November Term 1843, In the matter of the estate of Joseph W. Prestridge, dec'd. Petition for dower. Came Elizabeth Moore, widow and relict of de'c and filed her petition for dower in the words and figures following: Petitioner showeth unto your Honor that Joseph W. Prestridge, dec'd was in his life and during his intermarriage with said petitioner and at the time of his death seized and possessed in fee simple of certain lands situation in the county of Dallas, and known as the SE 1/4 of Section 4, Tp. 17, Range 9, part of fraction of Cahaba River Section 9, Tp. 17, Range 9, containing 20 acres, fraction A west of Cahaba River Section 3, Tp. 17, Range 9, containing 142 acres, the E 1/2 of NE 1/4 of Section 2, Tp. 17, Range 9, half of the undivided fraction east of Cahaba River, Section 10, Tp. 17, Range 9, containing 50 acres, in which petitioner is entitled to dower; that petitioner has since the death of dec'd intermarried with Aaron Moore; That Abner G. McCraw and Abram W. Jackson are the administrators of decedent's estate, and that James M., Benjamin B., Benton R. and Martin Prestridge are heirs of said dec'd and of full age, and that Malessa M., Howell T., Joseph J. Prestridge are also heirs of dec'd under the age of 21; that the aforesaid hiers are in possession of the above described lands, wherefore petitioner prays that her dower of said lands be allotted her; and it appearing to the satisfaction of the court that said administrators in the above stated case had accepted service and waived notice of the filing of the petition, it is therefore ordered by the court that a writ of dower issue in the above case to the sheriff of Dallas County returnable to the 2nd Monday in January 1844 of this court.

Orphans Court Records, Perry Co., AL:
This day came Abner C. McGraw and Abraham W. Jackson administrators of the Estate of Joseph W. Prestridge deceased, and filed in the office of the clerk of the court their petition praying a sale of the Real state of the said Joseph W. Prestridge deceased, stating that the land described in said petition cannot be fairly and equitably divided amongst the heirs of the said deceased without a sale thereof. It is therefore ordered by the court that the matters of said petition be set for hearing on the first Friday December next and it is further ordered that R. C. Hodge, he is hereby appointed Guardian ad litim of Malessa M. Prestridge, Howell T. Prestridge, Joseph J. Prestridge, George A. (the A. is struck thru and H. inserted) Prestridge and Elizabeth J. Prestridge deceased and it is further ordered by the court that ten days notice be given to the administrators, to heirs of full age, and to R. C. Hodge the Guardian ad litim of the minor Heirs of the said Prestridge deceased.

The State of Alabama
Perry County
This indenture made and entered into, the fifth day of December One Thousand Eight hundred and forty two, between Aaron Moore of the State of Mississippi, Winston County, of the first part, and Elizabeth Prestridge, widow of the State and County aforesaid, of the second part, whereas a marriage is shortly, intended to be held and solemized by the permission of God, by, and between the said Aaron Moore, and the said Elizabeth Prestridge; and whereas both the said parties have property that they wish to dispose of according to their device, and an agreement having been made prior to the marriage between the said Aaron Moore and Elizabeth Prestridge, that the children of the said Aaron Moore should enjoy his property provided he should die first, and also that the estate now belonging, to the said Elizabeth Prestridge should belong to the heirs of her should she not survive the said Aaron Moore; Therefore this indenture witnesseth, that in pursuance of the before recited agreement, and in consideration of the sum of Five dollars, paid by the heirs of the said Aaron Moore, the receipt of which is hereby acknowledged, the said Moore hath this day granted, sold, assigned transferred and set over and by these presents doth grant, bargain, sell, assign, transfer and set over unto the children of the said Aaron Moore, all the Estate, both real and personal, which is now owned by the said Aaron Moore, provided however, that a reasonable part, and the farm and stock be for the support of said Elizabeth Prestridge intended wife of the said Aaron Moore, during her lifetime, should she be the longest liver, which portion at her death also shall be for the said children of Aaron Moore. This indenture also witnesseth, that in pursuance of the above recited agreement, and for the consideration of five dollars paid to the said Elizabeth Prestridge, by the children of the said Elizabeth Prestridge, the receipt of which is hereby acknowledged, the said Elizabeth Prestridge hath granted, bargained, sold, assigned, transferred and set over, and by these presents doth grant, bargain, sell, assign, transfer and set over unto the heirs of her body, all the property which she does now, or may own at her death. In witness whereof, we hereunto set our hands and affix our seals, the day and date above mentioned.
