John Romich, born April 17, 1797, died November 21, 1834
 

I, John Romich of Earl Township, in the County of Berks and State of Pennsylvania do make
and publish this my last Will and Testament as follows to wit.

Principally I recommend my Soul into the hands of God who gave it to me.

Item, It is my will that the whole of my personal estate be sold as soon as convenient.

Item, it is my will that the Plantation which I have lately purchased from John Nine, situate in
the State of Ohio, containing one hundred and sixty acres, more or less shall be paid unto the said John Nine agreeably to the contract between us provided he perform the said contract on his part.

Item, I give and bequeath unto my beloved wife, Mary, the use and occupation of my said Plantation until my son Andrew arrives at the age of twenty one years. She maintaining and educating my children out of the proceeds there of, provided she continues my widow.

Item, I give and bequeath unto my said wife, Mary, after my said son Andrew arrives at the age of twenty one years, provided she continues my widow, the annual interest accruing on the one third of the valuation of my said Plantation. Sufficient room in the house on my said Plantation to live in and to accommodate her goods also sufficient firewood ready cut and hauled to her door and also all the monies which remain after the payment of my said Plantation and all my other debts, but in case my said wife should marry again, all what I have herein given to her during her widow hood, shall immediately after her marriage fall to my children in equal shares and I give and bequeath unto her seventy five dollars worth of the household goods and furniture belonging to my estate at that time.

Item, It is my will that as soon as my son, Andrew arrives at the age of twenty one years my said Plantation shall be appraised by six disinterested respectable Men of that neighborhood to be chosen by my said wife my son and the guardians of my other children.

Item, I give and devise unto my said son, Andrew my said plantation situate in the State of Ohio, containing one hundred and sixty acres more or less with the appurtenances at the valuation there of to hold the same to him, his heirs and assigns for ever. He paying the same in the following manner to wit. The Interest accruing on the one third of the said valuation annually unto my said wife provided she continues my widow. And after the decease or marriage of my said wife the principals unto all my children in equal share, my said son Andrew to retain his equal share there of and the remaining two thirds of the said valuation in ten equal annual payments, without interest to commence one year after my said son arrives at the age of twenty one years, unto all my children on whole payment always to be paid to one of my said children and to commence with the oldest and end with the youngest and my said son Andrew to take or retain his equal share in rotation with my other children. Subject nevertheless to the privilege which I have herein given to my said wife to live on the said Plantation and to have her firewood ready cut and hauled to her door provided she continues my widow.

Item, It is my will that in case my said son Andrew should die before he takes my said Plantation as aforsaid my said Plantation shall be sold at public sale by my Executors subject to the payment of the interest accruing on the one third of the purchase money annually unto my said wife during her widowhood, and after her decease or marriage.

Item, It is my will that in case any of my children should die under age and without _____, the Legacy hereby given such child or children to dying as aforesaid shall be equally divided amongest my other children or their legal representatives.
Lastly I nominate constitute and appoint my said wife Mary and my Father in Law,
Andrew Weilar to be the Executors of this my last will and testament.

Berks County, Pa., On the 5th day of January A.D. 1835, there appeared Jacob Romich
and Jacob Weisner and being duly sworn according to law, did depose and say that they were present and saw and heard John Romich, the Testator, sign, seal, publish, pronounce and declare this instrument of writing as and for his last will and Testament and that at the time of the doing thereof, he was of sound and disposing mind, memory and understanding to the best of their knowledge, observation and belief and likewise acknowledged the names signed there to as witness to be their own proper hand writing,
