Rowan County: Formed 1753 from Anson County. Recording of wills began in 1760, and there has been no significant loss of records. From about 1780 to about 1800, the county appears to have recorded wills in blocks arranged by first letter of the surname but not in alphabetical order. Several of the Rowan County original wills are in German and unless they were translated at the time of probate, the contents were not recorded in the will books. Ute-Ingrid Seidler translated and abstracted German language wills of Rowan County in the State Archives in North Carolina Genealogical Society Journal, Vol. 1, No-. 3 (July, 1975), pp. 136-140.

COMMENT: Next to Matthew HILL, near Philip WILSON (who lived by Dan River). Other DAVIS families in same district: William, James, John (name group near Stephen & William CLEATON), Daniel; in nearby Hill's Dist. were Samuel & George. None were near Morgan and no indication of kinship has been found. Morgan's oldest known son, Jonathan, had a son Joshua (1794NC-1856MO) so he could have been born c.1764 and the other male >21 in Morgan's household. Note Morgan & 5 males in Census; 4 sons mentioned in Will so possibly one son unknown.

Comment if there are five males + Morgan and there was only 4 sons mention in Morgan will. Question was the fifth male a son or just a male?

1790C Stokes: Morgan DAVIS m: 2 >=16, 3 <16; f: 4; 0 slaves. Still next to Matthew HILL, 5 entries from William CLAYTON 1 1 2 00 [who probably lived on some of Morgan's 400 acres]. Still no other DAVIS families in close proximity. [Note 1 less female than in 1786; Stephen CLAYTON 3 got married 1786/87. One son had died or moved; Jesse, John & Amos <16. A Jonathan DAVIS (1 0 1 00) was quite a few names removed, apparently not Morgan's son.]

1794 04 Jan (Stokes DB 2/124) Phillip WILSON & wife Rebeca... to Jonathan DAVIS [both of Stokes Co].... 150 pds.. 250 acres...Dan River.. crossing said River.. Wit. Morgan DAVIS & Joel HALBERT [neighbor, or Jonathan's brother-in-law?]; proved September term 1794 by Morgan DAVIS. [This was probably the same 250 acres Jonathan sold in 1799 - see below.]

1794 04 Mar (Stokes DB 2/107) Morgan DAVIS...to David POINDEXTER both of Stokes Co.... 150 pds...containing by grants 400 acres...Dan River. Signed Morgan DAVIS (no witness or mention of wife); proved March term 1794 by Morgan DAVIS.

COMMENT: Two of David Poindexter's daughters married Halberts. Elizabeth married Joel Halbert III and Susan married Martin Halbert.

1795 07 Sep (Stokes NC DB 2/217) John BAILEY and David SMITH his attorney... [sell to] Daniel SMITH...each of Stokes Co... 40 pounds... land on waters of Camp Creek...100 acres. Signed David X (his mark) SMITH for John BAILEY; wit. Jas. COFFEY & Sarah COFFEY; proved by James COFFEY Senr.

COMMENT: David & Daniel SMITH seem to have been brothers, sons of John SMITH in 1786C (2 6 3 00 near Morgan DAVIS). John BAILEY, who was probably in KY at the time, showed great trust in David. By 1799 David SMITH (born c.1772) was Morgan DAVIS' son-in-law (DB 3/285 - Morgan sold him land at half value); perhaps David's first wife was John BAILEY's daughter. David was in TN in 1805 when he sold out (DB 5/69,107; /s/ X his mark).

Tennessee

1799 01 Aug (Stokes DB 3/285) Morgan DAVIS of the County of Knox in the State of Tennessee to David SMITH of Stokes Co....100 pounds...200 acres on Dan River. Signed Morgan DAVIS; witnesses Samuel WELCH, Jos. DAVIS; proved March term 1800 by Samuel WELCH.

