  • Note*: 1837; Arkansas Gazette, Hot Springs, Hot Springs Co., Arkansas, USA; My "John Wells", also known in one source as aka "Daniel Wiggins", is proven by DNA testing NOT to be the son of Christopher Wells of PA whose son is named "John Wells" also found later in Texas. Since my ancestor did go by John Wells I will continue to refer to him by that name although his true identity isn't known by me at this time.

John did live in Arkansas where he married Lydia Collier. John is accused of murdering William McKinney of Mt. Ida, Arkansas, in 1837 over a land despute then fleeing with the family to Texas where he is found in Montgomery County in 1839. The newspaper "Arkansas Gazette" has more information surrounding this event.

Much mystery surrounds my ancestor and the murder of William McKinney. One McKinney relation wonders if the murder was staged to allow William to escape to Barry County, MO, where his son George McKinney was executor of a William McKinney who died in 1888 and was the same age as George's father. In the same write up witnesses to the murder say the killer escaped while others say they know the man was shot to death shortly after trying to escape - both these stories can't be true, which is?

The Governor of Arkansas, James Conway, posted a $300 reward in January, 1838, for the capture of John Wells/Daniel Wiggins, physical description: "Said fugitive is described to be six feet or upwards in height, thin visage, large nose, r rather turned to one side; blue eyes, with a small speck in one of them; dark hair, becoming gray; a scar above one of his ears in his hair. It is believed he wore away a green blanket coat; that he crossed the Red River near or opposite Jonesborough. It is said he has a son-in-law of the name Samuel, who resides on or beyond the Sulpher Fork, in Texas, to the house of whom he will most probably go."

Another newspaper posting: December 26, 1837 -Another Outrage - In an affray in Hot Spring County, on the 1st inst., between John Wells and Wm. McKinney, the latter was shot dead by Wells, who immediately fled, it is supposed, towards the Sulpher Fork of Red River. A reward is offered for his apprehension, by the widow of the deceased.

Then this strange set of postings for a John Maxwell, also accused of murder by Elizabeth (Allie) McKinney:

    March 22, 1836

    A Proclamation,
By the Governor of the Territory of Arkansas

Whereas a bill of indictment for murder was found against JOHN MAXWELL [for the murder of George G. McKinney over an election dispute, 1835?], by the Grand Jury in and for the county of Arkansas; and it appearing that the said John Maxwell has made his escape, and is now going at large:

Now, therefore, I, William S. Fulton, Governor of the Territory of Arkansas, have thought proper to issue this Proclamation, hereby offering a reward of Two Hundred Dollars, to any person or persons who will arrest the said fugitive and deliver him to the Sheriff of Arkansas County. And, I do, moreover, hereby require all officers, both civil and military, and request the good people of this Territory, to use their best exertions to apprehend the said fugitive, that he may be dealt with according to law.

Given under my hand as Governor, and under the seal of the Territory of Arkansas, at Little Rock, this twenty-sixth day of October, eighteen hundred and thirty-five.

    WS. Fulton

    $500 Reward

The above reward of Five Hundred Dollars will be paid for the apprehension and delivery, at the county of Arkansas, in this Territory, on the aboved named John Maxwell, independent of the reward offered in the foregoing proclamation of the Governor of Arkansas.

The murder committed by the said Maxwell was most unprovoked and diabolical; and it is urgently requested that all well-disposed citizens will aid in apprehending and bringing to justice the felon.

Said Maxwell is a tall, spare man, with rater a wan and wrinkled face, grave deportment, and a little lisp in his voice, and sometimes wears spectacles - a gunsmith by trade.

A.C. McKinney, Agent for Elizabeth McKinney
Post of Arkansas, December 16, 1835

Later postings indicate the charges were dropped against John Maxwell in 1837 when the shooting was ruled "self defense" - see http://genforum.genealogy.com/maxwell/messages/5250.html for details; Maxwell himself was murdered in 1838 at Arkansas Post Still...strange string of events involving McKinney and Maxwell families plus Wells. Hopefully some day all this will be separated into "facts" and timelines.]

A search through the remaining records from the County Poor Farm (located at Henry Co Historical Library in Clinton) provided no clues, ' but most records were lost during transfer from Court House to the library. He is probably not buried at Kepner Cemetery, Urich, next to his wife, Sarah -- as there is no note thatRandolph pointed out Daniels grave in 1938 when he showed his daughter, Amanda, where he was to be buried and where his wives and children were buried. . Daniel and Sarah's daughter, ''Tina'', who was also at the poor farm at the time of Daniel's death, was buried at Kepner as were Daniel/Sarah's sons Merideth and Randolph and 3 of Randolph's wives and two of his children.2
