This Indenture made the Twenty seventh day of May in the year of our Lord one thousand eight hundred and thirty seven Between Martin Zettelmoyer and George Zettelmoyer of the township of Greenwich in the County of Berks and state of Pennsylvania Executors of the last will and testament of George Adam Zettelmoyer late of the township of Greenwich in the County and State aforesaid deceased of the one part and George Adam Zettelmoyer (a son of said decd) of the aforesaid Greenwich Township County and state Yeoman of the other part Witnesseth that the said Martin Zettelmoyer and George Zettelmoyer Executors as aforesaid for and in Consideration of the sum of one thousand and ninety five dollars (Exclusive of the dower hereinafter inserted) lawful money of the United States to them in hand well and truly paid by the said George Adam Zettlemoyer at and before the ensealing and delivery hereof the receipt whereof they do hereby acknowledge and thereof do acquit and forever discharge the said George Adam Zettelmoyer his heirs executors and administrators by these presents have granted bargained sold aliened enfeoffed released and confirmed and by these presents (by virtue of the power and authority to them given) do grant bargain sell alien enfeoff release and confirm unto the said George Adam Zettelmoyer and to his heirs and assigns All that certain Messuage Tenement and tract of Land situate lying and being in Greenwich township County and State aforesaid bounded by lands of Jacob and Benjamin Merkel Henry Lenhart Daniel Keller Daniel Stump and said Geo A. Zettelmoyer and others Containing one hundred and fifty Acres and allowances be the same more or less It being the same tract of Land which Abraham Baily and Magdalena his wife by their Deed Poll bearing date the twenty seventh day of March AD one thousand Eight hundred and eleven for the Consideration therein mentioned did grant and Confirm unto the said George Adam Zettelmoyer deceased and to his heirs and assigns forever, And Whereas the said George Adam Zettelmoyer died intestate [an error] made his last will and testament in writing bearing date the twenty seventh day of March A.D. one thousand eight hundred and thirty six wherein and whereby he authorized and directed his Executors to make sale of his Real Estate as in and by the said recited will since his decease duly proven and remaining in the Register’s office at Reading in and for Berks County relation being thereto had fully appears.

Together also with all and singular the houses out houses barns stables gardens orchards meadows fields fences ways woods waters water courses rights liberties privileges hereditaments and Appurtenances whatsoever thereunto belonging or in any wise appertaining.

Subject to a dower of Nine Hundred and thirty three dollars and thirty three cents to be paid out of the above described tract of land immediately after the death of Susanna Bailey widow and relict of Peter Bailey deceased unto the legal heirs of said decd together with the yearly interest accruing out of the aforesaid dower or lien to be paid annually on the day of unto the said widow during her life And the reversions and remainders rents issues and profits thereof and also all the estate right title interest use trust property possession claim and demand whatsoever of him the said George Adam Zettelmoyer at and immediately before the time of his decease in law or equity or otherwise howsoever of in to or out of the same. To Have and To Hold the said above described Messuage Tenement and tract of Land Containing one hundred & fifty acres & allow more or less hereditaments and premises hereby granted and released or mentioned or intended so to be with the Appurtenances (Except the above dower or lien[)] unto the said George Adam Zettelmoyer his heirs and assigns to the only proper use and behoof of him the said George Adam Zettelmoyer his heirs and assigns forever.

Subject to the payment of the arrearages of the Principal and interest (if any) due to the Commonwealth of Pennsylvania for patenting the same and the said Martin Zettelmoyer and George Zettelmoyer Executors aforesaid for themselves their heirs Exs & Adms do severally and not jointly nor the one for the other or for the Act or deed of the other but each for his own acts only Covenant promise grant and agree to and with the said George Adam Zettelmoyer his heirs and assigns by these presents that the said Martin Zettelmoyer and George Zettlemoyer have not done committed or wittingly or willingly suffered to be done or Committed any act matter or thing whatsoever whereby the premises aforesaid or any part or parcel thereof is are shall or may be impeached charged or incumbered in Title Charge or Estate otherwise howsoever (Except the above Dower) In Witness Whereof the said Martin Zettelmoyer and George Zettlemoyer to these presents have hereunto set their hands and seals dated the day and year first above written.

Received the day of the date of the above written Indenture of and from the above named George Adam Zettelmoyer the sum of One Thousand ninety five dollars in gold or silver money it being the Consideration money mentioned in full now due and payable.

Be it Remembered that on the twenty seventh day of May Anno Domini 1837 before me Sam’l Hoffman Esquire one of the Justices of the Peace of the said County personally Came the above named Martin Zettelmoyer and George Zettelmoyer and acknowledged the above indenture to be their Act and deed and desired that the same might be recorded as such according to law. In testimony whereof I have hereunto set my hand and seal the day and year first above written.

Comments: This deed, as well as the one recorded in Deed Book 88 at page 647, make me wonder what other deeds these executors may have made that were not recorded for some reason. The conveyance is to their brother George Adam, Jr., who married first Maria Magdalena Miller and second Esther Reichelderfer.
