was about 4 years ago I never obtained my certificate I was then living at Clifton was a miner my liabilities were between 30 and 40 pounds that was through slackness of work and pressure of creditors. I have not paid anything of that yet. My present occupation is that of a coal miner at Helensburgh. I kept no books of account. I attribute my present bankruptcy to slackness of work and sickness in my family. 3 at once and one died. |
At this time, his liabilities were just over 25
pound.
Construction of the Illawarra Railway between
Sydney and Nowra was carried out and used in several stages, and finally
completed in 1893. The section from Clifton to Wollongong was opened for
traffic on 21st June 1887, the Jubilee Year of the Reign of Queen
Victoria, and the Crown Street Bridge over the railway cutting near Wollongong
Station was named Jubilee Bridge to commemorate this event. 67
Two years later, Robert was killed after being
run over by a train on the Helensburgh Railway line, in 1895. The following
appeared in the "Illawarra Mercury" dated 15th June
1895:

A
FATAL ACCIDENT - A HELENSBURGH MINER KILLED BY A TRAIN A miner named Robert Hails was run over by a
train and killed early on Thursday morning in one of the tunnels near
Helensburgh railway station. He had stayed rather late in the township and on
going home had to pass though the tunnel where the accident occurred. The
driver of the train, feeling that something had been run over, stoped the
train and went back, and found the deceased lying dead and terribly bruised.
One leg was cut off and carried about two chains from the body. The
stationmaster was roused, and the Helensburgh police communicated with, and
the body was conveyed to an hotel for the inquest. The deceased, who was 39 years
of age, leaves a widow and six children unprovided for. Evidence was given by
Isabella Hails (wife of the deceased), William Hanley, James Gordall, Henry
Jeffreys (driver of the engine) Thomas Smith (guard), and the local constable
(J.H. Wilkinson). The jury returned the following verdict -'That deceased came to his death by injuries accidentally received on the 13th of May through being run over by a passing train - No.67 - in No. 2 tunnel on the Illawarra line. We desire to add the deceased was trespassing on the line, and great credit is due to the driver and guard in calling instant attention to the accident and stopping the train.' |

Robert was buried in an unmarked grave in the
Church of England section at Helensburgh Cemetery. His daughter, Sarah was
buried with her father when she died four years later. Several members of the
Hails and related families were also later buried alongside Robert, including
his daughter, Mary and her family, his wife Isabella, her second husband,
Benjamin BATEY and their infant son, Benjamin. 52

grandmother, Isabella GOUNDRY. It is known however that Isabella did not marry
Joseph GOUNDRY until 1886. Isabella also stated that her daughter and
son-in-law were married in England, when infact they were married in Newcastle,
NSW. She also stated that her daughter, Isabella was born in England, when she
too was born in Newcastle, NSW. It is not known why she gave false information
to the Registrar, except perhaps to cover the fact that she was living with
Joseph GOUNDRY without being married, although her husband had died in 1880. Is
it possible that she left her husband prior to his death and moved to Clifton
with Joseph ?
Robert purchased land at Helensburgh in 1916 from
his brother-in-law Charles CAMPBELL. This land is described as Portion 597 and
was located on Boomerang St, Helensburgh. He sold the land in 1918. 32

Bartholomew was killed in a mining accident, just 8 months after they were

Emma and Robert's marriage in 1909 was according
to the rites of the Methodist church in the home of Robert's step-father,

Alf
was in the Royal Australian Navy during WWII. He was serving on the HMAS
Canberra when it was lost in action off the Solomon Islands in August, 1942. Of
the 816 officers and men, casualties included 10 dead of wounds; 74 missing
believed killed and 109 wounded. Alf then served on the HMAS Wagga.
He first married Esther Rose Lillian
RAKE, daughter of Arthur Samuel RAKE & Clara Lillian
PHIBBS, 20 Jul 1935 in Marrickville, NSW, AUSTRALIA 12. Born 18 Aug
1916 in Redfern, NSW, AUSTRALIA 1. Died 21 Sep 2001 in Westmead,
NSW, AUSTRALIA. Buried 26 Sept 2001 at Castlebrook Crematorium, Rouse Hill,
NSW, AUSTRALIA. They were divorced 1940. Esther and the children lived at 2
Third Ave, Berala. They had the following children:

He second married Lillian Mary TAPP. Died 22 May
1978 in Cabramatta, NSW, AUSTRALIA. Alf and Lily lived at Cabramatta.
He married Esther Rose Lillian RAKE again on 14
Dec 1980 in MacMasters Beach, NSW, AUSTRALIA 3.
After being reunited and living in Esther's home
for some time, Alf and Esther both sold their homes and built a new home at
MacMasters Beach on the Central Coast of New South Wales in 1980. They lived
there up until Jan 2000 when they decided to return to Sydney and purchased a
property at Pendle Hill to be nearer to their family. Esther became ill with
pneumonia in July 2001 and while she recovered, she had become very frail and
was discharged to a nursing home, as Alf was no longer able to care for her.
Esther was again admitted to hospital in September and passed away in Westmead
Hospital on 21 Sep and was cremated at Castlebrook Crematorium.

away peacefully on 21st September 2001. Beloved wife of Alfred,
much loved mother of Trevor and Colin and mother-in-law of Heather and Carol.

Jeffrey, Sandie, Vicki and Joanne. Great grandma and Nanpop of eleven great
grandchildren. Aged
85 years The
relatives and friends of ESTHER are kindly invited to attend her

sister and mother. He was aged 6 ½ months when he died. The burial record shows

Eileen was just 3 months old when she died. She
was buried with her mother and brother.

1946 his mother purchased a home at 2 Third Avenue, Berala where he lived until
1963.
He married Caroline MARTIN,
daughter of Robert Conway MARTIN & Helen Forrest McDOUGALL, 14 Jan 1961 in
Bankstown, NSW, AUSTRALIA 3. Born 2 Apr 1941 in Kilwinning,
Ayrshire, SCOTLAND 1. Occupation Retired Shop Assistant, Food For
Less (Woolworths). Known As Carol. Caroline migrated to Australia in 1951 with
family on board the "Ormonde". Returned to Scotland in
1955 on the "Seven Seas", returning to Australia in the
same year on the "Strathaird".
Carol and Colin were married at the War Memorial
Presbyterian Church at Bankstown. At the time Colin was living at Berala and
Carol at Riverwood. The witnesses to their marriage were Colin's brother,
Trevor, and Carol's sister, June Bancroft. 3

In 1963, Colin and Carol purchased their first
home at 149 Smithfield Rd, Smithfield. They lived in the house for many years,
but decided to sell once it was known that their street was to become a major

Rd, Northmead where they still reside.

Daughter of Colin Frederick HAILS & Caroline MARTIN. Born 6 May 1962 in
Bankstown, NSW, AUSTRALIA 1. Occupation IT Training Manager, NSW
Department of Community Services.
When Vicki was born, her parents were living in
rooms at the back of 2 Third Ave, Berala the home of her paternal grandmother
Esther Hails.
In 1963, Vicki moved with her parents into their
new triple fronted red brick veneer house at 149 Smithfield Rd, Smithfield. Both
Vicki and her sister attended Smithfield Public School. Vicki later attended
Fairfield Girls High School where she completed her Higher School Certificate.
Vicki left school in 1979 and worked briefly with
Australia Post before commencing work in the Public Sector as a Clerk in 1980.
Vicki has continued to work in the same Department and held various
administrative positions and is now employed as the Department's Information
Technology Training Manager.