COMMENT: David SMITH almost certainly married Morgan's daughter Elizabeth (see 1820C & Morgan's 1821 Will); Morgan seems to have sold the land at half value--see next. Witness "Jos." has not been identified; perhaps Morgan had a son Joseph or Josiah, born before 1778, who died before 1821. "Jos." may have been "Jas.", but James DAVIS in that area had 5 slaves in 1790 Census and seems unrelated to Morgan DAVIS. It seems most likely the witness was actually Jonathan or Jesse.

Comment: the Welch family travels with Davis and Smith family could there be marriage between this families?

Normal currency unit was the dollar "united States of America" by 1805.]

In the name of God Amen; I Morgan Davis of the County of Lincoln, in State of ___ Being weak in body, But of perfect mind 7 Memory, thanks be to the Almighty God, calling unto mind the immortally of my body & knowing it is appointed for all men once to die . do make & ordain this my last will & testament, that is to say principally at firsts of all I give & commended my Soul into the hand of God that gave it & my body & commended to the earth to be buried in a decent Christian burial at discretion of my executor which I shall appointing doubting but at the general _____ I shall receive the same again by the mighty power of God Ann as touching such world estate as where willed a has pleased God to help me with in this life, I give & dismiss of the same in other mime ________ following.

First it is my will that my beloved daughters Daughters Elizabeth SMITH, Sally CLAYTON, Ann WILLIAMS and Hannah HALBERT , have fifty dollar each, to be paid out or my money that is owning to me & my household furniture to be equally divide amongest my said your daughter and it is my will that my beloved daughter Mary CLAYTON have thirthy dollars paid out of my money that is owning me. In the presence of Brice Garner clark of the court ____ do certify that the said executor of the ___- of Morgan Davis was Proven in open court by the oaths of Abraham Sunmens & Jacob Albright who say they here & the said Morgan Davis acknowledge this to be his last will and testament & thy belived at the ___ of signing sealina & publishing the same he was of sound mind & memory which is order to be seconded & certified Records Sept 2nd 1831 Brice Garner clk

COMMENT: Only stated assets: one slave and money owing him, [from business?]. "Sarah ["Sally"] CLAYTON wife" wit. Wm. CLAYTON's sale 250 acres, waters of Little Snow Creek, Stokes Co. NC, 14 Mar 1796 (DB 4/334); William had bought the land Feb 1790 (DB 1/50). Mary almost certainly married Wm.'s brother Stephen CLAYTON 3; they also sold out 1796 (Stokes DB 2/401) and were in Hall Co. GA when Morgan DAVIS wrote his Will. Ann (DAVIS) WILLIAM's husband is unknown. Hannah DAVIS probably married a grandson of Joel HALBERT, who bought Stephen CLAYTON 2's mill on Snow Creek by Dan River in 1790 (DB 1/21), but which one is unknown. Will recorder apparently erred and the Will read: "It is also my will that the children of my beloved son Johnathan have thirty dollars to be equally divided amongst them." Jonathan DAVIS (clearly Morgan's son) died in Williamson Co. and his brother Amos admin. his estate, Feb and Mar 1808 (WB 1/183,184).

Marian Rankin Butler

Retired social worker

FRANKFORT, Ky. -- Marian E. Rankin Butler, 78, of Frankfort, formerly of Jonesboro, died Tuesday, Feb. 22, at Frankfort Regional Medical Center.

A Tampa, Fla., native, she was a social worker for the Arkansas Department of Social Services and a graduate of Jonesboro High School and Arkansas State University.

She was a member of the Genealogy Society of Craighead County and First Presbyterian Church of Jonesboro.

Survivors include a daughter, Gail Butler Hiley of Frankfort; a sister, Louise Rankin May of Southaven, Miss.; and two brothers, Thomas L. Rankin and Charles N. Rankin of Jonesboro.

She was preceded in death by her husband, John W. Butler Jr., and her parents, Nathan Lewis and Mary Gladys Davis Rankin.

Jonesboro services will be announced at a later date. LeCompte Johnson Taylor Funeral Home of Frankfort is in charge of arrangements.
