For many years the research group believed that John Prestidge Sr. was the son of Thomas Prestidge
As more documentation becomes available there are now doubts about the relationship between Thomas and John. At this time I have seperated the
two individuals from each other, but have place the link to Thomas above so that information can be traced to both families and as new information is
brought forward, it will be notated here. Which could cause the research team to determine there is a link between the two individuals.

Maryland Planter of the one Part and James Sewell m Ann Arundel County and provience aforesaid, Planter of the other part Witnesseth that the said John Prestidge for and in Consideration of the sum of Ten pounds Silver Currency to him in hand paid at and before the Ensealing and Delivery of these presents by the said James Sewell the receipt where of he the said John Prestridge both herby acknowledge and himself there with fully Satisfied Contented and paid and thereof and therefrom and from every part and parcell there of both fully clearly and absolutely exonerate acquit and Discharge the said the said James Sewell his heirs and assigns forever heath given grants Bargains (unreadable) aliend (unreadable) and comfirmed and by these presents both fully (unreadable) and absolutely give grant bargarins a fell (unreadable)(unreadable) and confirm with the said James Sewell his heir and asigns for ever all that tract or Parcell of Land Called Good Neighbourhood lying and being in Ann Arundel County near the Main falls of Patapsco River. Begining at a Bounded white oak standing on a Ridge near the lines of a Tract of Land Called and known by the Name of Boltons old fields, near the main falls of Patapsco River and running thence south sixty five degrees East forty Perches then south sixty five degrees West Thrity perches,then West Twenty Perches, then North Sixy five degrees West thirty perches then by a straight Line to the beginning containing and now laid out for Seven acres and alf acre of Land more or less, Together with all and Singular the Premesses and appartenances there who belonging or in any wise apparlaining . To have and To hold the said Tract or parcell of Land aforesaid together with all and singular the premisses and appartenances unto the said James Sewell his heirs and apsigns for ever to the only proper use and Behoof of him

February the fouth 1763 In came before us the Subscribers two of his Lordships Justise of Baltimore County Court the within named John Prestidge and acknowldeges the within Indeture to be his cat and deed and the Land Premises therein mentioned to be the Right and Estate of the within named James Sewell his heirs and asigns for ever and at the same time came Ann Prestidge the wife of the said John Prestidge who being by us privately Examined out of the hearing of her said Husband (unreadable) and Voluntarily acknowledged her Consent thereto and relinquished her Right of Dower in the within Land and premipes and Declared that She did the same of ---(faded)--- free will without the compulsion of her said ---(faded)---- fear of her displeasure. Location of John Prestidge's Land On the 1612 John Smith map, it was called the Bolus River. It has never been a major path of commerce since it is not navigable further upstream. The small, unassuming Patapsco River featured prominently in the Battle of Baltimore during the War of 1812. This is where Francis Scott Key, while aboard a British ship, wrote a poem which would later become the national anthem of the United States, The Star-Spangled Banner. Today, a red, white, and blue pylon marks the spot where the HMS Tonnant was anchored. |

