Robert Allen Bungate will
On November 11, 1837 Robert ALLEN made his will as follows:

This is the last Will and Testament of me Robert Allen of Whaplode in the County of Lincoln, Yeoman as follows:-    First I direct all my just Debts, Funeral and Testamentary Expenses to be fully paid and satisfied.  Also I give and devise unto my friends - James Osbourne of Whaplode aforesaid Grocer and Draper and James Watson of the same place, Farmer all that messuage? or permanent with the outbuildings, garden and appertainances? thereto belonging situated at Whaplode aforesaid and now in my own occupation, to hold the same unto said James Osbourne and James Watson and their heirs upon trust that they or the survivor of them or the heirs of such survivor do and shall as soon as conveniently can be after my decease make sale and dispose of the same either by public auction or private contract as he or they may think proper for the best price and most money that can be reasonably obtained for the same and to make infer, unto and execute all my necessary contracts conveyances and assurances and for facilitating such sale my will is and I do declare that the receipt or receipt of the said James Osbourne and
James Watson or the survivor of them or other person or persons acting in the execution of the trusts of this my wilier the money for which my said real estate shall be sold shall be sufficient in discharge to the purchaser or purchasers of the same for his her or their purchase money or so much thereof as shall be therein expressed or acknowledged to have been received. And that such purchaser or purchasers his her or their heirs executors administrators or assigns or any of them shall not be obliged to see to the application of the said purchasers money or monies or any part thereof nor be in any wise answerable or accountable for the ? misapplication or nonapplication of the same.   And my further will is that the said James Osbourne and James Watson or the survivor of them or the heirs of such survivor shall stand possessed of the money to arise and receive by or from such sale as aforesaid upon the trusts hereinafter mentioned. Also I   give and bequeath unto the said James Osbourne and James Watson their Executors administrators and assigned All and singular my household furniture, plates, linen and china, money and securities for money goods chattels personal Estate and Effects whatsoever and wheresoever at the time of my decease Upon trust that they or the survivor of them do and shall collect and get in all such parts of my said personal Estate as shall consist of money or securities for money. And do and shall sell and dispose of all such or other parts thereof as shall not consist of money or securities for money And do and shall stand possessed of the money to arise from such conversion, sale and disposition And also therein money to arise from the sale and disposition of my real estate hereinbefore directed to be sold upon trust / after deducting thereout, the costs charges and expenses of and attending the making and completing such sale and sales my just Debts, Funeral and Testamentary expenses and all other expenses that the said James Osbourne and James Watson or the survivor of them may expend or be put unto ? or  about the same / to pay to my Daughter Susanna the wife of Joseph Rogerson of London, Salesman, the legacy or ? of Twenty Pounds And then shall pay distribute and Dis? the clear net residue or surplas of the said such money unto, between and amongst my said daughter Susanna, my natural or reputed son Robert Allen Bungate and my son Thomas Allen equally share and share alike and to their respective executors administrators and assigns And I appoint the said James Osbourne and James Watson Trustees and Executors of this my will and do declare that they or


either of them shall not be answerable or accountable for any more of the said trust money that they or he shall actually receive Nor for any loss that may happen thereto unless wilfully occasioned and that it shall be lawful for each of them to deduct and retain out of the  said trust monies all costs charges and ? which they shall respectively sustain expend or be put untoin and about the execution of the aforesaid trust or in any way relating thereto.  And I revoke all former wills by me at any time before made and declare this to be my Last Will and Testament.  In Witness whereof I the said Robert Allen the Testator have hereinto set my name and seal the eleventh day of November One Thousand Eight Hundred and Thirty Seven.

My Codicil  to be taken as part of the Will of me Robert Allen bearing date the eleventh day of November One Thousand Eight Hundred and Thirty Seven.

Whereas my Daughter Susanna the wife of Joseph Rogerson hath departed this life since the date and execution of my said Will Wherefore I give and bequethas well the Legacy of Twenty Pounds and also the share of the resulting trust money respectively bequethed to my said Daughter by my said Will unto my Granddaughter Penelope Ann Rogerson to be paid to her at her age of Twenty One years. And I will the said monies to be placed out at interest and such interest be applied if requisite towards the  maintainance and support of my said Grandaughter living her ? . And in case she shall happen to die under age and unmarried then I give and bequeth the said Legacy and share unto and
between the other residuary Legatees  in my said Will divided equally share and share alike And I ratify and confirm my said Will in all other respects.In

Robert ALLEN died on the 28 October 1842, his estate settled, then in December this notation was filed with his Will.

Will of Robt Allen     On the 18th day of December 1842 James Osbourne
 Whaplode             and James Watson the Executers named in the written Will
 -----------------         of the written named Robert Allen were severally duty
 with Codacil ?         sworn and severally made oath that to the best of their
 1842             knowledge information and belief the whole of the Goods
 Sub £300     Chattels and credits of which the said testator Robert Allen died Posessed are under the Value of Three Hundred Pounds.
