This Indenture made the first day of April in the year of our Lord one thousand eight hundred and seventy four Between Elias Baver of the township of Greenwich County of Berks and state of Pennsylvania and Elizabeth his wife of the one part and William Zettlemoyer of the township of Greenwich County and state aforesaid party of the other part Witnesseth that the said Elias Baver and Elizabeth his wife for and in Consideration of the sum of Four thousand one hundred and fifty seven dollars and eighty six cents lawful money of the United States of America unto them well and truly paid by the said William Zettlemoyer at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged have granted bargained sold aliened enfeoffed released and Confirmed and by these presents to bargain sell alien enfeoff release and Confirm unto the said William Zettlemoyer his heirs and assigns

All that Certain Messuage Tenement and tract of land situate in the township of Greenwich bounded and described as follows to wit Beginning at a chestnut oak thence by land of late Henry Hartinger north eighty four degrees East fifty perches to a chestnut tree north fifty four and a half degs. East thirty four perches to a stone north seventy eight degs East forty seven perches to a point near a spring south twelve degs East one perch North seventy eight degs East one perch north twelve degs west one perch North seventy eight degs East forty four perches to a stone south eleven degs East twenty eight perches to a stone and north eighty four degs East fourty four and four tenth perches to a stone thence by land of George Adam Zettlemoyer north two degs west thirty four perches thence along saw mill land south seventy one degs west twenty four perches north two and a half degs west twelve perches north eighty five and a half degs East twenty three perches and north two degs west thirty seven perches to a stone thence along land of late George Yenser north sixty seven and a half degs west one hundred and four perches to a stone thence along land of Martin Zettlemoyer south forty seven degs west fifty eight perches to a stone north forty six degs west twelve perches to a stone and south eighty one degs west fifty three perches to a stone thence along land of now Jonathan Seidel south nine degrees west one hundred and four and a half perches to the place of beginning Containing one hundred and seventeen acres and one hundred and six perches strict measure It being the same premises which Charles Zettlemoyer Administrator of all and singular the goods and Chattels rights and credits which were of Jonas Zettlemoyer at the time of his death who died intestate and in pursuance of an order of the Orphans Court of the said County Berks for the sale of the real estate of the said intestate by indenture under the hand and seal of the said Charles Zettlemoyer bearing date the first day of April AD one thousand eight hundred and seventy four for the Consideration therein mentioned did grant and Confirm unto Elias Baver party hereto and to his heirs and assigns forever as in and by the said recited Indenture Relation being thereunto had more fuuuly and at large appears.

Together with all and singular buildings improvements ways waters water Courses rights liberties privileges hereditaments and Appurtenances whatsoever thereunto belonging or in any wise appertaining and the reversions and remainders rents issues and profits thereof and all the estate right title interest property Claim and demand whatsoever of them the said Elias Baver and Eliza his wife in law equity or otherwise howsoever of in and to the same and every part thereof Excepting and Reserving unto the said George Adam Zettlemoyer a piece of Meadow lying west of his saw mill (Containing about acres) for his use during his natural life To Have and To Hold the said described one hundred and seventeen acres and one hundred and six perches hereditaments and premises hereby granted or mentioned and intended so to be with the appurtenances unto the said William Zettlemoyer his heirs and assigns to and for the only proper use and behoof of the said William Zettlemoyer his heirs and assigns forever And the said Elias Baver and Eliza his wife for themselves their heirs executors and administrators do by these presents covenant grant and agree to and with the said William Zettlemoyer his heirs and assigns that they the said Elias Baver and Eliza his wife their heirs all and singular the hereditaments and premises herein above described and granted or mentioned and intended so to be with the Appurtenances unto the said William Zettlemoyer his heirs and assigns against them the said Elias Baver and Eliza his wife their heirs and against all and every other person or persons whomsoever lawfully Claiming or to claim the same or any part thereof by from or under him or them or any of them shall and will warrant and forever defend In Witness Whereof the said parties to these presents have hereunto interchangeably set their hands and seals dated the day and year first above written.

Received the day of the date of the within or aforegoing indenture of the within named William Zettlemoyer the sum of four thousand one hundred and fifty seven dollars and eighty six cents in full being for the Consideration money within mentioned.

On the first day of April Anno Domini 1874 before me one of the Justices of the Peace in and for said County personally appeared the above named Elias Baver and Eliza his wife and in due form of law acknowledged the above Indenture to be their and each of their Act and deed and desired the same might be recorded as such and the said Eliza being of full age and separate and apart from her said husband by me thereon privately examined and the full Contents of the above Deed being by me first made known unto her did thereupon declare and say that she did voluntarily and of her own free will and accord sign seal and as her Act and deed deliver the above written Indenture deed or Conveyance without any Coercion or Compulsion of her said husband Witness my hand and seal the day and year aforesaid.

Comments: References in the deed help to establish the identity of the grantee, William Zettlemoyer. Jonas Zettlemoyer was the eldest son of George Adam Zettelmeyer, Jr. and Maria Magdalena Miller. Jonas was apparently dead by 1873 when his father made his will because Jonas was not mentioned in the will. Charles was his next younger brother and he would have been a likely choice to serve as administrator of Jonas’ estate. William was their half-brother, the first child of their father by his second wife, Esther Reichelderfer. He and his wife, Mary Knepper, had their third child born the month before this deed.