John Prestidge a[gainst] James Gardiner. Command was given to the Sheriff of Ann Arundel County that he should take James Gardiner late of Arrull County Wheelright if he should befound in his Bailiwick and him should safe keep so that he might have his Body before the Justices of Ann Arundel County Court to beheld at Annapolis the second Tuesday of August then next to Answer unto John Prestidge in a plea of tres pass upon the Case afd And that thereof he the said Sheriff should not fail Etc At which said Second Tuesday of August towit the 10th day of the same month Anno Dom 1762 being the day of the return of the foregoing Writ Comes thesaid John prestidge by Thomas Johnson Junior his Attorney and the Sheriff of Annll County to whom the same Writ was directed likewise comes and makes return thereof to the Court here thus Endowed Viz Capi [?] Hensey John Sheriff And the said James Gardiner being called upon appears thereupon at the Prayer of the Plaintiff by his Attorney afsd it is ruled that the said James Gardiner give Special Bail to the Action afsd thereupon a Certain Henry Dorsey son of Caleb of the same County Gent present here in Court undertakes for the said James Gardiner that in case the said John prestidge shall recover Judgment Against the said James Gardiner in the plea afs or that the said James Gardiner shall be therein legally Convict that then the said James Gardiner shall pay the Condemnation of the same thereupon or render his Body into the Custody of the Sheriff of Annll County in satisfaction thereof or that he the said Henry Dorsey son of Caleb will do the same for him And the said John Prestidge declares against the said James Gardiner in the plea afsd as follows Vzt Ann Arundell County St? James Gardiner late of Ann Arundell County Wheelwright was Attached to Answer unto John Prestidge in a plea of Trespass upon the Case Etc And Whereupon the said John by Thomas Johnson Junior his Attorney Complains that whereas the James on the nineteenth day of August in the Year seventeen hundred and Sixty one at Ann Arundell County afsd was Indebted unto him the said John in the sum of three pounds Current Money for an Article properly Chargeable in Account as by a Parcticular Account thereof herewith into Court brought may Appear and being so thereof Indebted the afsd James in Consideration thereof afterwards to wit on the day and Year afsd at the County afsd upon himself Assumed and to the said john then and there faithfully promised that he the said James the afsd Sum of Money to him the said John when afterwards he should be thereunto required would well and truly content and pay And whereas the afsd James afterwards he should be thereunto required would well and truly content and pay And Whereas the afsd James afterwards to wit on the day and Year last afsd at the County afsd was Indebted unto the said John in Another sum of three pounds Current Money for the like sum of Money to him the said James by the said John at the Special instance and request of him the said James before that time [p. 786] time lent and delivered and so thereof being Indebted the afsd James in Consideration thereof afterwards to wit on the day and Year last afsds at the County afsd upon himself Assumed and to the said John then and there faithfully promised that he the said James the last afsd Sum of Money to him the said John when afterwards he should be thereunto required would well and truly content and pay nevertheless the afsd James his Several promises and Assumptions afsd so as afsd made not regarding but minding and fraudulently intending him the said John in this behalf craftily and subtily to deceive and defraud the afsd Several Sums of Money or any part of either of them to him the said John hath not contented or paid (although so to do the afsd James afterwards to wit on the day and year last afsd and often afterwards at the County afsd by the said John requested) but the same several sums of Money or any part of either of them to him the said John to content or pay he hathereto [sic] altogether refused and still doth refuse to the damage of him the said John in the sum of Six pounds Current Money afsd and therefore he brings suit esforth Pledges Et: Jno Dee & Richd Roe
And the said James Gardiner by J Hall [?] his Attorney comes and defends the force and Injury when � and prays leave to Imparle hereunto Untill next Court and he hath it the same day is given to the Plaintiff also at which said next Court to wit the 9th day of novr Anno Dom 1762 come again the said Parties Plaintiff and Defendant by their Attornies afsd � And the said Defendant by his said Attorney prays further leave to Imparle hereunto until next Court and he hath it the same day is given to the Plaintiff also at which said Next Court to wit the 8th day of March Anno Dom 1763 Come again the said Parties Plaintiff and defendant by their Attornies afsd � And the said Defendant by his said Attorney prays further leave to Imparle here unto until next Court and he hath it the same day is given to the Plaintiff also at which said Next Court to wit the 14th day of June Anno Dom 1763 Come again as well the said John Prestidge by his Attorney afsd as the said James Gardiner by his Attorney afsd and thereupon at the Prayer of the said James Gardiner by his Attorney afsd the said John Prestidge is adjudged to give Security for Costs in Case he should be non suited in the Plea afsd but the said John Prestidge Altho Solemnly called comes not but makes default nor does he further Presente his Writ against the said James Gardiner in the Plea afsd 00 Therefore it is Considered by the Justices here the 14th day of June Anno Dom 1763 afsd that the said John Prestidge take nothing by his Writ afsd but that he and his Pledges of Prosecuting be in Mercy Etc. and that the names of his said Pledges be sought for and that the said James Gardiner go thereof without day and it is also Considered that the said James Gardiner recover against the said John Prestidge the sum of [blank] Pounds of Tobacco by the Court here unto him or his Assant [?] Adjudged as for his Costs and Charges by him about his defence in this behalf laid out and Expended And that he have thereof his Execution Etc. 12 Mar 1767. John Presredge, Jr. enters 400 acres of land on the Blackjack Branch at a gum (tree) on the branches of Birches Creek (also added another 800 acres in same entry.) Although Pittsylvania Co., was formed from Halifax Co., in 1767, but this area was still part of Halifax.

Sworn and subscribed the 27th day of September.
This Oath was to be taken by all male inhabitants of Virginia above 16 years of age and reads as follows:
"I do swear that I renounce and refuse all Allegiance to the Commonwealth of Virgina, as a free and independent state, and that I will not at any time do or cause to be done any injurious to the freedom and independence thereof; as declared by Congress; and that I will discover and make known to the some one justice of peace for the said state all treasons or traitorous conspiracies which I now or hereafter shall know to be formed against this or any of the United States of America."
In the Pittsylvania Co., VA; Court Records Book 4, 1777-1783 page 38,
"October Court 1777" when Ann Prestage sued her husband John Prestage "denying her the Necessities of Life". She was given a "separate maintenance allowance of 10 Pound Current Money levy'd yearly of the Goods and chattels of the said John Prestage."

Whereas Sarah Dupree and her family has labored and done service for me for which hereby I give, unto the said Sarah Duepee and her heirs now subsisting fifty acres of land lying and adjoining of Benjamin Hardys line, and from the right and title to the said Sarah Dup & her heirs forever and likewise I desire that the said Sarah Dupe, and her children shall not be interrupted nor distressed on the place I now live on until the 25th day of Dec. 1791.
