Will of John Hyslop of McCriericks Cairn, Kirkconnell.
May 13th 1862.

 

I John Hyslop tenant in McCriericks Cairn do hereby nominate and appoint my son James Hyslop to be my sole and universal executer, and excluding and debarring all others from that office giving Grantivy and bequeathing to my said Son the whole personal estate belonging or that may belong to me at my death with the whole nilts and vouchers there of. But always under the burden of the payment of all my just and lawful debts deathbed and funeral charges and such legacies as I may appoint to be paid by any writing under my hand and I ordain my said son to pay my wife Margaret Hunter in case she shall survive me during all the days of her life an annuity of Fifteen pounds sterling and that at two terms in the year Whitsunday and  Martinmas by equal portions beginning the first terms of payment of the said Annuity at the first term of Whitsunday or Martinmas that shall arrive after my decease and thereafter at these two terms dividing the lifetime of my said wife with one fifth part more of each terms payment of penalty in case of failure and the legal interest of the same from and after the respective terms of payment until payment there of which said annuity shall be accepted by my said wife in full payment and satisfaction to her of all claim and demands competent to her under our contract of marriage or otherwise and I further ordain my said son to pay the following legacies to the parties after named at the first term of Whitsunday or Martinmas that shall arrive after my death with interest and penalty in common form in case of failure.
To John Hyslop in Upper Cairn my Grandson Forty pounds, to John Hyslop son of the said James Hyslop my son the like sum of forty pounds, to John Hyslop the son of Thomas Hyslop my son the like sum of forty pounds. And to John Hyslop tailor in Kirkconnell the like sum of forty pounds.
And I revoke all settlements mortis causa made by me prior to the date hereof and I declare that these presents shall be good and effectual, in my custody or in the custody of any person for my behalf  undelivered at the time of my death. With the delivery thereof I dispense forever. In witness where of I have subscribed these presents written on this and the preceding page by James Veitch Junior banker in Sanquhar at McCriericks Cairn aforesaid the twenty-first day of November in the year one thousand eight hundred and fifty six, before these witnesses, Thomas Hyslop and William Hyslop both sons of the said James Hyslop and both residing at McCriericks Cairn.
