WILL OF JAMES WARNOCK - 1866
I, James Warnock, of Greenup County, State of Kentucky, of sound and disposing mind, considering the undertainty extended life do publish this, my Last Will and Testament.
First, I bequeath to my beloved wife, Rebecca, all my estate, both real and personal, during her natural life after the payment of my just debts and my funeral, and bequests hereafter mentioned requiring of her to provide of the ... a suitable maintenance for my beloved daughter, Cynthia.
Second, After the death of my wife, I bequeath to my youngest son, James Wesley Warnock, the whole of the tract of land on which I now live thereon enjoin on him to take charge of his mother and her business during her life.
Third, I bequeath to the benefit of my beloved daughter, Cynthia, the wages of my negro boy, Alfred, to be hired out from year to year by my executors hereafter named, and the money arising therefrom applied to her use during the joint lives of said Cynthia and said Alfred. Should said Alfred die first, or any other unavoidable cause deprive my daughter Cynthia of the benefit of his hire, then I desire that other equivalent provisions out of my estate be made for her support during her natural life, and should my daughter, Cynthia, die first the said Alfred is to become a distributable part of my estate.
Fourth, I bequeath to my daughter, Sally Alexander, one hundred dollars in money to be raised out of my estate as soon as convenient after my death, but having heretofore given her a negro girl and other articles of value, I desire that my estate not be embarrassed by this legacy beyond the convenience of my executors who in providing for the same are to have a just regard to the interest of my whole estate.
Fifth, After the death of my beloved wife it is my will and desire that all my remaining estate be sold and the procedes equally divided among my lawful heirs, but if my daughter Cynthia and the Alfred be living, she is to retain the benefits of his hire as heretofore provided in lieu of her distributable share.
Sixth, I hereby appoint and constitute my sons Matthew, John W. H., William B. and James W. Warnock, or any one or more who choose to act as my executors of this my Last Will and Testament hereby revoking all former wills made by me.
